Three Workers Dead in Grain Silo, Including a Child. OSHA Can Do Nothing

In what may be the largest mass casualty workplace event this year, three workers were killed after being trapped in a grain silo in Pennsylvania. The workers included a 47-year-old, a 19-year-old and a 14-year-old. A 16-year-old boy died at the same farm in March when he was trapped under a horse-drawn manure spreader that weighed more than 10 tons.

And despite the high death toll and age of the workers, neither OSHA nor the Department of Labor’s Wage and Hour division (which enforces child labor laws) can do anything about it.

The Center Daily Times reports that Andrew Beiler, 47, and his two sons — a 19-year-old and a 14-year-old whose names were not released — died of asphyxiation from “silo gas.” Apparently, “One of Beiler’s sons was working in the silo when his father checked on him, Michael said, citing first responder reports. The eldest Beiler jumped in to help, but was overcome by the gas. His second son followed, but was also overcome.”

Rescuers dying when trying to rescue the original victims is not uncommon in confined space or trenching incidents. Before OSHA’s confined space standard was issued in 1993, more rescuers died in confined spaces than initial victims.

Grain silos are well known death traps that kill dozens of workers, often children, every year. When grain gets stuck, workers often go in at the top of a silo to loosen the grain or “walk it down.” But when the grain starts flowing, it can suck the worker down like quick sand causing suffocation. Often multiple workers die when others go into the grain in an attempt to rescue the first victim. Although there has been no investigation yet, these deaths are currently being blamed on “silo gas” (usually carbon dioxide or nitrogen dioxide) which forms when grain decomposes and can result in a person collapsing and dying within minutes, either due to oxygen displacement or toxicity.

OSHA’s grain handling standard requires employers to protect workers by training them, stop the conveyor system that moves grain at the bottom of the silo, use safety harnesses and provide a trained observer to respond to trouble. The standard also requires the air to be tested before entry and that the silo be ventilated.

Right now there is a new threat to environmental protection. A recently leaked draft bill text – bearing the watermark of the American Petroleum Institute – would override the National Environmental Policy Act (NEPA) by accelerating permitting review and timelines for energy development projects. West Virginia Senator Joe Manchin and Senate Majority Leader Chuck Schumer are now planning to attach these requirements to a “must-pass” federal budget resolution.

The deal would likely undermine the National Environmental Policy Act (NEPA), the fundamental law protecting the US environment, which was passed almost unanimously by Congress half-a-century ago. It is expected to greatly shorten the time available to consider whether projects should be given permits for fossil fuel infrastructure – meaning that our local communities simply won’t have time to make effective arguments to pipelines, wells, and other projects that may damage their environment forever.

Exposed and at Risk: Opportunities to Strengthen Enforcement of Pesticide Regulations for Farmworker Safety

THE USE OF PESTICIDES IS UBIQUITOUS IN OUR FOOD SYSTEM. In the United States, approximately 1 billion pounds of pesticides are applied annually across sectors. Nearly 90 percent of conventional pesticides are applied in the agricultural sector. As a result, farmworkers are routinely exposed at unusually high rates to chemicals that pose substantial risk to human health and safety. These risks are exacerbated by insufficient worker training and frequent improper handling and application.

Vermont Law and Graduate School’s Center for Agriculture and Food Systems released a report in 2021 entitled Essentially Unprotected, which contains a detailed overview of the landscape of pesticide laws at the federal and state level. As demonstrated in the report, there are still key gaps in existing law to sufficiently protect farmworkers. Given these significant gaps, it is particularly alarming that compliance with current protections appears woefully low. The failure to adequately enforce pesticide laws leaves farmworkers unprotected and at continued risk of injury and illness.

The system of pesticide law enforcement is complex and varies widely between states. This report seeks to explain some of the nuance reflected in the regulatory structure of enforcement while highlighting recommendations for consistency and improved health and safety outcomes. However, it is essential to note that poor compliance and enforcement are symptomatic of other issues, many of which plague farmworkers beyond pesticide exposure. For example, enforcement is considerably affected by workers underreporting exposure incidents and suspected violations due to fear of retaliation by their employers.

Many farmworkers are undocumented or on an H-2A guestworker visa and thus face fears of deportation or blacklisting if they speak out against employer abuse. Additionally, farmworkers often do not have access or resources to seek out medical attention after exposure. If they do, doctors may not be aware that their symptoms indicate pesticide poisoning or may not know how and to whom to report the incident. Even when doctors can draw the connection, not all states require that doctors notify health authorities or the state agency responsible for enforcement.e, enforcement is considerably affected by workers underreporting exposure incidents and suspected violations due to fear of retaliation by their employers.

Climate Change Is About to Cause a Viral Explosion

As climate change disrupts migration patterns, animals and the viruses they carry will come into unusual contact with each other — and inevitably with humans, unleashing new pandemics. The only thing that can stop this unfolding nightmare is a mass movement.

When animals migrate, be they butterfly kaleidoscopes or elk herds or bat cauldrons, they do so in response to ecological cues, which guide the manner and extent of the migration process. As climate change disrupts those cues, so too will it disrupt the migration of animals.

Climate change will thus deal a horrible blow to butterflies, bats, elk, and all manner of migratory animals. That’s tragic enough, but it gets worse: according to a recent study in Nature, this disruption will result in unusual interspecies contact, which will in turn cause new transmissions and mutations of viruses.

Through extensive modeling work, the study’s authors show that climate change will lead to altered migration patterns for thousands of animals, resulting in close to fifteen thousand new interspecies viral transmission events by the year 2070. In addition to having a massive ecological impact on the global fauna, this trend is of critical public health importance to us as humans, given that the majority of emerging infectious disease threats are zoonotic (transmitted by animal-to-human contact) in origin. The authors are cautious about predicting the probability of zoonoses into humans, but predict that geographies that are densely populated with humans will be future hot spots for interspecies viral transmission.

The study’s findings suggest that we are on the precipice of this mass-scale viral transmission event. The authors predict that the majority of these transmission events will happen between 2011 and 2040, indicating that many of them may already be taking place. While keeping temperature increases to within or below 2 degrees Celsius is a necessary goal, the authors predict that the accomplishment of this goal itself will not result in reduced viral sharing. In short, we’re probably stuck with massive changes in animal migration and vast quantities of viral transmission even if we slow climate change. However, there are other interventions we can make to stop the worst from happening.

In their model, the authors rely on a variety of land use scenarios — including alterations in deforestation, agricultural land usage, and human settlements — due to the uncertainty of how land is going to be used over the next fifty years. But none of that is inevitable. We can ensure that our land usage mitigates the impacts of climate change and prevents the emergence of the next pandemic. This can only happen if we’re able to take back control over how land is used, and democratically determine the best way to use it instead of leaving the decision up to capitalist markets.

Currently, our governments are beholden to corporate interests, which means that real estate and agribusiness have outsized influence over where and how land is developed. This has led to the unmitigated proliferation of sprawling housing developments, which often push deep into important ecological niches. This trend has already directly led to the destruction of 67 percent of coastal wetlands, which play a critical role in supporting local ecosystems, flood mitigation, carbon sequestration, and erosion control. In Brazil, Jair Bolsonaro’s far-right government has facilitated the rapid destruction of the Amazon rainforest to facilitate increased agricultural land usage. The Amazon is a massive carbon sink, and its destruction could make it impossible for the rest of the world to keep global warming from rising faster than 1.5-2 degrees Celsius.

Workers, Look Out: Here Comes California’s Phony Green New Deal

California politicians never tire of touting the state’s leadership on climate issues. But how much of it is bullshit, to borrow the Anglo-Saxon technical term recently popularized by former U.S. Attorney General Bill Barr?

Some East Bay and SF DSAers got very interested when we learned that the California Air Resources Board (CARB) was holding a one-day hearing on a 228-page draft plan for California’s transition to a green future. The 2022 Scoping Plan Update, to be adopted later this year, aims to be the state’s key reference document to guide legislators and administrations in remaking the California economy over the next two decades. We turned on our bullshit detectors and prepared for the worst. CARB did not disappoint.

The state is currently committed to two major climate goals: (1) to reduce greenhouse gas emissions to 40 percent below 1990 levels by 2030 and (2) to achieve “carbon neutrality” by 2045. These are hardly adequate goals in the eyes of science-based climate activists, but California officialdom is taking them seriously, at least seriously enough to commission a state agency to map out a master plan to reach them.

And there’s the rub. Charged with the outsized responsibility of devising a roadmap to a Green California, CARB’s staff came up with a technocratic vision that caters to the powerful, seems designed to fail, and pays virtually no attention to workers whose world will be turned upside down by “rapid, far- reaching and unprecedented changes in all aspects of society” required to limit global overheating to 1.5ºC. Despite copious lip service to environmental justice, CARB’s draft also ignores the critiques and questions put forward by CARB’s own Environmental Justice Advisory Committee (EJAC), assembled to give CARB input and feedback as the state’s master plan takes shape.

“The state’s 20-year climate policy blueprint is a huge step backward for California,” commented Martha Dina Arguello, EJAC’s co-chair and executive director of Physicians for Social Responsibility-Los Angeles. “The plan on the table is grossly out of touch with the lived reality of communities that experience suffocating pollution and doubles down on fossil fuels at a time when California needs real climate solutions.” 

The idea that an air quality regulatory agency like CARB could come up with a viable plan for a societal transformation on the scale of the Industrial Revolution is absurd on its face. To do this without extensive involvement of labor would seem to doom the project entirely. Yet CARB plowed ahead without any significant input from labor. Result: the only union mentioned in CARB’s draft plan is the European Union.

We searched the draft plan in vain to see if it addressed any of the key questions from labor’s point of view:

What is the green future for California’s workers? How shall we provide for workers and communities that depend on the fossil fuel economy as major industries are phased out? What would a green economy look like, what are green jobs, how can we create enough good green jobs to meet demand, and what public investments will be required?

Instead of answering questions like these, CARB’s draft plan promotes a bevy of false solutions to reach California’s already inadequate targets. CARB’s depends on the state’s problematic cap-and-trade carbon trading scheme as well as carbon capture and storage (the favored scam of the oil industry) and hydrogen (the favored scam of the gas industry). The draft gives the nod to 33 new large or 100 new peaker gas-fired power plants. Missing: cutting petroleum refining, oil extraction, and fracking; banning new fossil fuel infrastructure; degrowing military and police budgets; and committing more resources to education, mass transit, healthcare, and housing. Instead of proposing an economy of care and repair to replace the old fossil fuel economy, CARB offers electric cars and more pipelines.

Far from providing a roadmap to a green future, CARB has come up with California capitalism’s most ambitious response yet to the radical ecosocialist Green New Deal that the world needs and we are fighting for.

Ending Federal Offshore Oil and Gas Lease Sales in Next Five-Year Program Would Have Little to No Impact on Gas Prices, Jobs, and Economy, According to New Analysis

Amid climate crisis and record gas prices, new analysis debunks oil and gas industry claims on need for new federal leasing by offering further evidence that ending new federal offshore leasing would not raise gas prices for nearly two decades, and would have virtually no net economic impact.

According to a new report out today, putting an end to new federal offshore leasing on public waters for the next five years:

  • Would result in less than a cent increase in gas prices at the pump over the next two decades
  • Would still maintain close to current levels of oil production capabilities for many years
  • Would not have the drastic impact on workers in the Gulf or the national economy that the fossil fuel industry has purported. Industry’s claims about economic impacts fail to account for the ways that energy and job markets gradually adapt and the burdensome climate costs averted from transitioning to clean energy
  • Result in between $23 billion and $365 billion dollars in climate benefits through 2040

The new report, which was supported by Earthjustice, Healthy Gulf, and Gulf Coast Center for Law & Policy (GCCLP) and published by Apogee Economics and Policy, a leader in energy production forecasts and benefit-cost assessments related to energy development, rebuts industry claims that ending leasing would significantly impact production and the economy. Instead, the report provides analysis that shows that the Biden administration can end new leases for the next five years without raising gas prices, preventing oil production, and negatively impacting jobs. The new report supports the opportunity for moving the United States away from fossil fuels and meaningfully addressing the worsening climate crisis, instead of giving into demands by the oil and gas industry to double down on decades of more carbon pollution.

For years, oil and gas development has contributed to worsening climate impacts, devastation for Gulf communities, environmental destruction, and dangerous conditions for offshore workers. Because federal offshore leasing locks in development for decades, putting an end to leasing is essential if the Biden administration is going to meet its national climate pollution and Paris Agreement targets and environmental justice commitments.

The new report comes just ahead of the release of the Interior Department’s next five-year offshore oil and gas leasing program. In the upcoming program, Interior will propose a schedule of federal offshore oil and gas lease sales for the next five years and has the option to not hold any new lease sales over that five-year period.
