Key findings from our investigation into the people who got sick after cleaning up BP’s oil spill

Thousands of people have sued BP for long-term health conditions they claim stem from the dirty work of cleaning up BP’s Deepwater Horizon oil spill 13 years ago. The explosion marked the biggest industrial disaster in US history, which saw thousands of Gulf coast residents, many from poor fishing communities, take part in the cleanup effort.

The Guardian spoke with two dozen former workers, used computer programming to analyze a random sample of cases and combed through legal filings to understand the scope of the public health disaster.

BP declined to comment on detailed questions, citing ongoing litigation.

Here are some key findings:

Data analysis showed prevalence of health conditions among those who have sued

Among those who are sick there is a shared feeling of exasperation and anger as the chances of receiving damages and acknowledgment via the courts rapidly dwindles. They boated out into the Gulf to try to block the oil from coming ashore with floating barriers, called booms. They worked 12-hour shifts in the middle of the summer to save the wetlands and say they got sick as a result.

The Guardian used computer programming to analyze a random sample of 400 lawsuits out of the nearly 5,000 filed against BP. Many of the people in our sample have more than one ailment. Sinus issues are the most common chronic health problem listed among those who have sued, followed by eye, skin and respiratory ailments. Chronic rhinosinusitis, a swelling of the sinuses in the nose and head that causes nasal drip and pain in the face, was the most common condition. Two per cent have been diagnosed with cancer, a number some experts believe will continue to rise.

Rooftop Solar Justice

A war over the nation’s energy future is raging across the United States. On one side are everyday people who can benefit from clean, renewable energy through distributed-solar projects like rooftop and community solar. On the other side are for-profit electric utilities threatened by distributed solar’s impact on their lucrative, guaranteed profits. These companies are using their influence with regulators and legislators in a coordinated effort to undermine the expansion of distributed solar. They recently succeeded in California. This report addresses the environmental and economic justice of net energy metering, or NEM, and the utility industry’s false and self-serving claims against distributed-solar growth.

To combat the climate emergency and pervasive energy inequity, we need to maximize distributed solar development. NEM already exists in many states and is a key policy driver to expand distributed solar. Customers pay only for the net electricity they use each month, considering both the power going to the grid when rooftop-solar systems generate excess electricity and the power coming in from the grid (particularly at night). Net metering substantially reduces electricity bills, allowing people to recoup their distributed-solar investments.

For-profit utilities are fighting NEM on multiple fronts and in many states. In California, for example, they recently convinced regulators to gut net metering for new customers. In Florida a utility-backed bill to gut net metering passed the legislature. Utility companies fight NEM because it undermines their business model, which assumes that centralized utilities are the only legitimate makers and sellers of electricity.

As this report shows, anti-net-metering talking points are based on an outdated version of the grid, where for-profit utilities control everything. Utilities want to gut net metering to maintain control and use the proceeds to pay for rising utility costs, including the growing costs of addressing climate-fueled catastrophes and stranded assets in fossil fuel infrastructure.

I Survived the Rig Explosion That Caused the Deepwater Horizon Oil Spill; This Is What I Saw

It’s been 12 years since the catastrophic explosion that sank the Deepwater Horizon drilling rig, killing 11 workers and causing the largest marine oil spill in human history. A lot of forgetting can happen in that time. A lot of cultural amnesia and historical distortion has set in over the past 12 years, whether that came in the form of a years-long PR campaign from British Petroleum (BP), the high-budget Hollywood-ification of the disaster in the 2016 movie starring Mark Wahlberg, or just the general lack of workers’ voices and stories in the media. 

In this episode, we talk with Leo Lindner, who worked for 10 years at the mud company M-I, the last five of which were spent working on the Deepwater Horizon. Leo was on the rig on April 20, 2010, the day of the explosion. We talk to Leo about his life, about moving to and growing up in Louisiana as a kid, working on tugboats and in oil fields, and about the experience of being a worker in the midst of one of the most devastating industrial and environmental disasters of the modern era.

Outdoor Workers and Organizers in Miami are Fighting for a Countywide Heat Standard

Marta Gabriel has been picking tomatoes in Homestead, Florida, since she arrived from Guatemala five years ago. She didn’t know how hot and grueling conditions would be, but the job guaranteed her money that she could use to support her growing family as a mother of young children. However, after she nearly fainted from heat exhaustion and then suffered heatstroke while bending down to cut tomatoes, Gabriel realized her working conditions were not sustainable. She was already a member of WeCount!, a coalition of immigrant workers in southern Florida, and shared her concerns with organizers. 

Hundreds of thousands of other outdoor workers across South Florida share Gabriel’s experience. Starting in 2017, they began telling organizers at WeCount! that heat had become an issue. Now, construction workers, farmworkers, and other outdoor workers across Miami-Dade County are fighting for a countywide heat standard to ensure workers are protected from the deadly rising temperatures on the frontlines of climate change and extreme heat.

As it stands, workers in southern Florida are forced to work outside in the extreme heat without any local, state, or federal heat standards. WeCount!’s “¡Que Calor!” campaign (Spanish for “it’s so hot!”) is hoping to enact a heat standard similar to the one states like California, Washington, or Oregon, have already implemented—one that highlights the need for water, shade, and rest for workers. Led by those most impacted by the problem—farmworkers, plant nursery workers, day laborers, and construction workers—¡Qué Calor! is building a grassroots movement for climate, health, and labor justice. 

As heat rises, who will protect farmworkers?

Last June, as a record-breaking heatwave baked Oregon’s Willamette Valley, Sebastian Francisco Perez was moving irrigation lines at a large plant nursery in 104 degree Fahrenheit heat. When he didn’t appear at the end of his shift, his co-workers went looking for him, and found him collapsed between rows of trees. Investigators from the Oregon Occupational Safety and Health Division determined that Perez died of heat-related hyperthermia and dehydration. 

They also found that Perez had not been provided with basic information about how to protect himself from the heat. It wasn’t the farm’s first brush with regulators; it had previously been cited for failing to provide water and toilets to its workers. Later, in a closed conference with Oregon OSHA, an Ernst Nursery & Farms official blamed Perez for his own death, claiming that employees should “be accountable for how they push their bodies.”

This year, in a move to avert similar deaths — and force employers to take responsibility for protecting workers during hot weather — Oregon adopted the most stringent heat protections for outdoor workers in the country. The rule kicks in when temperatures reach 80 degrees F and requires employers to provide cool water, rest breaks and shade, as well as to make plans for how to acclimatize workers to heat, prevent heat illness and seek help in case of an emergency. 

The new standard has been praised by advocates, but industry is already pushing back. On June 15, the day the rule took effect, a coalition of Oregon business groups representing more than 1,000 companies filed a lawsuit seeking an injunction against the heat standard and another new rule governing workers’ exposure to wildfire smoke, arguing that they are unconstitutional. But the rules stand for now, making Oregon the third state to enact such standards for outdoor workers, after California and Washington. 

In the rest of the country, as climate change drives increasingly brutal heat waves, farmworkers lack protection. How they fare will largely depend on whether their employers voluntarily decide to provide the access to water, shade, and rest breaks that are critical when working in extreme heat. There are currently no nationwide regulations that spell out what employers must do to protect workers from heat and, while efforts to draft a federal rule recently began, it will likely be years before the standards are in place.

The Gulf South is uniquely positioned to be a national leader in the movement for a Green New Deal. With the climate crisis accelerating faster than even most scientific predictions, deep investment in Gulf South frontline communities will yield an opportunity for this region to be a global leader in equitable approaches to a socio-economic transformation that builds wealth and sustainability for the nation and the world.

Gulf South for a Green New Deal is a multi-state effort to address the impact of the global climate crisis on some of the most unique communities in the US. In May 2019, more than 800 advocates, farmers, fisherfolk, and community leaders from across the Gulf South gathered in New Orleans around a shared vision to advance regional sustainability in the face of the global climate crisis.

The creation of the Gulf South for a Green New Deal (GS4GND) Policy Platform was a six-month process anchored by the Gulf Coast Center for Law & Policy (GCCLP). Using techniques from the People’s Movement Assembly Process, GCCLP facilitated a five-state process of formalizing frontline voices. Through a broader regional organizing effort, over 100 original signatories are listed herein. Additional signatories will be updated quarterly.

This document is a collective assertion that the Gulf South must be included in the development of national policy. This platform is not a comprehensive policy vision, but rather a starting point and living tool of regional alignment and broad organizing in the Gulf South. The principles, goals, and strategies of this Policy Platform are offered to address what a Green New Deal must look like to be successful in the Gulf South.

We offer this document as a step towards climate justice, self-determination, and dignity for all people everywhere.

As goes the South, so goes the nation.

Update on #OperationPUSH in Florida Prisons

It’s been a hard silence for the past 5 days since Operation PUSH launched a statewide prisoner strike in the FL Department of Corrections prison system (FDOC or FDC) coinciding with Martin Luther King Day.

Information from prisoners is coming in at a much slower pace than people on the outside had anticipated, but reports are slowly and steadily making their way through the walls, despite many obstacles.

Thus far, we’ve heard from prisoners that there has been active participation or repression of some sort in the following prisons: Santa Rosa, Jackson, Gulf, Hamilton, Avon Park, Franklin, Holmes, Everglades, Reception and Medical Center at Lake Butler, Liberty, Lowell, Columbia, Florida State Prison, Suwannee, Calhoun, and Martin. (The list is growing by the day.)

Strike Repression

A common theme among report backs is the attempt by the DOC to sever communication in order to create the perception of inactivity and break the spirits of those participating in the strike. Key contacts inside have reported being threatened by administration with harsher retaliation if correspondence with advocacy groups such as Fight Toxic Prisons and Incarcerated Workers Organizing Committee continues.

According to prisoner reports, some facilities have shut off state phone service as of Tuesday, January 16. A Security Threat Group (STG) investigator employed at a prison in the panhandle confirmed that multiple prisons across the state were placed on lockdown in preparation for the strike. Shakedowns have occurred where independent means of communication were confiscated and their alleged owners/users were thrown in solitary confinement.

We’ve heard reports that widespread investigations are occurring for anyone who has received or sent mail to organizations offering support on the outside and certain individuals are being labelled a “security threat” for doing so which can result in heightened custody levels, which means a loss of privileges, and continued harassment by the STG unit. One prisoner was told, “As long as you communicate with these people you’re always going to be labelled a security threat and you’re always going to be put under investigation.”

Given the past two years of prisoner organizing in Florida, it’s understandable that there is an expectation to hear of something distinct on the inside marking the start of the strike.
