Tesoro: A Track Record of Pollution, Hostility to Workers, and Meddling in Politics

Right about now, oil executives in Texas are boarding a plane bound for the Northwest. Their goal? To steam roll opposition to the monster oil train terminal that Tesoro wants to construct on the downtown waterfront of Vancouver, Washington.

Hot on the heels of learning that the local city council is narrowly opposed to the project, the oil refining giant is going on a full court press lobbying mission in Vancouver, Washington. The companies leadership, including senior VPs and CEO Greg Goff, will be meeting behind closed doors with members of the city council and the Port of Vancouver. Then on Tuesday, March 25 from 1:00 to 2:00, they are holding a private meeting with 40 business leaders at the Heathman Lodge.

As a public service to the community of Vancouver, it’s worth explaining what Tesoro is—and why their oil train terminal has no place on the Columbia River.

Capital Blight - Oil Town Rebellion

For years, the communities of Western and Northwestern Contra Coast County and southwestern Solano County, located on the San Pablo and Suisun Bays, northwest of the San Francisco Bay have been dominated by the fossil fuel industry (and to some extent--until 1993--by the US Military Industrial Complex), and the capitalists running that industry have run each of these communities essentially like company towns.

Under these conditions, all official institutions, including elected city, county, and regional governments, most other businesses, and even the unions that supposedly "represent" the workers in these facilities are beholden to the dominant capitalist interests. Dissident residents or workers--if there are any--often find themselves isolated and alone if they can even find the courage to speak out at all. Complaints about working conditions, corrupt union officials, bought politicians, environmental racism, toxic pollution, and capital blight often fall on deaf ears and are usually dismissed as the product of "outside agitators", even "unwashed-out-of-town-jobless-hippies-on-drugs" or some such thing.

In this northwestern Bay Area region, there are four corporate refineries that dominate the towns of Avon and Pacheco (Tesoro), Benicia (Valero), Martinez (Shell), Richmond (Chevron), and Rodeo and Crockett (Conoco-Phillips), and--as one would expect--dissenters have indeed had a difficult, almost impossible time being heard.

Chevron in particular has run Richmond as a virtual company town as long as it has existed (indeed, the refinery predates the town's founding).  For years, the people of the nearby residential neighborhoods have complained of toxic pollution and political double standards that favor the corporation--allegations that are supported by mountains if evidence. Until recently, the local politicians were entirely loyal to the company.

The environmental struggles of these communities--mostly composed of African-Americans, Asian, Latino, and working class White people--have often been ignored by mainstream environmental NGOs. Locally based environmental groups, including the West County Toxics Coalition and Communities for a Better Environment (CBE), have had to do the vast majority of the work of bringing attention to the plight of their residents. On occasion, Greenpeace and Earth First! have given attention to them, but for the most part, it's been locals--most of whom are not typically activist oriented--who've borne the brunt of the struggles.

Many of these refineries are unionized--mostly by the United Steelworkers Union, with a minority of the workers instead belonging to IBEW Local 180. Naturally, the leadership of these unions has oriented themselves towards capitalist interests, who have on numerous occasions tripped over themselves to voluntarily speak on behalf of their capitalist masters.

For example, in 1999, after four refinery workers were killed in a fire, at the Tosco (now Tesoro) facility in nearby Avon, CBE spoke up on behalf of the deceased and called for stricter regulations of refineries (to protect both workers and the environment). Tosco, of course, opposed the proposed regulatory changes, instead calling for more watered down oversight which--CBE argued--left the foxes guarding the hen-house. Rather than support CBE, Jim Payne of the PACE union local that "represented" the workers at the time excoriated the environmentalists, declaring,

"It absolutely infuriates me that those damned tree-huggers would place this regulation in jeopardy,"

Certain residents of the nearby communities of Avon and Clyde were not especially welcoming of CBE either because--naturally--Tesoro used their substantial economic and political leverage to convince these people that CBE were "outside agitators", perhaps even "unwashed-out-of-town-jobless-hippies-on-drugs" (imagine that!).

This incident was very similar to the PCB spill in Georgia Pacific's lumber mill in Fort Bragg, California, that took place a decade earlier, in which the union leadership of IWA Local 3-469 (one Don Nelson) essentially took the company's side, leaving the rank and file workers to seek outside help from Earth First! and the IWW. Those efforts were led by Anna Marie Stenberg and (you guessed it), Judi Bari.

In spite of years of frustration and the corporations' seemingly iron rule, aided in large parts by their attempts to divide and conquer workers and environmentalists, the political winds in these northwestern Bay Area refinery towns appears to be shifting. Dissidents are gaining traction within their communities, no longer finding themselves isolated from their fellow residents. Workers employed by these industries are speaking out and even making alliances with environmentalists, the communities are finding that they can elect politicians willing to chart a course independent of the dominate corporate forces, and regulatory agencies—who usually provide official cover for the capitalists they’re ostensibly charged with regulating—are actually showing signs of actually demanding accountability from the powers that be.

Energy Crisis and Social Crisis

Every sector of the economy depends on it: energy of one kind or another. Energy makes the world go round and the power that rules the world is linked to the way energy is produced and consumed. The capitalist regime did not really gain momentum until the steam engine and the energy produced by the combustion of coal could be harnessed to industry. The initial dependence on coal was the cause of the vast size and appalling filth of the first industrial factories and cities; as the basis of the productive process, this dependence was responsible for the centralization of the entire system and the intensive exploitation of labor power. The internal combustion engine and the turbine put an end to the rule of coal, but not to the basic characteristics of society that had been created by it. Although the generalized use of electricity and gasoline made production more flexible and extended the range of consumption, facilitating the decentralization of factory production and the unlimited geographical expansion of the cities, social development continued to proceed within the framework that had been established by “carboniferous” capitalism: not only was the model of concentrated and hierarchical power maintained, but it was further reinforced by the new technologies. The refinement of machine production only reduced the role of the workers in the productive process, intensified exploitation and stabilized the class order. The new technologies consolidated class society and reinforced the foundations of domination.

Petroleum and electricity allowed productive activities to be relocated far from primary energy sources, that is, they capitalized the world. The extreme separation between the production and consumption of energy made transport the main strategic factor and at the same time the weak link of the system. Any serious disruption in the energy supply would cause all of society to collapse very quickly. Capitalism cannot exist without an extremely robust privatized distribution network to connect energy sources, which are under the control of financial enterprises or state-based mafias, with their consumer hostages. The expropriation of energy resources is a most instructive characteristic of social inequality: the proletarian from this perspective is the person who does not have unrestricted access to free energy. This explains why the ruling class strives to maintain the private ownership of energy resources and thus to keep the population in the most complete dependence. By fighting against the socialization of energy resources, locally controlled power generation and distribution networks and consumption, the ruling class is simply defending its social status.

Without cheap, inexhaustible and easily accessible energy, industrial society cannot continue to grow. The ruling class became aware of this “energy reality” when oil prices spiked after the creation of OPEC in 1973. The response was two-pronged: on the one hand, massive investments in nuclear power; on the other, the arms race of the great powers that was required by geopolitics, that is, the art of controlling of the world’s main oil and gas fields. The militarization of the world became indispensable for the system’s survival. This was a deliberate choice: it was the only way that power and servitude could be maintained.

Workers are Disposable in the Fracking Industry

The oil and gas industry, the nation’s chambers of commerce, and politicians who are dependent upon campaign contributions from the industry and the chambers, claim fracking is safe.

First, close your mind to the myriad scientific studies that show the health effects from fracking.

Close your mind to the well-documented evidence of the environmental impact.

Focus just upon the effects upon the workers.

The oil and gas industry has a fatality rate seven times higher than for all other workers, according to data released by the Centers for Disease Control. (CDC). According to the CDC, the death rate in the oil and gas industry is 27.1; the U.S. collective death rate is 3.8.

“Job gains in oil and gas construction have come with more fatalities, and that is unacceptable,” said John E. Perez, secretary of labor.

Not included in the data, because it doesn’t include the past three years, when the oil/gas industry significantly increased fracking in the Marcellus and other shales, is a 27-year-old worker who was cremated in a gas well explosion in late February in Greene County, Pa. One other worker was injured. Because of extensive heat and fire, emergency management officials couldn’t get closer than 1,500 feet of the wells. Pennsylvania’s Act 13, largely written by the oil and gas industry, allows only a 300 foot set-back from wells to homes. In Greene County, it took more than a week to cap three wells on the pad where the explosion occurred.

The gas drilling industry, for the most part, is non-union or dependent upon independent contractors who often provide little or no benefits to their workers. The billion dollar corporations like it that way. That means there are no worker safety committees and no workplace regulations monitored by workers. The workers have no bargaining or grievance rights; health and workplace benefits for workers who aren’t executives or professionals are often minimal or non-existent.

From D.C. to Connecticut, Obama Met with Keystone Pipeline Protests

This past week [March 1-7, 2014], Connecticut residents and students traveled as far as Washington DC and as close as New Britain to protest the proposed Keystone XL pipeline. The pipeline would carry leak-prone tar sands oil from Canada into the US. Both demonstrations targeted President Obama, who has the legal authority to block the pipeline. Although Obama campaigned on promises of climate protection, his repeated embrace of fossil fuel infrastructure recently led Business Week to deem him president of “The Petro States of America.”

On Sunday March 2, students from over 80 colleges met in Washington DC and marched to the White House in a demonstration called “XL Dissent”. At the White House, many took part in a “human oil spill” and locked themselves to the gates. Police arrested some 398 people. Democracy Now! reporter Amy Goodman commented the protest “could be the largest youth sit-in on the environment in a generation.” Several Connecticut students and residents participated.

Oil Boom Kills More Workers, But Government Takes No Action

Just last Friday [February 21, 2014], oil drilling claimed the life of another worker. Nathan James Scott, 26, was struck by a welding truck and died at a drilling site in Converse County, Texas, owned by Houston-based EOG Resources. An investigation into his death is in progress. But federal regulations and investigations haven’t been enough to stem the climbing death and injury rates in the oil and gas industry. In fact, the federal government has declined to issue even basic safety rules for onshore drilling, and is in the midst of cutting funding for workplace safety inspections.

The fatality rate for workers in onshore oil and gas drilling is startlingly high compared with other industries, seven times higher than the average, and injuries are far more common. In Texas, the oil industry kills more of its workers than any other. And as an investigation by the Houston Chronicle found, the federal government isn’t taking action to make it safer.

Crying for Lec Megantic… and Learning the Lessons

On February 24, Marilaine Savard, from Lac Megantic Canada gave a presentation in Pittsburg, CA, on the train tanker car explosion that rocked that little town last July, killing 47 people (it would have been far more if it had been later in the morning) and destroying most of downtown. The explosion was of Bakken crude oil, the most explosive oil being pumped nowadays. The Obama administration has ordered “emergency safety rules” for transporting Bakken crude. Those rules are merely that the oil has to be pre-tested for explosiveness. That means absolutely nothing, and even if they did impose more rules, they will not be enforced, if simply by underfunding so there aren’t enough inspectors (a very common trick). From the well head to the refinery and all along the way, fracking is deadly. And that doesn’t even include how it adds to global climate disaster – global warming.

The AFL-CIO's Keystone Pipeline Dreams

The IWW maintains that we must not only abolish wage slavery, we must also, "live in harmony with the Earth". The same economic forces that subject the working class to wage slavery are those that are destroying the planet on which we all live. Logically, if the business unions are not fighting to abolish wage slavery, it follows that they will be unable to take a meaningful stand on environmental issues.

Therefore it comes as no surprise that the AFL-CIO President, Richard Trumka has officially declared his support for the Keystone XL Pipeline, specifically stating, “there’s no environmental reason that [the pipeline] can’t be done safely while at the same time creating jobs.”

He has further gone on to speak in favor of increasing natural gas exports, opining,

“Increasing the energy supply in the country is an important thing for us to be looking at…all facets of it ought to be up on the table and ought to be talked about. If we have the ability to export natural gas without increasing the price or disadvantaging American industry in the process, then we should carefully consider that and adopt policies to allow it to happen and help, because God only knows we do need help with our trade balance.”

Do we really need to elaborate on the foolishness in suggesting that Keystone XL is either good for the environment or creating jobs, because it most certainly is neither, and we can readily prove that.

To begin with, it’s not the construction of the Keystone XL Pipeline itself that’s the primary issue, but what will inevitably be transported through it that is the bone of contention. Nobody disputes that it will transport oil extracted from Canadian tar sands mining, and such oil will be anything but green.

Cole Strangler's article in In These Times, Angering Environmentalists, AFL-CIO Pushes Fossil-Fuel Investment Labor’s Richard Trumka has gone on record praising the Keystone pipeline and natural gas export terminals, lays out a fairly strong case that Trumka’s claims are false, stating:

The anti-KXL camp has long argued that construction of the pipeline will facilitate the extraction of Alberta’s tar sands oil, one of the dirtiest fossil fuels on the planet. Many also oppose Keystone XL on the grounds that its route crosses the Ogallala Aquifer, one of the world’s largest underground sources of fresh water. “We invite President Trumka to come to Nebraska and visit with farmers and ranchers whose livelihoods are directly put at risk with the Keystone XL pipeline,” says Jane Kleeb, executive director of Bold Nebraska, which has organized local opposition against the pipeline. “To say the pipeline will not harm our water is ignoring real-life tragedies witnessed by all of us with the BP explosion, the Enbridge burst pipe into the Kalamazoo River and tar sands flowing down the street in Mayflower, Arkansas.”

“Brendan Smith, co-founder of the Labor Network for Sustainability, a group that works with labor unions and environmental groups to fight climate change, took issue with Trumka’s argument that Keystone would create jobs.  “There is plenty of work that needs to done in this country, and we can create far more jobs fixing infrastructure and transitioning to wind, solar and other renewable energy sources,” says Smith. “Why build a pipeline that will significantly increase carbon emissions and will hurt our economy when there is a more robust and sustainable jobs agenda on the table?”

However, the author’s critique barely scratches the surface.

Why Nothing Is Being Done to Improve Oil by Rail Safety

Since the oil train explosion in Lac-Megantic in July of 2013, we have learned that there are some obvious safety issues that need to be addressed regarding transportation of crude oil by rail. The first is that the majority of the rail cars transporting this oil are DOT-111’s which have been deemed unsafe due to their tendency to rupture in accidents. The second is that Bakken crude oil can be explosive and isn’t being properly classified for transport.  

Since Lac-Megantic we have heard many calls for increased rail safety. In August of 2013, Senator Chuck Schumer (D-NY) wrote a letter to the Federal Railway Adminstration (FRA) and the Pipeline and Hazardous Materials Safety Adminstration (PHMSA) requesting that the agency begin a phase out of the DOT-111 rail cars. Senator Schumer also referenced a March 2012 letter written by National Transportation Safety Board (NTSB) Chairman Deborah Hersman requesting safety upgrades to existing DOT-111 rail cars.

On January 15th, 2014, Representative Corrinne Brown (D-FL) wrote a letter to Jeff Denham (R-CA), who is Chairman of the Railroads, Pipelines and Hazardous Wastes Congressional Subcommittee, requesting a hearing be held regarding rail safety.  In her letter she mentions that several members of the Subcommittee have already written letters requesting a hearing on rail safety as far back as August 2013.  Brown wrote:

“Again, we urge the subcommittee to hold a hearing immediately on rail safety.  We believe the hearing should, at a minimum, include representatives from the NTSB, FRA, PHMSA, the rail industry, and rail labor.  Thank you in advance for consideration of this request.”

Additionally, there are concerned elected officials across the country who have requested action on rail safety. Even Rahm Emanuel, former White House Chief of Staff and current Mayor of Chicago has joined the chorus of people requesting improved rail safety.

Last week, the PHMSA released the first results regarding the testing of Bakken Crude. This testing began in November 2013 and is one of the few changes that have been made since the explosion in Lac-Megantic. The results were not good as over 50% of the samples taken were found to be improperly classified. The offenders paid fines ranging from $12,000 to $51,530.

Keystone XL ‘Black Snake’ Pipeline to Face ‘Epic’ Opposition from Native American Alliance

A Native American alliance is forming to block construction of TransCanada’s proposed Keystone XL pipeline which still needs final approval from U.S. President Barack Obama after the State Department released an environmental report indicating the project wouldn’t have a significant impact Alberta tar sands production.

Members from the seven tribes of the Lakota Nation, along with tribal members and tribes in Idaho, Oklahoma, Montana, Nebraska and Oregon, have been preparing to stop construction of the 1,400 kilometre pipeline which is slated to run, on the U.S. side, from Morgan, Mon., to Steel City, Neb., and pump 830,000 barrels per day from Alberta’s tar sands. The pipeline would originate in Hardisty, Alta.

“It poses a threat to our sacred water and the product is coming from the tar sands and our tribes oppose the tar sands mining,” said Deborah White Plume, of the Oglala Sioux Tribe, which is part of the Lakota Nation in South Dakota. “All of our tribes have taken action to oppose the Keystone XL pipeline.”

The U.S. State Department released its long awaited environmental report on TransCanada’s proposed pipeline Friday. The report found that the pipeline’s operation would not have a major impact on Alberta tar sands production which is also at the mercy of market forces.

“Approval or denial of any one crude oil transport project, including the proposed project, is unlikely to significantly impact the rate of extraction in the oil sands or the continued demand for heavy crude oil at refineries in the United States based on expected oil prices, oil sand supply costs, transport costs and supply-demand scenarios,” said the report.

The project will now go into a final phase which focuses on whether Keystone XL “serves the national interest.” Pipeline’s environmental, cultural and economic impacts will be weighed in this phase and at least eight agencies will have input on the outcome, including the Department Defence, Justice, Interior, Commerce, Transportation, Energy, Homeland Security and the Environmental Protection Agency.
