Keystone XL ‘Black Snake’ Pipeline to Face ‘Epic’ Opposition from Native American Alliance

A Native American alliance is forming to block construction of TransCanada’s proposed Keystone XL pipeline which still needs final approval from U.S. President Barack Obama after the State Department released an environmental report indicating the project wouldn’t have a significant impact Alberta tar sands production.

Members from the seven tribes of the Lakota Nation, along with tribal members and tribes in Idaho, Oklahoma, Montana, Nebraska and Oregon, have been preparing to stop construction of the 1,400 kilometre pipeline which is slated to run, on the U.S. side, from Morgan, Mon., to Steel City, Neb., and pump 830,000 barrels per day from Alberta’s tar sands. The pipeline would originate in Hardisty, Alta.

“It poses a threat to our sacred water and the product is coming from the tar sands and our tribes oppose the tar sands mining,” said Deborah White Plume, of the Oglala Sioux Tribe, which is part of the Lakota Nation in South Dakota. “All of our tribes have taken action to oppose the Keystone XL pipeline.”

The U.S. State Department released its long awaited environmental report on TransCanada’s proposed pipeline Friday. The report found that the pipeline’s operation would not have a major impact on Alberta tar sands production which is also at the mercy of market forces.

“Approval or denial of any one crude oil transport project, including the proposed project, is unlikely to significantly impact the rate of extraction in the oil sands or the continued demand for heavy crude oil at refineries in the United States based on expected oil prices, oil sand supply costs, transport costs and supply-demand scenarios,” said the report.

The project will now go into a final phase which focuses on whether Keystone XL “serves the national interest.” Pipeline’s environmental, cultural and economic impacts will be weighed in this phase and at least eight agencies will have input on the outcome, including the Department Defence, Justice, Interior, Commerce, Transportation, Energy, Homeland Security and the Environmental Protection Agency.

As some double-down their efforts to engage in the corrupt political process surrounding the northern leg of Keystone XL, we want to take some time to honor three brave womyn currently imprisoned by the state for resisting another tar sands pipeline in their backyard.

On Friday, Vicci Hamlin, Lisa Leggio, and Barbara Carter of Michigan Coalition Against Tar Sands (MI CATS) were found guilty of trespassing and “resisting and obstructing an officer”, a felony charge in Michigan that carries a maximum jail sentence of three years. They were arrested while blockading construction equipment being used to expand Enbridge’s Line 6B – the same tar sands pipeline which caused the largest inland oil spill in U.S. history when it leaked over one million gallons of tar sands bitumen into the Kalamazoo River in 2010.

Obama’s State of the Union: Fantasy, Fact, Fiction or All of the Above?

During Obama’s State of the Union address last night the presence of the star of the reality TV show Duck Dynasty might have been the most real part of a very surreal evening.

Of particular note were Obama’s comments on energy and climate change.

While the US Southeast was being hammered by a highly unusual winter storm which stranded thousands in the metro Atlanta area, (no, this does not disprove climate change you nitwits, climate scientists have warned for years that a warming globe means extreme and unpredictable weather) Obama was proclaiming a desire to address climate change so that “when our children’s children look us in the eye and ask if we did all we could to leave them a safer, more stable world, with new sources of energy, [we can say] yes we did.”

This sounds wonderful until we consider the “all of the above” energy strategy Obama touted earlier in the speech, which gives a nod to some of the dirtiest, most polluting and destructive energy sources.  It includes shale oil from the Bakken oil fields in North Dakota–the gas flares of which can be seen from space.  This shale oil is so extremely volatile that in the past year two trains carrying bakken oil have exploded.  It means more coal; it means more deep water offshore drilling of the type that caused the BP oil spill disaster.  It means more nukes, even in the shadow of the ongoing catastrophe at Fukushima.  And it means more fracking.  Obama made a big show of his support for natural gas “if extracted safely,” which it is not.

Just over the golden hills of Martinez, the descent into Pittsburg on California's Highway 4 opens a view of the Carquinez Strait. The strait is a narrow segment of the tidal estuary that accepts the rushing waters of the Sacramento and San Joaquin rivers as they empty into the San Francisco Bay. The vista paints a portrait of the transition to a clean energy economy: on the northern side of the strait, enormous turbines of the Shiloh Wind Power Plant revolve gracefully. Along the southern waterfront, an aging former PG&E power plant casts a shadow over massive, decaying fuel tanks next to Pittsburg’s newly revitalized downtown.

This is the stage of the Bay Area’s latest and biggest energy battle, between residents of Pittsburg and energy infrastructure company WesPac.

WesPac Energy wants to transform the PG&E site into a mega crude-by-rail facility, marine oil terminal, and refurbished tank farm. With plans to handle 242,000 barrels per day, the terminal would process one-fifth of all crude coming through California. The facility would deliver Bakken crude and tar sands to all five of the Bay Area’s refineries via new and expanded pipelines. In simple terms, WesPac is looking to turn Pittsburg into the crude hub of Northern California.

WesPac had been developing its proposal with the Pittsburg planning department for two years, but it wasn’t until a sunny Sunday in August 2013 that anyone really knew about it.

On this particular Sunday, longtime Pittsburg resident Lyana Monterrey happened upon a tiny notice in the Contra Costa Times for a public hearing on an environmental impact report. Alarmed at the tremendous risks and dangers posed by the project, Lyana knocked on her neighbor Kalli Graham’s door to tell her about the story she had read. Kalli and Lyana immediately started going door-to-door to alert their neighbors of WesPac’s plans. Neither of them had participated in community organizing before. They attended the city hearing the following day, met a few other concerned residents, and decided to take action.

“I just could not sit still. I could not do nothing about this,” Lyana recalled.

What started as a few neighbors raising their voices quickly grew into a tidal wave of community-led activism that’s swept the town of Pittsburg into the regional and national spotlight. 2013 has been tainted by a half dozen oil train derailments and explosions, including a deadly disaster in Lac Megantic, Quebec that leveled a small town and killed 47 people. So, the prospect of “bombs-on-wheels” (as one community resident put it) rolling through Pittsburg on the daily has set the community ablaze with fierce opposition to WesPac.

Two diverse community led groups--the Pittsburg Defense Council and the Pittsburg Ethics Council--have emerged within the last six months to lead the campaign against the WesPac project, alongside ForestEthics and other NGO allies. Together, we’ve gathered over 4,000 petition signatures, organized a riveting Toxic Tour of the city’s heavy industrial sites, and conducted a bucket brigade air monitoring project that reveals striking levels of pollution in the community. We’ve flooded downtown Pittsburg with lawn signs, mobilized a January 11 march and rally that brought out over 300 residents, and organized a rally that packed Tuesday’s City Council meeting. Community leaders are meeting with city officials, training and empowering volunteers, and generating dozens of media hits. We’re gearing up to come out in full force as the Pittsburg Planning Commission and City Council vote on the project in coming months.

Stop WesPac: Pittsburg Workers Stand Up

Pittsburg, California, is a solidly working class town if there ever was one. Like workers in other parts of the country and the world, residents here are building a working-class environmental movement, in this case to stop the construction of a facility to receive and store the highly volatile oil from the Bakken deposit.

This movement is taking up the most immediate effects of the destruction of the environment – from pollution of the air, water and soil to threats posed by tanker car explosions. Much of this threat is due to capitalism’s determination to burn every last drop of fossil fuel, and ultimately this working class environmental movement will have to take up the struggle for the alternatives.

More Crude Spilled in 2013 Than Previous Four Decades Combined

More crude oil spilled from train accidents in 2013 alone than in the previous four decades combined—an alarming number reported by McClatchy News on Monday that points towards a drastic shift in the highly toxic, yet growing, crude oil business to rail transport.

According to data from the Pipeline and Hazardous Materials Safety Administration, in the four decades that such records have been taken between 1975 to 2012, U.S. rail spilled a combined 800,000 gallons of crude oil. This pales in comparison to the damage done in the 12 months of 2013, in which 1.15 million gallons of crude oil was spilled.

In total, U.S. railroads shipped 400,000 carloads of crude oil in 2013, or over 11.5 billion gallons.

"The spike underscores new concerns about the safety of such shipments as rail has become the preferred mode for oil producers amid a North American energy boom," McClatchy reports.

Already, I am mad as hell, and can’t take it anymore. Then, the President of my home country goes before the UN, and tells them that we are an imperialist country. In this speech, part of what outlined the new Obama Doctrine, noted the following American policy for the rest of his 3 years in office:

“…let me take this opportunity to outline what has been U.S. policy toward the Middle East and North Africa and what will be my policy during the remainder of my presiden[cy]…The United States of America is prepared to use all elements of our power, including military force, to secure our core interests in the region…We will ensure the free flow of energy from the region to the world. Although America is steadily reducing our own dependence on imported oil, the world still depends on the region’s energy supply and a severe disruption could destabilize the entire global economy. We will dismantle terrorist networks that threaten our people….when it’s necessary, defend the United States against terrorist attack, we will take direct action. And finally, we will not tolerate the development or use of weapons of mass destruction…we’ll continue to promote democracy and human rights and open markets because we believe these practices achieve peace and prosperity…these objectives are best achieved when we partner with the international community and with the countries and peoples of the region…Now, the notion of American empire may be useful propaganda, but it isn’t borne out by America’s current policy or by public opinion.”(1)

A Train Bound for Tragedy

On July 6, a derailed oil train crashed into the small Quebec town of Lac-Mégantic, killing 47 people. The tragedy highlighted a distressing practice in the freight train industry: Namely, that thanks to technological developments over the last few decades, a single engineer might now be expected to operate a 100-car train. Because of the lack of oversight, say many railroad workers, that lone man’s mistake could end in disaster.

“The Canada accident really put the spotlight on what can happen if you have one person responsible for such a big piece of machinery,” says J.P. Wright, a locomotive engineer with CSX Transportation in Kentucky and organizer with Railroad Workers United, a national group of progressive labor activists including members from different rail unions, in an interview with In These Times.

RWU, along with the Brotherhood of Locomotive Engineers and Trainmen (BLET), has highlighted the Montreal disaster as an example of potential tragedies workers think will increase if the industry continues its push for one-man trains. 

However, Ed Burkhardt, chairman of Montreal, Maine & Atlantic Railways, the company running the Quebec train, tells In These Times that one-man crews had nothing to do with the July accident. He argues that the derailment, which occurred when the train’s sole operator left it parked unmanned to spend the night at an inn, could have happened with a two-man crew as well.

“This was a situation where the hand brakes were not properly applied. An employee failed in his duties there. It could be an employee of a two-man crew just as well as an employee of a one-man crew,” Burkhardt says.

But rail workers say that inevitable human errors or unforeseeable accidents will become more frequent and more deadly with only one person running a train.

Violations Analysis of Shell Oil Company's Shale Gas Development in Pennsylvania

This report analyzes data provided by the Pennsylvania Department of Environmental Protection regarding violations cited for shale gas development by Shell Oil Co’s subsidiaries through the end of 2012.

Key findings include:

  • Shell has a 5:6 violation to well ratio. Out of 603 wells drilled, we found that Shell’s subsidiaries East Resources Inc., East Resources Mgmt. LLC and SWEPI were cited 494 violations by PA DEP.
  • Ninety percent of Shell’s violations were environmental in nature. Out of 494 violations, we identified 443 that were environmental in nature, which have or are likely to cause harm to the environment.
  • Shell has been cited for a casing failure rate of about one percent of wells for a total of six citations. It is important to note that well casings are meant to protect aquifers from contamination by chemicals used in the hydraulic fracturing, or “fracking” process.
  • Shell was cited violations 45 times for Improper Construction of Waste impoundments, 37 times for Faulty Pollution Prevention Practices, 25 times for Discharge of Industrial Waste. This presents imminent danger to surface and ground water supplies.
