Big Oil praises Gov. Brown's state of the state address, activists challenge his policies

Amidst predictably fawning media coverage, California Governor Jerry Brown delivered his sixteenth and final State of the State address at the State Capitol in Sacramento on January 25.

Brown proclaimed that the "bolder path is still our way forward" on climate change, cap-and-trade and infrastructure investment, including the implementation of the water bond of 2014 and the construction of his Delta Tunnels, and an array of other issues.

He said the renewal of his cap-and-trade program on a bipartisan basis was “a major achievement and will ensure that we will have substantial sums to invest in communities all across the state -- both urban and agricultural.”

“The goal is to make our neighborhoods and farms healthier, our vehicles cleaner -- zero emission the sooner the better -- and all our technologies increasingly lowering their carbon output. To meet our ambitious goals, we will need five million zero-emission vehicles on the road by 2030. Think of all the jobs that will create and how much cleaner our air will be,” said Brown.

A statement from Western States Petroleum Association (WSPA) President Catherine Reheis-Boyd praising the Governor's State of the State address pretty much summarizes the oil industry's deep partnership with Jerry Brown since he began his fourth term as Governor In January 2011 and their strong support of his controversial carbon trading program.

In fact, documents leaked to the media in 2017 revealed that Brown’s highly touted cap-and-trade bill, AB 398, was based on a WSPA and Chevron wish list.

Reheis-Boyd, who also served as the Chair of the Marine Life Protection Act (MLPA) Initiative Blue Ribbon Task Force to create so-called “marine protected areas” in Southern California, proclaimed:

“Throughout Governor Brown’s historic years leading our state, he has worked to ensure California sets ambitious standards in climate change policy. As our state’s leading energy producers, we we continue to work with him, future Governors and our state’s leaders to me California’s climate change goals.

Despite hundreds of millions in state rebates and investments, even the Governor noted today that zero emission vehicles, like electric cars, represent a very small percentage of the vehicles on the road today. Of the nearly 26 million passenger cars in California, only 300,000 are zero emission vehicles.

Our members will continue to provide the reliable and affordable fuel that powers our state and the vehicles that Californians choose every day for their families and small businesses.”

Jerry Brown tells indigenous protesters in Bonn, ‘Let’s put you in the ground’

Governor Jerry Brown doesn’t always deal with critics of his controversial environmental policies well — and that was the case again on Saturday, November 11, when he spoke at the UN Climate Conference in Bonn, Germany.

Californians, including indigenous water protectors and those on the frontlines of climate change, disrupted California Governor Jerry Brown’s speech at the “American’s Pledge” event at the UN climate talks to confront his strong support of fossil fuels in his state.

The banner-carrying protesters yelled, “Keep it in the ground” and other chants, referring to the governor’s strong support of fracking, both offshore and on land in California, and cap-and-trade policies that could prove catastrophic to the Huni Kui People of Acre, Brazil and other indigenous communities around the globe.

“I wish we have could have no pollution, but we have to have our automobiles,” said Brown as the activists began disrupting his talk.

“In the ground, I agree with you,” Brown said. “In the ground. Let’s put you in the ground so we can get on with the show here.”

“This is very California. Thanks for bringing the diversity of dissent here,” the visibly disturbed Brown continued.

This is not the first time that Brown has employed harsh words to blast his opponents. On July 25 of this year, Brown blasted critics of his oil industry-written cap-and-trade bill, AB 398, for practicing “forms of political terrorism that are conspiring to undermine the American system of governance” in an interview with David Greene of NPR (National Public Radio).

Governor Brown, portrayed as “a green governor,” “climate hero,” and “resistance to Trump” by the mainstream media and corporate “environmental” NGOs, has come to the climate talks to promote California as a global model of “climate leadership” at a time when increasing number of Californians are fed up with his pro-Big Oil and pro-Big Ag environmental policies

The alarming ties between Jerry Brown’s Delta Tunnels and his faux Marine Protected Areas

The deep relationship between the MLPA Initiative and Delta Tunnels is undeniable. In many ways, the neoliberal MLPA Initiative process, completed in December 2012, has served a template for the Governor’s campaign to build the tunnels.

In spite of some superficial differences, the two processes have been united by their (1) leadership, (2) funding, (3) conflicts of interest, (4) greenwashing goals, (5) racism and denial of tribal rights and (6) junk science. When people educate themselves on the undeniable links between the two processes, I believe they can more effectively wage a successful campaign against the Delta Tunnels and to restore our imperiled salmon and San Francisco Bay-Delta fisheries.

In spite of massive opposition to the MLPA Initiative by Tribal leaders, fishermen, grassroots environmentalists, the fake “marine protected areas” overseen by a Big Oil lobbyist and other political hacks went into effect anyway. I fear the same thing will happen in the Delta Tunnels struggle.

In  recent months, have seen a number of decisions, including the Delta Stewardship Council’s approval of the Delta Plan amendments,the NOAA Fisheries no jeopardy biological opinion, and the California Department of Fish and Wildlife’s approval of a permit to kill endangered salmon and other species in the Delta Tunnels, that advance the California WaterFix proposal.

It’s like back in 2011 when after a couple of favorable court rulings, successful direct action protests and growing opposition to the MLPA Initiative, things went bad. The fishing groups lost a major lawsuit, the Fish and Game Commission backed down on their commitment to protect tribal gathering rights, and in spite of the Co-Chair of the North Coast MLPA Science Advisory going to prison for embezzlement of federal money from the Yurok Tribe, the faux “marine protected areas” went into effect anyway.

California’s Delta Tunnels/ Waterfix dealt fatal blow; rejected by Westlands Water District

Growers in the massive district, located on the west side of the San Joaquin Valley, cited the high cost of the state-federal proposal as their reason for rejecting the project. Politically powerful Westlands is the largest irrigation district in the country.

The district would be one of the key beneficiaries of the proposed 35-mile long twin tunnels under the Sacramento-San Joaquin Delta — and their rejection of the project is a major loss for the Brown administration’s campaign to fast-track the construction of the tunnels. It also sends a message to other water districts that the cost of the controversial plan is not worth the potential benefits.

The Metropolitan Water District (MWD) of Southern California board is slated to  vote on the tunnels in early October, but the Westlands vote delivers a major blow to the project.

“Westlands’ decision to not participate in the California WaterFix will make it very difficult for other agencies to participate,” Tom Birmingham, the General Manager of Westlands, told the Los Angeles Times.

Delta Tunnels: Bureau of Reclamation is “Beyond reclamation.”

“Three recent federal audits have found the U.S. Bureau of Reclamation misspending more than $100 million in funds but the agency has not committed to any meaningful reforms nor to punishing any responsible officials,” according to Public Employees for Environmental Responsibility (PEER).

“The latest audit, last week, identified $84.8 million in improper Bureau of Reclamation payments to the State of California for its controversial Delta Tunnel Project. Despite this finding, the Bureau has no stated plans to recover even a penny.”

“Three recent critical audits arose from reports by Reclamation’s own employees represented by PEER. In the latest report on Friday, the Inspector General (IG) for the U.S. Department of Interior concluded that Reclamation illegally siphoned off funds to benefit fish and wildlife for the Delta Tunnel, a project to trans-ship vast quantities of freshwater from the Sacramento River and Delta to the south.  This project does not benefit fish and wildlife – just the opposite – but will principally benefit south-state irrigators,” PEER said.

This is the third recent “scathing report” on Reclamation misappropriations, according to the whistleblower group:

  • In late August, the U.S. Office of Special Counsel concluded that Reclamation illegally gave $32 million to Klamath Basin irrigators, again misusing funds earmarked for protecting fish and wildlife.  This ruling validated an earlier IG report confirming whistleblower disclosures; and
  • In October, the IG found that Reclamation never collected “repayment of millions of dollars of costs incurred to design, construct, and operate and maintain new head gates and fish screens” within the Klamath Project. These gates and screens are supposed to keep federally protected fish “in the river and out of the Klamath project irrigation canals

The misuse of funds in the Klamath Basin couldn’t have come at a worse time. The number of fall Chinook salmon predicted to return to the Klamath and Trinity rivers in 2017 — approximately 11,000 fish — is the lowest on record, a result of two consecutive juvenile fish disease outbreaks and other factors, including water diversions, dams, drought and ocean conditions.

The Pacific Fishery Management Council closed recreational and commercial salmon fishing in the Klamath Management Zone this season. Recreational fishing for fall run Chinook is banned on the Trinity and Klamath rivers this year.

California’s largest union opposes wasteful Delta Tunnels/ WaterFix

An open letter from the SEIU to the Metropolitan Water District Board of Directors

Dear Board of Directors:

Service Employees International Union (SEIU) Local 721 urges you to oppose the proposal to build massive water tunnels in Northern California, known as the so-called California WaterFix. Our 97,000 members deliver public services in counties, cities, sanitation and water districts and non-profits across six counties including Los Angeles. Water quality is vital to our members both as residents and workers.

Fixing aging infrastructure for Southern California is linked with creating environmentally sustainable water capture at the local level. During the recent storms in L.A., the region enjoyed a deluge of rain that turned yards and hills green again. But we also saw the negative impacts to aging infrastructure, with road sink holes, emergency calls to Sanitation Districts and, most importantly, a rush of uncaptured water rolling through storm drains to the ocean.

We support efforts to capture our stormwater, and last month’s LA County Supervisors motion to determine an appropriate parcel tax to fund stormwater capture and water quality projects and programs in the coming year. We also support the partnership between Metropolitan Water District and L.A. County Sanitation Districts to build a new recycled water facility and upgrade our treatment plants in Carson and the City of Los Angeles, producing a new water source.

We support Mayor Eric Garcetti’s goals to increase reliability and double local water sources by 2035. The City of Santa Monica, the City of Camarillo, Ventura County Water, Orange County and L.A .County are also proposing similar efforts to increase local and regional water projects.

Neither the State nor Metropolitan Water District has released a credible financial plan on the real impacts to ratepayers, and there is good reason to suspect the costs will be much larger.

We oppose the so-called California WaterFix to build massive water tunnels in Northern California.

Jerry Brown, climate leader or climate charlatan?

Brown made the announcement at a time when increasing numbers of Californians are challenging his  environmental credentials as he teams up with the Donald Trump administration to build the controversial Delta Tunnels and to exempt three major California oilfields from protection under the federal Safe Water Drinking Act.

“It’s up to you and it’s up to me and tens of millions of other people to get it together to roll back the forces of carbonization and join together to combat the existential threat of climate change,” said Governor Brown in his remarks on the eve of the G20 Summit. “That is why we’re having the Climate Action Summit in San Francisco, September 2018.”

“President Trump is trying to get out of the Paris Agreement, but he doesn’t speak for the rest of America. We in California and in states all across America believe it’s time to act, it’s time to join together and that’s why at this Climate Action Summit we’re going to get it done,” he claimed.

Ten Concrete Actions Jerry Brown Can Take to Become a Real Green Governor

Responding to President Donald Trump’s decision on June 1 to withdraw from the Paris Climate Agreement, California Governor Jerry Brown immediately issued a bluntly-worded statement condemning the decision.

“Donald Trump has absolutely chosen the wrong course,” said Brown. “He’s wrong on the facts. America’s economy is boosted by following the Paris Agreement. He’s wrong on the science. Totally wrong. California will resist this misguided and insane course of action. Trump is AWOL but California is on the field, ready for battle.”

As usual, Brown’s statement and ensuing interviews were greeted by mostly fawning, uncritical coverage by the national and international media portraying the Governor as the “resistance” to Trump and a “climate leader.” Brown may speak colorful and fiery words at times, words that many agree with, but they are often not backed up by his actions.

He’s a political genius when it comes to working media, since he’s convinced much of the state, national and international media that he’s a “climate leader” and “green governor” at the same time he oversees some of the most environmentally devastating policies of any governor in recent California history.

If Brown really cared about climate change, green energy, the environment and the people of California and the planet, he would take a number of urgently-needed actions, rather than just issue constant statements and proclamations about how “green” his administration is.

Extinction 2017: California Edition

One of the least discussed issues in California environmental politics – and one of the most crucial to understanding Governor Jerry Brown’s Delta Tunnels Plan – is the clear connection between the Marine Life Protection Act (MLPA) Initiative and the California WaterFix, formerly called the Bay Delta Conservation Plan (BDCP).

At a time when local, national and international mainstream media are focusing on the Oroville Dam crisis, it’s important for reporters to dig deeper and understand the context that the emergency, which spurred the evacuation of over 188,000 people in Butte, Yuba and Sutter counties, occurs within.

It’s crucial to understand that these two neo-liberal processes, the MLPA Initiative and the California Water Fix, are the environmental “legacy” that two Governors, Arnold Schwarznegger and Jerry Brown, have devoted their energy, staff and money to, rather than doing the mundane but necessary process of maintaining and repairing the state’s water infrastructure, including Oroville Dam.

The privately-funded MLPA Initiative and the California WaterFix at first may appear to be entirely different processes.

The MLPA Initiative, a process begun in 2004 under the Schwarzenegger administration, purported to create a network of “marine protected areas” along the California coast. The network was supposedly completed on December 19, 2012 with the imposition of contested “marine protected areas” along the North Coast under the Jerry Brown administration.

On the other hand, the Bay Delta Conservation Plan process began under the Bush and Schwarzenegger administrations to achieve the so-called “co-equal goals” of water supply reliability and Delta ecosystem restoration. In 2015, the state and federal governments divided the BDCP into two projects, the California WaterFix, the conveyance component and the California EcoRestore, the habitat “restoration” component.

But in spite of some superficial differences, the two processes are united by their leadership, funding, greenwashing goals, racism and denial of tribal rights, junk science and numerous conflicts of interest. When people educate themselves on the links between the two processes, I believe they can more effectively wage a successful campaign against the Delta Tunnels and to restore our imperiled salmon and San Francisco Bay-Delta fisheries.

How Green is Jerry Brown?

This review fact-checks the perception of Jerry Brown as an environmentalist against his actions since taking office as Governor in 2011 to answer the question: “How Green Is Brown?” On a continuum of “Green” to “Murky” to “Dirty,” the review concludes that Brown’s environmental record is not green. The following advocates and public interest groups concur with the report’s analysis, conclusions, and recommendations: Food & Water Watch, Physicians for Social Responsibility-Los Angeles, Rootskeeper, Powers Engineering, Basin & Range Watch, Aguirre & Severson LLP, Public Watchdogs, the Southern California Watershed Alliance, The Desal Response Group, Restore The Delta, and Committee to Bridge the Gap.

Brown has staked his environmental legacy on fighting climate change, calling it the “singular challenge of our time.” He claims that he is enacting “a 1 thorough, integrated plan to reduce fossil fuel consumption.” He plans to have 1.5 million electric cars on the road by 2025 and has granted major investor-owned utilities a windfall of billions of dollars to build the charging infrastructure to make it happen. Yet, he has thrown his support to the fossil fuels industry whose products emit the most carbon on the planet when burned for transportation, electricity, and heat.

Far from the environmentalist that Brown claims to be, Brown has expanded the burning of heat-trapping natural gas and nurtured oil drilling and hydraulic fracturing while stifling efforts to protect the public from harm. The Public Utilities Commission has approved a slew of unnecessary new fossil-fuel power plants when the state’s three major investorowned utilities have overbuilt their generating capacity by nearly triple the minimum extra capacity that the state requires. Under Brown, the number of active onshore state oil and gas wells jumped by 23 percent since the year before he was elected Governor in a bid to produce more oil.

Hydraulic fracturing is producing 20 percent of the state’s oil, while companies continue to use other common, dirty methods of oil extraction exempted from fracking legislation under Brown. Companies are extracting oil from a few hundred newly permitted offshore wells in existing state leases since Brown came to office, though Brown asked then- President Obama to ban any new drilling in California’s federal waters. Brown’s regulators have ignored a petition signed by 350,000 people to ban the use of toxic oil wastewater for crop irrigation until proven safe.
