An Arresting Experience: Doing direct action at BNSF Delta Yard

Following is the story of why I and four others engaged in an act of civil resistance at BNSF Delta Yard in Everett, Washington September 2.  The act was intended to draw attention to a Petition for Redress of Grievances Inflicted by Fossil Fuels.  Please sign our petition here

I am a veteran climate activist.  I have written about the climate crisis for over 25 years and for most of the last 15 worked full-time to advance climate solutions.  I have spent a lot of time trying to stop global warming sitting in front of a computer.  On September 2, 2014 it was time to sit in front of a train. 

Five of us attached ourselves to a tripod made of three 18-foot steel poles erected across a train track at Delta Junction, the north end of BNSF’s Everett Delta staging yard.  I locked myself at the foot of one of the poles.  School teachers Liz Spoerri and Jackie Minshew and coffee shop owner Mike Lapointe fastened themselves to the others. Abby Brockway, a house painter and artist, ascended to perch at the top.

Our banner, “Cut Oil Trains, Not Conductors,” expressed solidarity with railroad workers fighting against dangerous, single-person train crews.  During the day the action drew numerous supporting honks from truckers driving across the bridge above.

Around 150 yards to the south an orange BNSF engine was linked at the head of a black mile-long snake of tanker cars filled with North Dakota Bakken shale oil.  This is the same extraordinarily unstable crude that on July 6, 2013 leveled several city blocks and incinerated 47 people at Lac-Megantic on the Quebec-Maine border.  That exploded in fireballs after derailments October 19, 2013 in Edmonton, Alberta and November 8, 2013 in Aliceville, Alabama. A derailment and fire December 30, 2013 in Casselton, North Dakota erupted in a toxic plume that forced evacuations in a five-mile radius.  Another Bakken train derailed and was engulfed in flames January 7, 2014 in Plaster Rock, New Brunswick.

Every week oil trains each carrying up to three million gallons of volatile Bakken crude trundle through Seattle 8 to 13 times and Washington up to 19 times, according to BNSF’s own figures. Sightline's Eric de Place reports that oil unit train traffic through Washington has risen from essentially zero in August 2012 to an average of 2.6 trains a day. They run past stadiums and heavily populated neighborhoods, and through tunnels underneath Seattle and Everett.  Just this July 24 a nearly 100-tanker train derailed beneath the Magnolia Bridge in Seattle.  Fortunately no toxic fireball . . . this time.

The Energy "Reform" Scam in Mexico

IN MID-August, Mexico's Senate approved several amendments to the country's Constitution that opened the door to the privatization of Mexico's vast energy sector.

The U.S. business and political elite has been pressuring Mexico for energy privatization for years. Building on efforts by Mexico's rulers for decades, President Enrique Peña Nieto and ruling Institutional Revolutionary Party (PRI) prepared the way for the "reform" with two years of attacks on teachers, social movements and unions.

The new law represents a nail in the coffin for one of the most important social gains of the Mexican Revolution of 1910-17--a constitution that enshrined state ownership of mineral rights. This is a complete surrender of Mexico's energy sovereignty, secured in 1938, when President Lázaro Cárdenas nationalized the oil industry.

The privatization will give way to a speculative frenzy that will only benefit the U.S. government's geostrategic interests, while lining the pockets of global energy corporations and Mexican capitalists alike. Meanwhile, workers will pay the price--both the country's poor and working class as a whole when the energy sector is increasingly opened up to international and domestic private capital, and workers at currently state-run companies.

These fears were the backdrop to last fall's militant strike movement by Mexico teachers. Over a period of 20 years, dozens of unions have been smashed and their members' jobs liquidated due to privatization schemes--including some 40,000 workers in the Mexican Electrical Workers Union (SME) who lost a fight to save the public electrical utility in Mexico City.

Foes of Keystone to challenge SD permitting

As TransCanada seeks to re-certify permits in South Dakota to build its Keystone XL pipeline, opponents are vowing to renew the fight against the project.

In a press release issued Friday, Dakota Rural Action, a group that advocates for agriculture and conservation issues, announced it would contest the permit proceedings.

Paul Seamans, chairman of Dakota Rural Action and an owner of land crossed by the proposed pipeline route, said in a statement that TransCanada's permits, which lapsed in June, were first granted by South Dakota's Public Utilities Commission in 2010 under the premise that the pipeline would bolster US oil supplies.

“The shale oil revolution in the U.S. during the last six years has precluded any need for importation of tarsands crude from Canada for domestic use,” he said.

Dakota Rural Action said that it anticipates multiple parties will contest TransCanada's re-certification.

“While TransCanada would have everyone believe that certification will be a simple matter of submitting their application to the PUC,” Seamans said. “Dakota Rural Action members and landowners feel otherwise and will be contesting the need for the KXL and fully expects the PUC to hold extended hearings on the permit."

Conflicting messages about conflict: the “battle” against Enbridge

With the federal government’s approval of the Enbridge Northern Gateway pipeline on June 17, 2014, there arose a chorus of angry disapproval from many people in BC. Some talked about waging a “war against Enbridge,” while others proclaimed the beginning of the “battle.” Predictably, the political parties opposed to the Conservative government promised to put a stop to Enbridge, if elected. Those who have worked to oppose Enbridge over the past 5 years renewed their pledges to carry out court cases, referendums, voting campaigns, as well as civil disobedience.

In fact, the “Hold the Wall” campaign initiated by the Yinka Dene Alliance claims that over 22,000 people have pledged to do just that, “using all lawful means.” But what if a court decides its unlawful to “hold the wall”? Those with perhaps the most realistic grasp of the situation have renewed their calls for direct action, if and when necessary, to physically stop the construction of the pipelines.

Many people are talking about the necessity for direct action. Direct action is one of those terms used by so many different groups, in so many different ways, that its real meaning has become blurred.

Direct action means taking action to directly stop, delay or disrupt an activity. Here are some basic examples:

  • A road block against logging trucks, and which effectively stops logging from occurring, is a form of direct action.
  • A protest in a city street against logging is not a form of direct action, unless that protest manages to disrupt the offices of the logging corporation, for example.
  • A banner drop is not a form of direct action, unless the banner disrupts or delays some type of activity.
  • Standing on the side of a road with picket signs is not direct action, but standing in the road and blocking industrial machinery from reaching its destination is.

Journalist sues Utah tar sands refinery for illegal "terrorism" police detention

SALT LAKE CITY--An award-winning independent journalist filed a lawsuit Wednesday against Tesoro and the Salt Lake City Police Department for illegally detaining him and accusing him of terrorism for taking photographs of a refinery. 

Jesse Fruhwirth posted a video on the Internet of December 16, 2013, when an ice storm and power outage prompted a major pollution event at Tesoro's tar sands refinery in the Rose Park neighborhood.

"I was in bed reading and through my window suddenly I could see that the night sky was ablaze as if all of Rose Park was on fire," says Fruhwirth. "Only the refinery was on fire, but I knew that such huge flare offs were extra dangerous events for babies, old people and sick people and I thought it was important to film the fire that might severely sicken or kill some of my neighbors that night."

Fruhwirth also filmed the interaction he had with a police officer who ordered him to stop filming. In the video, Salt Lake officer Yvette Zayas tells Fruhwirth that she detained him for taking pictures of "critical infrastructure,” that she would refer her report to a "Joint Terrorism Task Force" to protect "homeland security."

Zayas is simultaneously a paid employee of Tesoro and SLCPD, but that night she was working directly on Tesoro's payroll.

Seattle Activists Mount Tripod: Stop Exploding Oil Trains

Five residents of Seattle and Everett, WA, working with Rising Tide Seattle, have stopped work at a Burlington Northern Santa-Fe Rail Yard in Everett by erecting a tripod-structure on the outbound railroad tracks, directly in front of a mile-long oil train. Follow Rising Tide Seattle for live updates on Facebook and Twitter.

Seattle resident Abby Brockway – a small business owner, and mother – is suspended from the structure 18 feet above the tracks while four other residents are locked to the legs the tripod. The group is demanding an immediate halt to all shipments of fossil fuels through the Northwest and calling on Governor Inslee to reject permits for all new fossil fuel projects in Washington, including proposed coal and oil terminals.

“People in the Pacific Northwest are forming a thin green line that will keep oil, coal and gas in the ground,” said Brockway, “Just one of these proposed terminals would process enough carbon to push us past the global warming tipping point – we won’t let that happen.”

Today’s protest has shut down work at BNSF’s Delta Rail Yard in Everett. With the increase of fossil fuel transport in recent years the yard has become a crucial staging ground for coal trains headed to Canadian export terminals and oil trains bound for Washington refineries. An oil-train carrying explosive bakken crude oil sat stalled while the protest continued.

“Exploding oil-trains running through my town are just a reminder of how out of control the fossil fuel industry really is,” said Jackie Minchew an Everett resident and retired educator locked to one of the tripod’s poles.

In a controversial move, Burlington Northern Santa-Fe recently announced a tentative deal with Union leaders to reduce train crews from an engineer and conductor to a single engineer. The oil train that de-railed and exploded in Lac-Megantic, Quebec was crewed by a single engineer. BNSF claims that oil-trains will continue to have two person crews, but critics point out that nothing in the proposed contract binds the company to that statement. Under the proposed deal Coal Trains would be operated by a single crew-member.

“BNSF is endangering workers, communities and our environment. They should keep the conductors and lose the oil trains,” said Brockway.

The surge in oil-train traffic is already impacting other commodities like passenger rail and agricultural shipments. Farmers from the Midwest to Washington State have faced what they call “unprecedented” delays in moving Wheat and other products to West Coast ports. Amtrak service through fossil-fuel train corridors has also suffered significant disruption and officials have expressed concern that the problem will only get worse as more terminals come online.

Wrong Side of the Tracks: Why Rail is Not the Answer to the Tar Sands Market Access Problem

Tar sands pipelines face increasing resistance both in the United States and Canada. As existing pipelines reach capacity, the delay and possible cancellation of new pipelines is costing tar sands producers billions of dollars and reducing investment in the sector. The success of anti-pipeline campaigns has forced industry to look to rail in an attempt to address these losses and open new markets for their product.

The crude oil produced from the Albertan tar sands is a semi-solid substance called bitumen, rather than a liquid crude oil. Shipping bitumen by rail is more expensive than shipping it by pipeline and the added cost is a substantial challenge to the long-term viability of the tar sands industry. Despite significant evidence, market analysis, and real world experience to the contrary, some prominent institutions - including the U.S. Department of State - continue to assert that rail has the potential to replace tar sands pipeline capacity, and thus the rapid pace of tar sands development will continue regardless of whether new pipeline capacity is built or not.

Obama Opened Floodgates for Offshore Fracking in Recent Gulf of Mexico Lease

In little-noticed news arising out of a recent Gulf of Mexico offshore oil and gas lease held by the U.S. Department of Interior's Bureau of Ocean Energy Management, the floodgates have opened for Gulf offshore hydraulic fracturing (“fracking”).

With 21.6 million acres auctioned off by the Obama Administration and 433,822 acres receiving bids, some press accounts have declared BP America — of 2010 Gulf of Mexico offshore oil spill infamy — a big winner of the auction. If true, fracking and the oil and gas services companies who perform it like Halliburton, Baker Hughes and Schlumberger came in a close second.

UK Anti-Fracking Protests Get Creative

MOSCOW, August 21 (RIA Novosti) - British anti-fracking protesters are getting creative in their fight against a network of lobbying groups supported by the United Kingdom’s shale gas extraction industry.

Activists super-glued their hands to the main door of the Department for Environment, Food and Rural Affairs in Blackpool this week. Other protesters brought major traffic disruption to Swansea after blockading a new university building.

In Salford, anti-fracking campaigners hung a banner from a city bridge to remind people of the 884,000 gallons of radioactive water dumped into the Manchester Ship Canal from a single fracking operation, which was cut short because of earthquakes in the area, purportedly caused by the fracking operations.

Peaceful protests also took place in London, Manchester and Leeds.

TransCanada Faces United Front in South Dakota: Tribes and Landowners Say NO KXL

IHANKTONWAN, SOUTH DAKOTA – ­ TransCanada faces yet another hurdle in its effort to build the Keystone XL pipeline. A coalition of long­existing pipeline fighters in South Dakota have come together to extend their share division of protecting the land, the water and the peoples of the area. An alliance of Protect the Sacred Movement of the Ihanktonwan/Yankton; the Bridger Spiritual Camp, Pte Ospaye; the Lower Brule Spiritual Camp, Wiconi Un Tipi; the Rosebud Spiritual Camp, Oyate Wahacanka Woecun; Dakota Rural Action; and the Indigenous Environmental Network are launching No KXL Dakota, a united effort to fight the Keystone XL pipeline.

Before TransCanada can build within state borders, the company must certify its permit, proving it still meets the original permit conditions. The coalition is preparing to fight the permit certification at the South Dakota Public Utilities Commission, and expects the company to file for certification this year.

“Oceti Rising,” says Faith Spotted Eagle, with Protect the Sacred, “is reaffirming our sovereignty as nations and strengthening our protection of Mother Earth. Water is life, Mni Wiconi. Oceti means fire and could also represent unity between non Native and Natives in protecting their homefires.”
