A Practical Guide for Resisting the Trump De-Regulatory Agenda

This guide is a project of Save EPA, an all-volunteer organization based in Colorado and made up of former employees of the U.S. Environmental Protection Agency. We have expertise in environmental science, law and policy. We are using our collective expertise to educate and advocate about environmental science, environmental protections and the Trump Administration’s assault on EPA and our public health.

As former staffers who helped develop, issue and enforce standards for clean air, water and land and a safe climate, we are gravely concerned that the Administration’ s attempt to broadly roll back regulations could deprive our country and planet of critically important protections for years to come. As this guide explains, putting standards and other protections in place entails a long, careful, information-laden process. Repealing protections that will need to be replaced will take years that we have do not have to waste.

We have written this guide to be useful in countering attempts to roll back public protections issued by any federal agency. EPA is responsible for protecting the public and environment from pollution, and other federal agencies are responsible for protecting workers, consumers, patients, students, and other important segments of our society. Together, federal agencies have been charged by Congress to work on behalf of the American people through laws that Congress has passed to help make our nation a safe, secure, fair and productive place to live, work, learn and play.

We were inspired to write this guide by the Indivisible Guide written by former congressional staffers to provide insight and advice about how to “make Congress listen” to concerns about the Trump Administration agenda (www.indivisibleguide.com). We reference the Indivisible Guide and follow some of its organization and phrasing, but we and our guide are independent of the Indivisible organization. Rising from the ashes, a Buffalo suburb ends its dependence on coal

Sixteen months ago, the coal-fired Huntley Generating Station, which sits on the banks of the Niagara River, stopped producing power for first time since World War I.

Erie County lost its largest air and water polluter. But the town of Tonawanda, a working class Buffalo suburb 13 miles downstream of America’s most storied waterfalls, also lost its biggest taxpayer.

The impact of Huntley’s decade-long slowdown — and finally shutdown — hit this upstate New York community like a punch to the gut.

In just five years, between 2008 and 2012, Huntley’s pre-tax earnings tumbled by $113 million as it operated far below capacity, translating into a combined revenue hit of at least $6.2 million to the town, county, and local school district. That precipitous decline came when state education funds were also shrinking. Belt-tightening wasn’t enough; 140 teachers lost their jobs. Three elementary schools and one middle school closed their doors.

Rebecca Newberry, a 35-year-old former bartender and LGBT-rights activist, saw her home town facing the same fate that has befallen so many other Rust Belt communities that fell on hard times following an industrial exodus. She was determined not to let it happen to the place where she grew up. And she was fortunate enough to find a diverse group of allies who were willing to fight for their survival.

By combining the resources of her nonprofit, the Clean Air Coalition of Western New York, with area labor unions and other community groups, Newberry helped to hatch a plan for Tonawanda’s next chapter — and provide an inclusive, equitable template for other blue-collar towns facing the loss of dirty energy jobs and other polluting industries. (The jargony term for this in advocacy circles is “just transitions.”)

Driscoll’s Boycott Movement Continues and Grows

This is a friendly reminder from your comrades at the Good Earth Workers Union that the call to boycott the multi-national corporation known as Driscoll’s Berries is still ongoing.

You may recall that last year, about 400 farmworkers organized as FUJ in Washington state fought for a contract in their struggle for higher wages and better working conditions. Despite their successful and hard-won fight, berry pickers and other agricultural workers face severely worse working conditions in the Mexican state of Baja California.

At least 60,000 workers are represented by the National Independent Democratic Union of Agricultural Workers (SINDJA). Our brothers and sisters in Mexico have been facing fierce repression for their organizing efforts in the region over the last several years. Many of them work at farms in the San Quintin region that are contracted through Driscoll’s Berries.

Don’t be fooled by the “Fair Trade” sticker they slap on the clamshell packages: Driscoll’s is complicit with a corrupt state that uses violence to crush labor movements. The next time you need to visit a grocery store, don’t just boycott the berries; ask to talk to the produce department about the ongoing movement. Any store that sees value in selling organic or fair trade products should heed this call to action.

Juan Cruz Ferre (JCF): There is overwhelming evidence that demonstrates how anthropogenic climate change is out of control and will lead to global environmental catastrophe – without a major overhaul of energy production. In the February 2017 issue of the Monthly Review, you point out that although we have been presented with precise and indisputable estimations, science and social science institutions have failed to come up with effective solutions. Why do you think this is the case?

John Bellamy Foster (JBF): We are in an emergency situation in the Anthropocene epoch in which the disruption of the Earth system, particularly the climate, is threatening the planet as a place of human habitation. However, our political-economic system, capitalism, is geared primarily to the accumulation of capital, which prevents us from addressing this enormous challenge and accelerates the destruction. Natural scientists have done an excellent and courageous job of sounding the alarm on the enormous dangers of the continuation of business as usual with respect to carbon emissions and other planetary boundaries. But mainstream social science as it exists today has almost completely internalized capitalist ideology; so much so that conventional social scientists are completely unable to address the problem on the scale and in the historical terms that are necessary. They are accustomed to the view that society long ago “conquered” nature and that social science concerns only people-people relations, never people-nature relations. This feeds a denialism where Earth system-scale problems are concerned. Those mainstream social scientists who do address environmental issues more often than not do so as if we are dealing with fairly normal conditions, and not a planetary emergency, not a no-analogue situation.

There can be no gradualist, ecomodernist answer to the dire ecological problems we face, because when looking at the human effect on the planet there is nothing gradual about it; it is a Great Acceleration and a rift in the Earth system. The problem is rising exponentially, while worsening even faster than that would suggest, because we are in the process of crossing all sorts critical thresholds and facing a bewildering number of tipping points.

JCF: If conversion to renewable energy could halt or reverse the march of environmental crisis, why aren’t we moving in that direction at the right pace?

JBF: The short answer is “profits.” The long answer goes something like this: There are two major barriers: (1) vested interests that are tied into the fossil-fuel financial complex, and (2) the higher rate of profitability in the economy to be obtained from the fossil-fuel economy. It is not just a question of energy return on energy investment. The fossil-fuel infrastructure already exists, giving fossil fuels a decisive advantage in terms of profitability and capital accumulation over alternative energy. Any alternative energy system requires that a whole new energy infrastructure be built up practically from scratch before it can really compete. There are also far greater subsidies for fossil fuels. And fossil fuels represent, in capitalist accounting, a kind of “free gift” of nature to capital, more so than even solar power.

Interrogating digital capitalism

The ways that capitalism uses technology as a means of control was discussed on Thursday evening in London, at a meeting organised by the Breaking the Frame collective.

The meeting was called “Interrogating Digital Capitalism”. Ursula Huws, who researches technology and labour at the University of Hertfordshire, started her talk by arguing that terms such as “digital capitalism” and “biocapitalism” are unhelpful. “I prefer to talk about capitalism”, she said.

Capitalism uses technology at each stage of its restructuring, after recurrent crises, Huws argued. She pointed to three main ways that it uses technology for social control.

  • Technology is used to “simplify and standardise work processes” and sometimes – but not always – to substitute for labour.
  • Technologies are used to control work processes, and for surveillance.
  • Technologies are used to “create new commodities, bringing new areas of human activity into alienated, commodified relationships”. This included the “formalisation of the  information economy” and the “commodification of domestic labour”.

Huws talked about the role of internet-based employment platforms in the “gig” economy. With her colleague Simon Joyce, she last year published research suggesting that up to 5 million people in the UK have been pulled into the “gig economy”.

In a recent article about Uber introducing driverless cars in Pittsburgh, USA, Huws argued that “this kind of restructuring tends to create new jobs, even as it destroys others. Driverless cars may do to professional drivers what washing machines did to laundry workers. But capitalism, disruptive as ever, carries on as usual.”

Huws argued at the meeting that those hired via sites such as Freelancer, Upwork or Clickworker – often to do work conducted in isolated settings such as window cleaning or other domestic tasks – will find it harder to organise collectively than the Uber drivers. who have played a front-line role in worker organisation of precarious workers.

Richard Hall of De Montfort university spoke about the Cybernetic Hypothesis, published by the French collective Tiqqun in the mid 1990s. (An English translation of the document is here.)

Richard argued that cybernetics is “a systemic, structural and secular response to the issue of maintaining stable forms of accumulation and avoiding crisis inside capitalism”. (He has put notes from his talk on his blog.) He quoted Tiqqun’s assertion that cybernetics is “the tool by which capitalism has adjusted its capacity for disintegration and its quest after profit to one another”.

During discussion, Bob Hughes – whose book The Bleeding Edge, on technology and inequality, was published last year – argued that a critique of technology needed to acknowledge not only the dangers inherent in its use by capitalism, but also its potentialities for socialism and for human development.

How many more have to die?

July 6th this year marks four years since a runaway train carrying volatile Bakken crude crashed and burned in the small town of Lac-Mégantic, Quebec, killing 47 and destroying half the town. It’s time to recommit to making sure tragedies like this don’t happen again. It’s also the right time to speak up against the criminal trial beginning September 11th this year, that unfairly and inaccurately hangs the Lac-Mégantic crash on two railroad workers, Tom Harding and Richard Labrie.

Railroad managers push hard to squeeze every dollar they can out of every train run. The Lac-Mégantic train had a dangerous cargo, overlong train, defective equipment, a single crew-member and work rules that cut the margin of safety down to just about zero. The result was a disaster that still impacts the Lac-Mégantic community.

Multiple government safety investigations and independent journalists looked at what happened in Lac-Mégantic and came to the same conclusion. Railroad management policies made this kind of runaway train crash likely to happen sooner or later. Lax government oversight looked the other way until it did.

You would think that four years later there would be stronger safety regulations on every railroad, with extra layers of protection for dangerous cargo. Sadly, this is not the case. Railroad policymakers are still cutting corners and government regulators are still looking the other way. They want people to believe that the big safety problem is a few careless railroad workers.  But in Lac-Mégantic, SINCE the wreck, the supposedly safely restored wreck curve has now deteriorated and keeps that community at risk.  Everyone there tightens up when a train passes now.

Even after all the reports and exposes, the Canadian and Quebec governments are still not going after the railroad policy makers and their unsafe policies. The managers who made the critical policies will not even get a slap on the wrist. That’s just wrong, and it guarantees that the danger continues. Every year since the crash, the number of reported runaway trains in Canada has increased. That’s a sign of a reckless culture, not the actions of two rail-road workers one night in Quebec.

Whether your main issue is the environment, community safety, rail safety, or worker’s rights, it comes down to stronger government regulations and stronger railroad safety policies, with real community and labor enforcement. The two railroad workers were not the cause of the Lac-Mégantic crash or any of the runaway trains since then. They are not the ones still running trains right through the town of Lac-Mégantic, ignoring the demands of the survivors for a simple rail bypass. The people in Lac-Mégantic know that sending Harding and Labrie to prison won’t address any of their problems with the railroad. But if that happens, you can bet the government will close the book as the official verdict on Lac-Mégantic and railroad management will be standing there with them.

When you hold public commemorations this year, we ask you to make this point your way. Blaming Harding and Labrie for the Lac-Mégantic tragedy weakens all of us and all our causes. So all of us have to speak up.

Against Our Own Best Interest: Why Working People Shouldn’t Elect Businessmen Into Office

In my experiences, I’ve run across many people who believe business executives are a good choice to be our lawmakers. Many of these same people also complain about the poor treatment of employees and off-shoring of manufacturing jobs, decisions that are often made by business executives.  So why exactly do people elect them into public office?

After getting into a variety of debates, I’ve found many people’s logic can be summed up in this statement, “Business leaders are smart people and hard workers who know how to make the right decisions to build companies from the ground up. They are good employers and will use their expertise to fix our government and provide more and better jobs.” If these were the businessmen and women that actually made it into office, I might consider the notion, but this is rarely the case.

Rural conservatives have a strange admiration for business executives as being job creators. Yet, these are the same people who make the big company decisions like downsizing, placing freezes on pay increases, reducing healthcare benefits while increasing employee insurance premium contributions, requring mandatory overtime, all while giving the green light for human resources to treat everyone like a literal resource—or as a threat if they have been harassed or injured in the workplace. Business executives loyalty is always to the stockholders and other investors. They are legally bound to make a profit. If this means eliminating labor overhead, they do.

Our national business culture breeds a superiority complex among corporate executives, making it difficult for them to be kind to their laborers. The free market mandates competition, which good or bad, results in a survival of the fittest mentality that ends up in a quest for the cheapest sources of both labor and materials (like coal). This is the mentality that drives people beyond having a conscious when it comes to the average laborer. For some well-to-do business leaders, it translates into the divine right to take a massive dump on anyone beneath them because, after all, “It’s just business.”

People also seem to forget the golden rule of business that allowed many of our now elected officials to make their fortunes—”It takes money to make money.” The majority of the super wealthy who own the majority of businesses, did not come by their fortunes through a rags to riches story. It came from prior wealth inherited from their predecessors.  They have never had to work hard just to survive and provide for their families. They have no understanding of the people who work for them, and therefore, no reason to care about them.

The reversal of privatization and an urban coming of age

A gentle revolution is underway in Barcelona, Spain. Until recently, prevailing wisdom has been that efficient, quality and cheap services are best provided by handing everything over to the private sector. These days are gone. From energy supply to kindergartens to funeral services, the municipality is providing more and more of the basic needs of its citizens at affordable and transparent prices. Following a city council motion in December 2016, Barcelona is now aiming to municipalize its water service. Since the progressive coalition Barcelona en Comú gained power in the Catalan capital, the city has introduced a wide-ranging policy of remunicipalizing outsourced public services and creating new ones.

Barcelona is not unique in this respect. Thousands of public officials, workers, unions and social movements are working to create effective public services that address the basic needs of people and respond to social, environmental and climate challenges. They do this most often at the local level. Reclaiming Public Services, a new report, found that there have been at least 835 examples of (re)municipalization of public services worldwide in recent years, involving more than 1,600 cities in 45 countries.

Cities and towns around the world are following different models of public ownership, with citizens and workers involved in a variety of ways. People are moving away from private options and developing new, public ways to deliver services. Far from being an anomaly, bringing services like transport, health care and energy back under public control is a worldwide trend -- and one that makes sense.

Privatization has been given ample chance to succeed and has come up short. The persistent myth that public services are by nature more expensive, inefficient and outdated, and that we, as citizens and users, should resign ourselves to paying ever higher tariffs for ever lower standards has not yet abated. Nor has the idea that service workers have no choice but to accept ever more degraded conditions. Because everything is seen to have a price, many politicians have lost sight of the common good, while "taxpayers" are sometimes only interested in their own individual pursuits.

The remunicipalization movement tells a very different story. While it is still in its infancy in Canada, the remunicipalization movement in Europe can be seen as a response to austerity policies and is being carried forward by an increasingly diverse array of politicians. Successful (re)municipalization experiences inspire and empower other local authorities to follow suit. We see it in the way municipalities and citizens have joined forces in Germany to push for energy democracy. In France and Catalonia, networks of public water operators pool resources and expertise, working together to deal with the challenges of remunicipalization.

There are many examples from outside Europe too. In India, the city of Delhi began the process of delivering affordable primary public health care in 2015 by setting up 1,000 Mohalla (community) clinics in 2015. Since then more than 2.6 million of its poorest residents have received free quality services.

These locally rooted changes are providing improved services as well as savings for local authorities and the public. The Nottingham City Council in the U.K., for example, decided to set up a new energy supply company in 2015 after finding that many low-income families in the city were struggling to pay their gas and electricity bills. Robin Hood Energy offers a cheaper service than private providers because it neither extracts profits nor confuses customers with complicated pricing schemes. The company, which offers the lowest energy prices in the country, has the motto: "No private shareholders. No director bonuses. Just clear transparent pricing." They have also formed partnerships with other major cities. In 2016, the city of Leeds set up the White Rose Energy municipal company to promote simple no-profit tariffs throughout the Yorkshire and Humberside regions. In 2017, the cities of Bradford and Doncaster agreed to join the White Rose/Robin Hood partnership. Meanwhile, campaigners with Switched on London are pushing their city to set up a not-for-profit energy company with genuine citizen participation. The motivations in these diverse cities are similar: young municipal companies can simultaneously beat energy poverty and play a key role in achieving a just and renewable energy transition.
