LNS is working strategically in key states that are leading the national narrative on climate justice. This year, LNS and Jobs with Justice San Francisco launched California Labor for Climate Jobs, a coalition of labor unions calling for an equitable, worker- and union-led transition to a resilient economy with good jobs based on clean energy and expanded public and social services. The coalition won a $40M Displaced Oil and Gas Workers Fund in the California State Budget, and advocated for support for communities and public jobs that will be impacted as oil and gas phases out across the state.

LNS also participated as a member of the Los Angeles County and City Just Transition Task Force that released a Just Transition Strategy – a first-ever framework for supporting workers and communities impacted by oil drilling phase-out policies. Essential to making the transition just is the necessary support to transition workers’ skills into jobs of comparable, family sustaining compensation or retirement. The Just Transition Strategy was noted as core to LA City’s Green New Deal laws, and a test-case for Native Nations, environmental justice communities, and workers to begin to envision together an ecologically just and economically sustainable future.

A Pick Axe and a Heart Attack: Workers Suffer As They Clean Up Toxic Mess That Vernon’s Old Battery Recycling Plant Left Behind

When workers tasked with cleaning up toxic lead dust spilled by the Exide battery recycling plant from Guadalupe Valdovinos’ yard started packing up, she noticed they hadn’t finished. She saw a large patch of soil on her property that they hadn’t touched. 

When she insisted they missed a spot, she remembers the clean-up workers rudely said that cleaning up the untouched corner of her property “wasn’t part of the plan.” 

Valdovinos says that the apparent disregard for her home started early in the clean-up process “They would hit and break things. We expected them to repair it. They were hostile. They were they would grunt or be very like, well, we didn’t do that,” said Valdovinos, “Like, we didn’t come at them attacking them. We were just pointing out, hey. You broke something. And they took it very offensive, like, No, we didn’t do that. No, that’s not our problem. So that was another issue. Yeah, it wasn’t a friendly environment.”

She complained about the clean-up at an Environmental Board Meeting in July and addressed California’s Department of Toxic Substance Control (DTSC), the state agency responsible for cleaning up the mess made by Exide Technologies’ battery recycling plant. For decades, Exide belched out thousands of tons of poisonous lead dust across the predominantly Latino communities surrounding the industrial city of Vernon. 

“I’m here to urge the Council and DTSC not to contract the cleaning crew National Engineering Consulting Company Group, also known as NEC because they are not professional,” said Valdovinos at the Environmental Board Meeting.

She was hardly the first to complain of sloppy standards affecting the cleanup of more than 7 million pounds of lead dust spewed out by Exide. Residents have long complained about issues with the cleanup, and now employees of the contractors responsible for the cleanup are speaking out too. Reporting by L.A. TACO found two incidents of severe injuries to subcontractor workers due to possibly unsafe working conditions and questionable treatment of poisonous lead dust. 

One cleanup worker died after suffering injuries inflicted by a Bobcat digger at one site in 2020. At another, in the spring of 2022, an employee of a state contractor was severely injured by a pickax blow to their chest and shoulder area after a site was not appropriately cleared for overhead hazards. 

LA Teachers, Parents, and Communities Demand Heat-Safe, Climate-Safe Schools

As Los Angeles temperatures soared this September, the United Teachers of Los Angeles (UTLA) and its allies demanded that the Los Angeles United School District (LAUSD) bargain over their comprehensive climate justice proposals and take immediate action to address the extreme heat searing LA schools. The announcement for a September 6 press conference stated,

In the midst of LA’s worst heatwave of the year – and a climate crisis that hits Black and brown communities the hardest – LAUSD is completely unprepared to deal with extreme heat. Despite broken AC units and hot asphalt schoolyards, the District has rejected parents’ pleas for even temporary shade from the sun.

The UTLA, together with parents, students, and community representatives, made a series of climate justice bargaining proposals to address the climate crisis in LA schools as part of its common good “Beyond Recovery” platform. But the LAUSD has refused even to bargain over them.

The UTLA’s bargaining proposals for “Healthy Green Public Schools” include:

  •  Create strategic plan for a Green, Clean, Free, and Healthy LAUSD, including but not limited to: conversion of buses, installation of solar panels, use of school land for collection of clean water, creation of schools as cooling zones, creation of schools as climate change/grid shut-down resiliency centers, and increased healthier food options
  • Provide support for school/community gardens to feed students and families
  • Shaded and appropriate play areas for all students
  • Support of local struggles for environmental justice and equity
  • Increase healthy food options for students and families that address food insecurity, nutrition, culture, and support of environmentally sustainable and worker-friendly food sources
  • Expand green spaces and tree planting at schools
  • An LAUSD audit on green practices, including energy use, carbon emissions, air quality, and water use

It’s Time We Listen to Transit Operators

Transit Operators Are the Backbone to Our Region’s Infrastructure. It’s Time We Act Like It.

On her day off last week, one bus driver* took time away from her daughters to tell me about her shift the night before. As regular riders boarded, she was sure to tell each of them that she was on vacation tomorrow and her shift had not yet been covered. In other words, don’t expect this bus to show up.

Transit operators are an integral part of making California affordable. Transportation is the second-highest expense after housing, and driving is both the most expensive transportation option and a top source of greenhouse gas emissions.

Giving Californians frequent, reliable, and accessible transportation alternatives is only possible with transit operators, but there’s a national shortage. A new report by the Transit Center outlines the crisis, finding that 117 transit agencies cut service due to worker shortages, with bus operator positions hardest hit.

LA Metro and the SFMTA are reducing service to manage staffing shortages. Reduced service and staff leaves riders stranded or delayed — which disproportionately affects BIPOC residents who make up a majority of transit ridership. Frequency also attracts riders. When VTA increased its service last fall, more frequent routes saw higher ridership increases.

I spoke with operators who work for Bay Area transit agencies who are working longer shifts, missing time with their families, and dealing with angry customers after missed buses. Here’s how they would solve the staffing crisis and make the job more attractive:

Building Our New Electric Fleet

Today on TAP: In a signal victory last week, an activist group prevailed on a major bus manufacturer to hire its workers from local, historically disadvantaged communities.

In 1997, after a campaign of several years’ duration, the Los Angeles City Council voted to establish the nation’s first living wage ordinance. Under its terms, businesses with which the city had contracted to do its work—for which the city’s taxpayers were footing the bill—were required to pay their employees a specified, decent wage, as well as offering them a modicum of benefits.

The ordinance, and the campaign that pressured the council to enact it, were the brainstorm of Madeline Janis, the attorney who’d founded and led the Los Angeles Alliance for a New Economy (LAANE). “Taxpayers should not be subsidizing poverty-wage jobs,” Janis argued.

At roughly the same time, in tandem with another progressive community organization, LAANE also persuaded a number of local developers to sign community benefits agreements (CBAs), which obligated those developers to hire local residents—in effect, disproportionately minorities and women—on major construction projects. Previously, such projects were built by a heavily white male workforce that lived nowhere near the city’s center, even as those projects uprooted the self-same minority communities who’d lived and worked there. With the coming of CBAs, minorities began to gain much greater entry to union construction jobs that offered pay and benefits that otherwise would have remained out of reach.

Electric Bus Makers Pave the Way to Union Jobs for Disadvantaged Workers

Last year Armando (who requested that his last name not be used) was working as an addiction counselor when a parole officer came to his office with a flyer announcing a new nine-week training course in electric bus manufacturing technology. The company promised not to discriminate against the formerly incarcerated, among whom are some of his clients. “I wanted to see the class so I could explain it to my clients and maybe recommend it, and make sure they understood the opportunity,” Armando told Capital & Main. “And then I thought, ‘Man, this is a good company with good pay and benefits, and it’s in a growing field.’”

Armando signed up for the class himself, and after completing it last October, he was offered a position as a battery technician at Proterra at over $20 an hour, an entry level salary higher than he was earning as a counselor, with a potential to increase quickly. True to its word, the company didn’t discriminate against him because of his past drug addiction. Armando, 52, who has been clean for five years, did have to compete with job candidates who didn’t have dings on their record and had experience in manufacturing. Now, after only six months, Armando’s eyeing a supervisory position. He’s also been helping the company screen candidates and mentoring those taking the pilot course.

“I want [students] to understand that you can’t be late or get high or do anything stupid on the job,” Armando said. “There’s expensive equipment, and you could kill yourself if you’re careless. Some of these students never had real jobs, and I like people to get a second chance. But you have to take the nine-week course seriously.” The gratitude Armando feels toward the company that gave him a chance has made him work even harder, he said.

The program at Proterra is the fruit of a community benefit agreement (CBA) between the company, United Steelworkers Local 675, L.A.-based nonprofit Jobs to Move America, and a coalition of community organizations that established standards for training, supporting and hiring job candidates from nontraditional backgrounds. They give them a chance at skilled union jobs in the growing field of green manufacturing.

Workers Say They Breathe Polluted Air at “Green” Insulation Facility

As the acceptance of climate change becomes increasingly commonplace, more and more companies will be created or adapted to ​“fight” or ​“solve” it — or, at the very least, minimize its effects. Kingspan Group, which began as an engineering and contracting business in 1965 in Ireland, has since grown into a global company with more than 15,000 employees focused on green insulation and other sustainable building materials. Its mission is to ​“accelerate a zero emissions future with the wellbeing of people and planet at its heart.” 

But workers at the Kingspan Light + Air factory in Santa Ana, Calif. don’t feel that the company has their wellbeing at its heart — and they say they have documented the indoor air pollution in their workplace to prove it. Differences between Kingspan’s mission and its true impact don’t stop there, workers charge: One of its products was used in the flammable cladding system on Grenfell Tower, a 24-floor public housing tower in London that went up in flames in June 2017, killing 72 people. Kingspan has been the target of protests in the United Kingdom and Ireland for its role in the disaster. Both Kingspan workers and survivors of the Grenfell Tower fire have called on the company to put public safety over profits.

Since the 1990s, union organizers say there have been multiple attempts from the International Association of Sheet Metal, Air, Rail and Transportation Workers (SMART) union to organize employees at Kingspan, but none were successful. The company says its North America branch employs ​“1,600 staff across 16 manufacturing and distribution facilities throughout the United States and Canada.” Workers at the Santa Ana plant are tasked with welding, spray painting and assembling fiberglass to produce energy-efficient skylights. During the pandemic, when workers say Covid-19 swept through the facility, employees reached back out to SMART — not just because they wanted to form a union, but because they grew concerned about what they say is poor air quality in the facility. 

While SMART provided support for their campaign for clean air, the workers took control: In the summer of 2021, the Santa Ana workers came into work armed with monitors to measure indoor air pollution. Their goal was to measure airborne particulate matter that is 2.5 micrometers in diameter or smaller (PM 2.5). Such fine particulate matter constitutes a form of air pollution that is associated with health problems like respiratory and cardiovascular issues, along with increased mortality. The workers found that the average PM 2.5 concentration inside the facility was nearly seven times higher than outdoors. (To put that in perspective, wildfires usually result in a two- to four-fold increase in PM 2.5.) The majority of monitors found PM 2.5 levels that would rank between ​“unhealthy” and ​“very unhealthy” if measured outdoors, according to Environmental Protection Agency standards, the workers reported. 

Because this is the air workers were breathing in for 40 hours per week, in October 2021, they went public with both their campaign to form a union and their fight for a safe workplace — a campaign that continues to this day.

We call on those who deal with Kingspan to reconsider rewarding it for behavior that weakens the credibility of the green building community, and that goes against the values of safe and sustainable buildings and communities.Read the full statement and list of signatory organizations here.

This effort is part of Clean up Kingspan, an inspirational campaign led by Kingspan factory workers in Santa Ana, CA who are holding the global manufacturing company accountable for health, safety, and pollution issues in their community and demanding a fair process to decide whether to unionize. In collaboration with UC Irvine pollution scientist Dr. Shahir Masri, these workers measured unhealthy levels of PM2.5 pollution inside their workplace.They also blew the whistle on Kingspan for misrepresenting its daily operations and water pollution clean-up efforts to the CalEPA.

What this campaign makes clear is that the struggle we face isn’t ‘jobs vs. the environment;’ it’s corporate greed vs. everyone else. LNS is proud to stand with workers, community activists, faith leaders, & environmentalists in this campaign for true economic and environmental justice. It’s time for the green building community to stand with us too.
