Special Report: Norfolk-Southern Train Derails 50 of 151 Cars in Fiery Crash

As we approach the 10 year anniversary of the deadly train wreck in Lac-Megantic, Quebec on July 5th, 2013, a major fiery train wreck in Ohio this past weekend serves as a reminder of just how potentially dangerous long and heavy trains can be. Add to this the fact that in the last 10 years, the Class One carriers have dramatically increased both the length and tonnage of the average train, while cutting back on maintenance and inspection, and we have a time bomb ticking, just like a decade ago, leading up to the Canadian disaster that destroyed a whole town and took the lives of 47 people. While thousands were and remain evacuated, and property damage to both rail and non-railroad property will no doubt soar into the millions, we dodged a bullet as no rail workers and no trackside residents were killed. This time.

The train, NS 32N, which was built in Madison, IL and headed east to Conway, PA swapped out crews in Decatur, IL. This crew would experience trouble while running their route between Decatur, IL and Peru, IN. In fact, they did not complete their trip to Peru since they outlawed on the federal hours-of-service statute. The train severed a knuckle between two cars at Attica, IN. This occurred while the train was going downhill and while in dynamic braking. Pretty much the only time a train breaks in this scenario is when the train isn’t blocked properly. In order to mitigate in-train forces, railroads prior to PSR would build trains with the heavier cars on the head end and the lighter cars on the rear end. This prevents severe slack run-ins and run-outs throughout the trip and if the train’s emergency brakes are applied, you don’t have heavier cars running into lighter cars which causes jackknifing. This particular train had 40% of it’s weight on the rear 1/3 of the train. Most of this tonnage was made up of loaded tank cars which are very heavy and slosh back and forth when coming to a sudden stop. This sloshing after a stop can continue the pushing of more cars off a track in a jackknifing situation which is what occurred in this Ohio wreck. This block of tank cars was placed directly behind a block of cars that were in the middle of train which were equipped with cushioned draw bars. The draw bars on these cars slide in and out independent of the car body which helps protect the merchandise carried within from damage. These type of draw bars are usually on automobile carriers to prevent the cars/trucks inside from being damaged. Placing cars with these draw bars in the middle of a train creates elasticity. Building a train like this (Head end = locomotives, which are the heaviest part of any train, followed by heavy mixed freight loads, followed by a block of cushioned draw bar cars, followed by a block of heavy tank cars (such as the case with this 32N) is akin to placing two bowling balls on the ends of a rubber band and praying the rubber band doesn’t break. 

Video footage has emerged online showing one of the wheels on this train on fire as it passed by the camera. If this footage is authentic, it’s very likely that car caused the derailment. This damaged car apparently was allowed to leave its initial terminal because it wasn’t inspected properly due to car inspectors being laid-off and time allowed per car inspection being dramatically reduced by the industry. If this did indeed occur this way, the train would’ve gone into emergency and the heavy tank cars on the rear end would’ve slammed into the derailed cars causing the 50 cars to pile up off the track and catch fire. 

"Precision Scheduled Railroading" is more than likely a major culprit in this incident for the following reasons:

  • Inspection times have been cut resulting in the defective car remaining in the consist.
  • Train was excessively long and heavy… 151 cars, 9300 feet, 18,000 tons.
  • Train was not blocked properly because PSR calls for limited car dwell times in terminals. Blocking a train for proper train handling (placing the majority of weight on the head end and ahead of cushioned draw bars) takes longer so this practice has been mostly eliminated by the rail carriers. 

Fiery Ohio Train Wreck the Result of "PSR"

Railroad Workers United (RWU) condemns the dangerous and historically unsafe practices by Class 1 rail carriers that resulted in this catastrophe that will impact the community of East Palestine Ohio for many years, if not forever. The root causes of this wreck are the same ones that have been singled out repeatedly, associated with the hedge fund initiated operating model known as “Precision Scheduled Railroading” (PSR). But risky practices, such as ever longer and heavier trains even precede PSR. The train that wrecked is a case in point, 9300 feet long, 18,000 tons. Other hallmarks of modern day railroading include deep cuts both maintenance and operating employees, poor customer service, deferred maintenance to rolling stock and infrastructure, long working hours and chronic fatigue, limited on-the-job training and high employee turnover. 

Norfolk Southern train NS 32N with 150 cars on the manifest, derailed on Feb. 3 at 8:55pm. It consisted of 3 locomotives 141 loads and 9 empties. The train had a crew of 3 at the time of the wreck, consisting of an Engineer, a Conductor and a Conductor Trainee. 20 of its loaded cars were considered Hazmat by the railroad. 10 of those hazmat cars were involved in the 50-car pileup. Of those 10, 5 cars contained Vinyl Chloride, all of which were damaged and/or burned, with one of those leaking by design to relieve explosive pressure. 

At this time, the immediate cause of the wreck appears to have been a 19th century style mechanical failure of the axle on one of the cars – an overheated bearing - leading to derailment and then jackknifing tumbling cars. There is no way in the 21st century, save from a combination of incompetence and disregard to public safety, that such a defect should still be threatening our communities. 

40% of the weight of NS 32N was grouped at the rear third of the train, which has always been bad practice and made more dangerous with longer heavier trains. This fact almost certainly made the wreck dynamically worse. But increasingly the PSR driven Carriers, driven to cut costs and crew time by any means necessary, cut corners and leave crews and the public at risk.

The crew was able to uncouple the locomotives and move them to safety, preventing an even bigger tragedy. This would not have been possible under the various management schemes now being proposed to operate such trains with single person crews. Further, because Train 32N carried the standard crew of two or more workers, they were able to immediately take the necessary emergency measures to ensure a safe and effective response.

The short-term profit imperative, the so-called “cult of the Operating Ratio” - of NS and the other Class 1 railroads - has made cutting costs, employees, procedures, and resources the top priority. In this case, NS and the other carriers have eliminated many of the critical mechanical positions and locations necessary to guarantee protection against these kinds of failures. Simultaneously, they regularly petition the regulators at the Federal Railway Administration for relief from historically required maintenance and inspections.

The wreck of Train 32N has been years in the making. What other such train wrecks await us remains to be seen. But given the modus operandi of the Class One rail carriers, we can no doubt expect future disasters of this nature.

The news about people who work for a living has featured some recent breakthrough stories, where previously immune companies have seen their workers organize and form unions. But what about an industry that remains one where unions have a long history and are still active? 

Very few people pay attention the way we should to railroads in America. That may be about to change, and not in a good way.

Sure, news about expanding Amtrak seems like a good thing, and there are plenty of High-Speed Rail (HSR) proposals — usually accompanied by reports on how expensive they are and how long they will take to build — if they can get past the NIMBY folks, the highway and airline lobbies, and the fossil fuel interests.

People freak out about bomb trains (understandable), and derailments — but how many people pay attention otherwise to the condition of our rail corridors, how much the industry is investing in itself, how much of the national economy depends on rail service, and the conditions for the people who work for the railroads?

Or the public good for that matter?

Simple Solutions Can Safeguard Against Catastrophic Train Events

“Just because an industry can do something doesn't mean an industry should be doing it!” says Fritz Edler, a veteran railroader and railroad safety activist based in Washington, D.C.

Edler should know: He has broad knowledge about infrastructure, energy, environmental impact, and economics for heavy (freight) and light (passenger) rail in national and international contexts. He also headed the international defense effort for rail workers who were scapegoated after the horrific 2013 Lac-Mégantic, Quebec, volatile oil train wreck.

A special guest at La Coalition's campaign planning meeting in August, Edler shared insights on what the public can do to safeguard against catastrophic train events:

  1. Oppose precision scheduled railroading (PSR). PSR jeopardizes engineer and public safety by encouraging risky industry decision-making and focusing exclusively on lowering the operating ratio to satisfy Wall Street and hedge fund investors. PSR is now the subject of Congressional inquiries. 
  2. Demand sane scheduling and uninterrupted rest time. This will mitigate out-of-control crew fatigue. 
  3. Oppose longer trains. Technological advances allow the operation of longer and heavier trains than ever before, yet safety standards do not address these changes. Longer, heavier trains shift costs to trackside communities in multiple ways. They greatly increase wear and tear on rail infrastructure without requiring increased inspection and maintenance. Longer trains (100+ cars, over 1 mile long) also are significantly more likely to block railway crossings—which inconveniences the public and risks delaying first responders up to 15 minutes.
  4. Require emergency response plans (including fire and hazmat) for all changes in freight traffic, and publicly review the adequacy of the plans.
  5. Demand a minimum of a two-member crew on every train. Some operations require more workers to adequately protect both crew and trackside communities. The optimal number is three to five engineers on a train.
  6. Regulate railroads as the public utilities they have historically been. Limit hedge funds’ power and Wall Street’s involvement in the industry because they promote profits over public safety.
  7. Demand appropriate maintenance and oversight of railroad corridors.
  8. Demand restoration of meaningful whistle-blower protections. These should include significant penalties for evasion and misconduct. Whistle-blower protection is essential for guaranteeing railway safeguards.
  9. Support railroad upgrade efforts that include critical safety and operation improvements for both freight and passenger service. Upgraded railroad crossings are a prerequisite for most expanded and improved rail passenger services and higher-speed freight services—for safety and public convenience. 
  10. Support railroads as a vital part in America's Green Transportation future. Press legislators to support the Green New Deal and high-speed rail legislation, which guarantee the inclusion of rail projects that advance freight and passenger services. 

Last, Edler recommended that the public be skeptical when considering support for new advances in railroading, such as remotely operated trains. It’s important to avoid new problems in an already compromised industry. 

‘It’s Going to End Up Like Boeing’: How Freight Rail Is Courting Catastrophe

Just before 5 a.m. on August 2, 2017, Alice Murray was fast asleep when her entire house shook, almost as if a freight train had crashed into the block, she told the Cumberland Times-News.

That's exactly what happened.

About 30 yards away, just off Cleveland Street in Hyndman, Pennsylvania, 33 cars in a 178-car freight train belonging to CSX Corporation derailed. The train crashed into one house and damaged two others. The entire town had to be evacuated. Miraculously, no one was killed. 

As scary as the derailment in Hyndman was, it could have been much worse. Of the 178 cars on that train, 70 contained hazardous material, including 15 of the derailed cars, according to a National Transportation Safety Board (NTSB) investigation. Luckily, just three of them—which contained molten asphalt, molten sulfur, and propane—either leaked or lit on fire. 

The town was evacuated because molten asphalt, if released, can create vapors that, according to the NTSB, are an "explosive mixture with air." Some of the other derailed cars contained liquified petroleum gas, and one car that did not derail contained Sodium Chlorate, which is potentially poisonous to inhale.

What’s Wrong with Single Employee Train Operations?

At first glance, the casual observer from outside of the rail industry is prone to say that single employee train operation sounds dangerous. “What if the engineer has a heart attack?” is an often heard question. And while this question has merit, there are many other and far more complex and unanswered questions about just how single employee train operations could be accomplished safely and efficiently for the train crew, the railroad and the general public. How will the train make a back-up move? What happens when the train hits a vehicle or pedestrian? How will the train crew member deal with “bad-order” equipment in his/her train, or make pick-ups and set-outs en route? What about job briefings and calling signals, copying mandatory directives and reminders of slow orders? These are just some questions that we take up in this article.

Remote Control and “Utility Conductors”

In recent years, the Class I rail carriers have been biding their time, slowly but surely inserting language into recent contracts with both unions of the operating crafts that will facilitate their schemes to run over the road trains with a lone employee. They have made arrangements with the Brotherhood of Locomotive Engineers & Trainmen (BLET) to allow the BLET represented crew member to make use remote controlled locomotives. With this scenario, the lone operator would strap on a belt pack, dismount from the locomotive, and run the locomotive by remote control operation (RCO) using radio control from the ground. And the carriers have also made deals with the United Transportation Union (UTU) to allow for “utility conductors”; i.e. a conductor who can “attach” to one or more over-the-road trains during the course of a single tour of duty. Between the two arrangements, the rail carriers apparently believe they can safely and efficiently operate road trains with just one employee aboard as opposed to the current standard of two. We disagree.

Drop ALL the Charges NOW! Rail Safety Requires No Scapegoating

On Feb 5, 2018, Canadian railroaders Tom Harding and Richard Labrie are ordered back to court to face addition federal charges, even after being acquitted in a 3 month frame up trial related to the Lac-Mégantic oil train wreck of 2013.

Set up to fail!  Every danger was put in place by out-of-control railroad managers and policy makers, while the government looked away. None of those dangers was created on July 6, 2013. They were all in place long before that and part of a system and a culture of recklessness.  But no owners or top manager decision makers are ever going to face trial.  They are actually free and running trains around the world right this minute.

The continued targeting of Harding and Labrie is part of the ongoing attempt by the Canadian government to save face and divert attention away from worldwide calls for a real investigation of who set up the dangerous factors that killed 47 and destroyed the downtown.

The charges now being prosecuted under the Railway Safety Act and the Fisheries Act are part of an ominous recent move to criminalize workplace rules which has been a long time goal of employers who wish to shift all liability onto their work forces.  They also represent a significant abuse of power by the government in this case, since a jury has already acquitted the two.

The essence of why real rail safety requires that the Canadian government must drop ALL the Charges NOW.

Canada rail workers win fight against frame-up

The rail bosses and federal government were handed a stinging defeat when the three-and-a-half-month frame-up trial of locomotive engineer Tom Harding and train traffic controller Richard Labrie, both members of United Steelworkers Local 1976, and low-level former Montreal, Maine and Atlantic Railway manager Jean Demaitre, ended here Jan. 19. The 12-member jury declared the three former employees “not guilty” on all counts from the July 2013 derailment and explosion of a 72-car runaway oil train in Lac-Mégantic, Quebec.

Harding, the main target of the frame-up, was also acquitted on two lesser charges. The jury announced the verdict to a packed courtroom on the ninth day of deliberations.

“I am very happy with the verdict,” retired worker and Lac-Mégantic resident Jean Clusiault, told the media at the courthouse. Clusiault’s 24-year-old daughter, Kathy, was one of those killed at the Musi-Café near the tracks when the train derailed and exploded. “They treated these people horribly, like killers,” he said, referring to the three framed up men. “They broke their lives.”

Many people from Lac-Mégantic attended the trial. Clusiault was there every court day. When reporters asked him who he thought was guilty, he pulled a rumpled piece of paper from his pocket and started reading a list of high company officials, beginning with former CEO Edward Burkhardt.

“This is a victory for workers,” Gilbert Carette, a former Quebec highway maintenance department worker, told the Militant. “This tragedy, caused by company negligence and government deregulation of the rail industry, was placed on the shoulders of innocent workers.”

Carette is active in the Citizens and Groups Coalition for Rail Safety in Lac-Mégantic, which has been fighting for the federal and Quebec governments to build a railway bypass around the town.

“The Citizens Coalition,” said spokesperson Robert Bellefleur in a post-verdict press release, “has always insisted that the three employees were ordinary actors in a business scheme planned at high management levels to ensure maximum benefits for top company officials and shareholders of the oil and railway companies involved.”
