Striking Alabama Miners Are Done Playing Nice

BROOKWOOD, ALA. — ​“You ain’t working tonight!”

That was one of the picket line chants heard June 15 as several hundred members of the United Mine Workers of America (UMWA) and their allies attempted to block strikebreakers from entering the Warrior Met Coal mine.

With tank tops that read ​“scab bullies,” supporters stood shoulder to shoulder with the miners while police pleaded for protesters to move their trucks. No one would claim the vehicles.

“Who is in charge?” one of the officers asked.

“Everyone,” answered Haeden Wright, president of a local UMWA women’s auxiliary unit, a close-knit group of union members’ wives and supporters. ​“We are the UMWA.”

Police eventually towed the vehicles, but the standoff would last for hours. One miner offered a simple explanation: ​“This playing nice shit ain’t cutting it.”

The picket line had grown contentious before. In May, about two months after the strike began, Tuscaloosa police arrested 11 leaders of the UMWA and the Alabama AFL-CIO for blocking one of the mine’s 12 entrances. They all spent the night in jail and, according to the union, were given a warning: If they’re arrested again, they will be held until trial.

Along with threats from police, striking miners have faced other attacks — including three separate vehicular assaults in June, in which drivers plowed into UMWA picketers.

“Warrior Met personnel, either management or nonunion workers, have repeatedly struck our members, who were engaging in legal picket line activities, with their vehicles,” UMWA International President Cecil E. Roberts said in a June 7 statement. ​“We have members in casts, we have members in the hospital, we have members who are concerned about their families and potential of violence against them if they come to the picket line.”

The work stoppage, which follows the months-long campaign to unionize Amazon warehouse workers in nearby Bessemer, is one of the country’s most significant mining strikes in decades. On April 1, upward of 1,100 workers walked off the job as their contract with Warrior Met expired. The union reached a tentative agreement with management a week later, but rank-and-file members rejected it, claiming it failed to address demands for better hours and wages. The miners remained on strike.

When the UMWA signed its most recent contract in 2016, it agreed to significant concessions to save the jobs of workers laid off by the mine’s previous owners, Jim Walter Resources, with the understanding that new management would eventually reward workers for their sacrifice. Those concessions included an average wage cut of $6 (from $28 to $22), mandatory seven-day workweeks, loss of overtime pay and, perhaps most crucially, an end to full healthcare coverage.

Coal Miners Strike in Alabama: 'Warrior Met Coal Ain't Got No Soul!'

On June 22, Alabama coal miners represented by the United Mine Workers of America picketed BlackRock, State Street Global Advisors, and Renaissance Technologies—the investment firms who finance and reap the profits from their employer, Warrior Met Coal.

Just as Amazon workers were concluding their disastrous union election in Bessemer, about 1,100 metallurgical coal miners were voting to strike Warrior Met Coal in nearby Brookwood, Alabama. The miners say Warrior Met and the New York hedge funds backing it have failed to follow through on their end of an agreement made five years ago.

Warrior Met Coal, Inc, was formed to purchase the assets of Walter Energy after that company was declared bankrupt in 2016. The sale terms stipulated that Walter Energy's remains would be purchased "free and clear," meaning Warrior Met was not obligated to employ Walter Energy's miners or recognize their union. Warrior Met agreed to retain the miners and honor their representation if they signed a subpar contract mandating excruciating sacrifices. These included hefty cuts to pay and benefits paired with inhumane scheduling and firing policies. "You could be scheduled 7, 10, 20 days straight," says Haeden Wright, president of the auxiliary for two striking UMWA locals.

Workers saw their hard-earned pensions swapped out for threadbare 401Ks. They lost much of their ability to earn overtime pay, all but three holidays off with their families, and 30 minutes of paid lunch time (lunch is eaten deep underground near dangerous methane gas and coal and silica dust). They could take three days off if a loved one died, but under Warrior Met's "four strike" policy a fourth day off would result in termination. Pay was slashed by between $6-$8 an hour, bringing it well below the industry standard for unionized miners. Health insurance was cut from 100% coverage to an 80/20 system with massive out-of-pocket costs—no small concern in one of the most physically hazardous professions, with high rates of life-altering injuries and 10% of workers suffering from black lung

Warrior Met assured the miners that if they accepted these losses, they would be taken care of in the next contract. So they endured the squeeze and delivered Warrior Met from its financial hardship, producing "ungodly amounts of coal" and billions in profit for the company and its investors. When contract negotiations began this spring, however, Warrior Met reneged on its promise, refusing to bargain in good faith.

More than a thousand coal miners at Warrior Met Coal are now in the third month of their strike in the right-to-work state of Alabama. The miners walked off the job on April 1 after their union, the United Mine Workers of America, called the first strike to hit the state’s coal mining industry in four decades. Workers are fighting for improvements to wages and benefits after they agreed to drastic cutbacks in 2016, when Warrior Met Coal took control of the mines after the previous company went bankrupt. Today a group of striking mine workers traveled from Alabama to Wall Street to protest the investment firms backing Warrior Met. “These are the companies that fund Warrior Met and allow Warrior Met to pay their executives millions of dollars a year, while the miners, the workers themselves who are creating that value, are struggling to get by on sometimes as little as $22 an hour,” says labor journalist and organizer Kim Kelly.

The strike itself has gained more national attention, which has also put a spotlight on the harsh tolls that coal mining takes on workers, their bodies, and their families. From work-related diseases like black lung and silicosis to methane explosions and roof cave-ins, coal mining has always been a dangerous job, and coal miners today still face many hazards. In the latest installment of “Battleground Brookwood,” TRNN contributor Kim Kelly continues her coverage of the strike at Warrior Met Coal by investigating the true price of coal production.

Fighting for Coal Country

Clearly, the UMWA's positions on carbon capture and storage (CCS) and so-called "clean coal" stand in contrast (and, for the most part, opposition) with the entirety of the climate justice movement, ecosocialists, green syndicalists, and a good deal of rank-and-file union members not involved in resource extraction (including the more than 60-70% who support something like the Green New Deal). That said, at least the UMWA finally accepts that coal is a dying industry and a just transition is needed. Therefore, this is presented to show where the UMWA stands, not as an endorsement of their positions.

At the end of 2011, there were nearly 92,000 people working in the American coal industry, the most since 1997. Coal production in the United State topped a billion tons for the 21st consecutive year. Both thermal and metallurgical coal were selling at premium prices and companies were making large profits.

Then the bottom fell out. Over the next 4 years, coal prices cratered, especially in metallurgical coal but also in thermal coal. The global economy slowed, putting pressure on steelmaking and metallurgical coal production. Foreign competition from China, Australia, India and elsewhere cut into met coal production.

Domestically, hydraulic fracturing (fracking) of shale formations opened up previously untapped natural gas fields, caused the price of gas to drop below that of coal for the first time in years. Utilities began switching the fuel they used to generate electricity from coal to gas. Environmental regulations coming from the Obama administration also impacted coal employment. By 2016, just 51,800 people were working in the coal industry. 41,000 jobs had been lost.

Companies went bankrupt. Retirees’ hard-won retiree health care and pensions were threatened. Active miners saw their contracts, including provisions that had been negotiated over decades, thrown out by federal bankruptcy courts. From 2012 to today, more than 60 coal companies have filed for either Chapter 11 reorganization bankruptcy or Chapter 7 liquidation. Almost no company has been immune.

“Just since 2015 we have had companies like Peabody, Arch, Alpha Natural Resources, Walter Energy, Westmoreland and Murray Energy all go bankrupt,” President Roberts said. “Patriot Coal went bankrupt twice. Retirees’ health care was on the brink, but we were successful in preserving that in 2017. The 1974 Pension Fund was on the path to insolvency, but we were able to save that in 2019.

“Even though our contracts were thrown out by bankruptcy judges at company after company, we were successful in preserving union recognition, our members’ jobs and reasonable levels of pay and benefits at every company as they emerged from bankruptcy,” Roberts said. “But in no case has the contract that came out of bankruptcy been the same as the one our members enjoyed when a company went into bankruptcy. This has been extremely painful all the way around.”

Utility Workers Union and UCS estimate costs to transition U.S. coal miners and power plant workers in joint report

Hard on the heels of the April statement by the United Mine Workers Union, Preserving Coal Country: Keeping America’s coal miners, families and communities whole in an era of global energy transition, the Utility Workers Union of America (UWUA) jointly released a report with the Union of Concerned Scientists on May 4: Supporting the Nation’s Coal Workers and Communities in a Changing Energy Landscape. This report is described as “a call to action for thoughtful and intentional planning and comprehensive support for coal-dependent workers and communities across the nation.” The report estimates that in 2019, there were 52,804 workers in coal mining and 37,071 people employed at coal-fired power plants – and that eventually all will lose their jobs as coal gives way to cleaner energy sources. Like the United Mine Workers, the report acknowledges that the energy shift is already underway, and “rather than offer false hope for reinvigorated coal markets, we must acknowledge that thoughtful and intentional planning and comprehensive support are critical to honoring the workers and communities that have sacrificed so much to build this country.”

Specifically, the report calls for a minimum level of support for workers of five years of wage replacement, health coverage, continued employer contributions to retirement funds or pension plans, and tuition and job placement assistance. The cost estimates of such supports are pegged at $33 billion over 25 years and $83 billion over 15 years —and do not factor in additional costs such as health benefits for workers suffering black lung disease, or mine clean-up costs. The report states: “we must ensure that coal companies and utilities are held liable for the costs to the greatest extent possible before saddling taxpayers with the bill.” Neither do the cost estimates include the recognized needs for community supports such as programs to diversify the economies, or support to ensure that essential services such as fire, police and education are supported, despite the diminished tax base. 

The report points to the precedents set by Canada’s Task Force on Just Transition for Canadian Coal Power Workers and Communities ( 2018), the German Commission on Growth, Structural Change and Employment (2019), as well as the New Mexico Energy Transition Act 2019 and the Colorado Just Transition Action Plan in 2020. The 12-page report, Supporting the Nation’s Coal Workers and Communities in a Changing Energy Landscape was accompanied by a Technical Report, and summarized in a UCS Blog which highlights the situation in Illinois, Michigan, and Minnesota. Mineworkers Union Supports Biden's Green Energy Plan

One of the biggest impediments to President Biden’s climate plan has done a 180 and is now supporting the plan.

The United Mineworkers of America (UMWA) announced this week that they support the President’s green energy policies in exchange for a robust transition strategy. The union hopes that this will mean more jobs for their members as it becomes clear that more industries are moving away from coal. The move by the UMWA is especially important as they have a close working relationship with West Virginia Senator Joe Manchin whose support will be needed to pass any green energy plan. Manchin is also the Chairman of the Senate Energy and Natural Resources Committee. The union is also calling on Congress to allocate funds to train miners for good-paying jobs with benefits in renewable energy sectors.

President Biden has proposed allocating $16 billion to reclaim abandoned mines and to plug leaking gas and oil wells. This would not only provide bridge jobs for workers in areas like West Virginia, but it would also address serious environmental issues that these abandoned mines and wells are causing.

Mineworkers President Cecil Roberts said in a live-streamed event with the National Press Club that coal jobs decreased by 7,000 last year leaving only about 34,000 active coal miners in the United States.

“Change is coming, whether we seek it or not. Too many inside and outside the coalfields have looked the other way when it comes to recognizing and addressing specifically what that change must be, but we can look away no longer,” the United Mineworkers stated. “We must act, while acting in a way that has real, positive impact on the people who are most affected by this change.”

“We have to think about the people who have already lost their jobs,” Roberts said. “I’m for any jobs that we can create that would be good-paying jobs for our brothers and sisters who have lost them in the UMWA. As we confront a next wave of energy transition, we must take steps now to ensure that things do not get worse for coal miners, their families, and communities, but in fact get better."

To help these workers through a just transition, the union is proposing significant increases in federal funding for carbon capture technology and storage research and development funding. They are also calling for building out a carbon capture infrastructure such as pipelines and injection wells. This would allow coal-fired plants to remain open, but they would have to install technology that would capture emissions and store them underground instead of in the atmosphere.

Both thermal and metallurgical coal were selling at premium prices, and companies were making record profits.

Then the bottom fell out. The global economy slowed, putting pressure on steelmaking and metallurgical coal production. Foreign competition from China, Australia, India and elsewhere cut into met coal production.

Domestically, huge increases in production from newly-tapped natural gas fields, primarily as a result of hydraulic fracturing of deep shale formations, caused the price of gas to drop below that of coal for the first time in years. As a result, utilities began switching the fuel used to generate electricity from coal to gas. An enlarging suite of environmental regulations also adversely impacted coal usage, production and employment.

lost.

Companies went bankrupt. Retirees’ hard-won retiree health care and pensions were threatened. Active union miners saw their collective bargaining agreements – including provisions that had been negotiated over decades -- thrown out by federal bankruptcy courts. Nonunion miners had no recourse in bankruptcy courts and were forced to accept whatever scraps their employers chose to throw their way.

Since 2012, more than 60 coal companies have filed either for Chapter 11 reorganization bankruptcy or Chapter 7 liquidation. Almost no company has been immune.

In 2017 and again in 2019, the United Mine Workers of America (UMWA) and its bipartisan allies in Congress, led by Sen. Joe Manchin (D-W.Va.), Sen. Shelley Moore Capito (R-W.Va.) and Rep. David McKinley (R-W.Va.), successfully preserved the retiree health care and pensions that the government had promised and tens of thousands of miners had earned in sweat and blood.

The UMWA was successful in preserving union recognition, our members’ jobs and reasonable levels of pay and benefits at every company as they emerged from bankruptcy, but in no case has the contract that came out of bankruptcy been the same as the one our members enjoyed when a company went into bankruptcy

Don’t call it a Just Transition: United Mineworkers announce Principles for Preserving Coal Country

United Mine Workers of America president Cecil Roberts was accompanied by West Virginia’s senior Senator Joe Manchin on April 19 when he announced the UMWA’s new principles for addressing climate change and the energy transition. Preserving Coal Country: Keeping America’s coal miners, families and communities whole in an era of global energy transition is built on three goals: “preserve coal jobs, create new jobs, and preserve coalfield families and communities.” The UMWA statement calls for specific steps to achieve those goals, including enhanced incentives for carbon capture and storage research, with a goal of commercial demonstration of utility-scale coal-fired CCS by 2030; tax incentives for build-out of renewable supply-chain manufacturing in coalfield areas, with hiring preference for dislocated miners and families; and provision of wage replacement, family health care coverage, and pension credit/401(k) contribution, as well as tuition aid. For the community, the principles call for direct grants to coalfield counties/ communities/school districts to replace lost tax revenues for 20-year period, as well as targeted investment in infrastructure rehabilitation and development – roads, bridges, broadband, schools, health care facilities. 

The document concludes with a statement of willingness to work with Congress, President Biden, and other unions, and with this: “This cannot be the sort of “just transition” wishful thinking so common in the environmental community. There must be a set of specific, concrete actions that are fully-funded and long-term. The easiest and most efficient way to fund this would be through a “wires” charge on retail electric power sales, paid by utility customers, which would add about two-tenths of one cent per kilowatt hour to the average electric bill. This would amount to less than $3.00 per month for the average residential ratepayer.”

Passage of the PRO Act is also one of the action items in the Mine Workers Preserving Coal Country statement, and a key goal for American unions.
