Pursuing a Just and Renewable Energy System: A Positive and Progressive Permitting Vision to Unlock Resilient Renewable Energy and Empower Impacted Communities

It is indisputable that the climate emergency requires the United States to rapidly transform its majority fossil energy system to 100% clean and renewable energy.

The United Nations Intergovernmental Panel on Climate Change’s recent sixth synthesis report makes absolutely clear that an unprecedented bold transition to renewable energy with an equally aggressive effort to halt new fossil fuel development and phase out existing fossil fuel usage is absolutely vital to avoiding the most catastrophic consequences of climate change.

This necessary transformation presents a tremendous opportunity to pursue a far more just path forward—one that ends the status quo entrenchment of the fossil fuel industry; empowers federal agencies to use their authorities to accelerate the transitions to a justly sourced, justly implemented, resilient, and equitable power system; actualizes the principles of environmental justice; and preserves our core environmental laws.

This system is composed of our most commonsense and affordable solutions that can be deployed in an efficient and just manner: energy conservation, distributed and resilient renewable energy and storage, and responsibly-sited utility-scale renewables, all paired with robust community engagement and opportunities for real energy democracy.

However, both Congress and the Biden administration are failing to exercise their imaginations to embed justice in a renewable energy future.

After the passage of the Inflation Reduction Act, both Democratic and Republican Congress members have proposed numerous “permitting reform” proposals, but the majority continue to argue that achieving a fast transition to renewable energy necessarily means undermining bedrock environmental laws like the National Environmental Policy Act (NEPA).

This false logic must be interrogated. While these proposals might marginally improve the deployment of utility-scale renewable energy particularly on pristine lands, our energy needs can and must also be met with renewable energy on built surfaces that is more resilient, affordable, and respectful toward communities and wildlands.

Furthermore, any such purported gains of “permitting reform” proposals would be massively dwarfed by the emissions of fossil fuel projects that would also be expedited and result in deepening substantial environmental injustices for countless communities around the nation.

Congressional progressives, including Rep. Alexandria Ocasio-Cortez, have defended their railroad strike vote by pointing to rank-and-file support. Here, Railroad Workers United clarifies the group has always unequivocally opposed denying railworkers their right to strike.

On April 11, 2023, Jacobin published a transcript of an interview by editor at large David Sirota with Representative Alexandria Ocasio-Cortez. In the context of a general discussion about differences between the “progressive” wing of the Democratic Party and the Biden administration, the subject of the vote to break the strike of the railroad workers came up.

In defending her votes — one to approve seven days of sick leave for railworkers and one to support the president’s bill to block the strike — Ocasio-Cortez states that she was acting on the wishes of Railroad Workers United (RWU) and other groups of railroad workers. She states in the interview, “When you look after the vote, folks like RWU were saying, ‘This is what we asked them to do.” Later she says, “Because, for example, with the rail vote, the only partners that I had leading up to that were railworkers. And if that’s what they asked us to do, then that’s what we did.”

But Ocasio-Cortez is clouding the reality of the situation by referring to “the vote,” when in fact there were two separate and distinctive votes. One bill proposed seven days of paid sick time, while the other bill blocked railworkers from striking; these bills were completely independent of one another.

The Fight Against Cop City

On Saturday, March 4, I arrived at Intrenchment Creek Park in DeKalb County, Georgia, for the first day of a week of action against a $90 million construction project undertaken by the Atlanta Police Foundation—a private entity, backed by local CEOs and political leaders, that advances police interests. The foundation wants to raze eighty-five acres of public forest to build the largest police training facility in the United States, complete with a firing range, a burn building, and a “kill house” designed to mimic urban combat scenarios. It also argues that the facility will boost morale among officers. The size and scale of the project, and the destruction and deforestation it will require, have led a growing number of activists, organizers, and community members to object to what they call “Cop City.” The campaign against Cop City is simultaneously a campaign to defend the Weelaunee Forest, the name used for the area by the Muscogee Creek people forcibly displaced by settlers from the land in the early 1800s before it became the site of the notorious Atlanta Prison Farm. These elements of the campaign—the histories on which it draws, what it’s fighting against and for, who it is bringing together, and how—have given it tremendous staying power despite extraordinary odds.

Locals often describe Atlanta as “a city in a forest,” with trees and a tree canopy covering almost half of the land. The ecosystem depends on this foliage, and activists say that the deforestation required to build the facility will harm air quality, hasten climate change, and contribute to flooding in predominantly poor and working-class Black and brown communities. The proposed development will further distance residents from accessible green space while bringing toxic waste closer. But the project will do more than fracture the largest green space in Atlanta. The activists fighting against Cop City argue that police violence itself constitutes an environmental hazard, and that toxic chemicals associated with explosives that could be used on the site will destroy the air, water, and land on which myriad forms of life depend.

The week of action I attended was organized in remembrance of Tortuguita, or Manuel Esteban Paez Terán, the twenty-six-year-old nonbinary forest defender killed by Georgia State Patrol on January 18. Activists I met affectionately abbreviated their name to “Tort.” While police originally claimed self-defense, body-camera footage and two different autopsies show police shot Terán thirteen or fourteen times and suggest they were sitting cross-legged with both hands up when the police fired. Terán’s mother has since come to Atlanta from Panama to file suit against the city for records of her child’s murder, and to demand justice with a growing coalition at her side.

Terán is the first environmental activist killed by police in recent U.S. history. Their death is part of an intensifying campaign of repression waged against protesters fighting environmentally destructive developments across the country, most famously the Standing Rock encampment against the Dakota Access Pipeline (DAPL). The arrests, raids, and prosecutions evoke the Green Scare of the early 2000s, when the federal government infiltrated, surveilled, and prosecuted environmental and animal activists across the country. The recent protests, however, come at a time of greater popular recognition of the climate crisis—and the seeming futility of turning to elected officials to take climate action against the same corporations that fuel their campaigns and structure the economy.

In Atlanta, there have been three waves of arrests and at least as many forest raids since December. Sixty-eight people are facing variations on common charges brought against protesters—disorderly conduct, criminal trespass and assault, and obstruction of governmental administration. But forty-two among them face domestic terrorism charges, which carry a mandatory minimum of five years of incarceration and a maximum of thirty-five. The thin affidavits suggest the basis of the charges are affiliation with Defend the Atlanta Forest, “a group classified by the United States Department of Homeland Security as Domestic Violent Extremists.” (A DHS official told the Washington Post it never made such a classification.) Those who have been released on bond are prohibited from having contact with their codefendants or with Defend the Atlanta Forest. Multiple activists have insisted, however, that Defend the Atlanta Forest is not an organization at all: instead, it is a demand, a social media account, and a shorthand reference for a loosely affiliated group of autonomous individuals, protecting the land against encroachment and seemingly motivated by anarchist principles. This insistence is about their political commitments as much as it is a rejection of the state’s theory of criminalization.

Rail Workers Warn Safety Bill Loopholes Are Big Enough to 'Run a Freight Train Through'

"If the language is not precise, the Class 1 railroads will avoid the scope of the law without violating the law, yet again putting the safety of our members and American communities into harm's way," said one union leader.

Amid heightened national focus on railway safety in the wake of the East Palestine, Ohio disaster and other recent accidents, one railroad workers' union warned Friday that, while welcome, a bipartisan rail safety bill has "loopholes big enough to operate a 7,000-foot train through."

The Railway Safety Act of 2023—introduced earlier this week by Sens. Sherrod Brown (D-Ohio), J.D. Vance (R-Ohio), Bob Casey (D-Pa.), Marco Rubio (R-Fla.), John Fetterman(D-Pa.), and Josh Hawley (R-Mo.)—is meant to "prevent future train disasters like the derailment that devastated East Palestine."

The legislation would impose limits on freight train lengths—which in some cases currently exceed three miles. The measure was introduced a day after Democratic U.S. Reps. Ro Khanna(D-Calif.) and Chris Deluzio (D-Pa.) put forth a billthat would require the U.S. Department of Transportation (DOT) to impose stricter regulations on trains carrying hazardous materials.

"We welcome greater federal oversight and a crackdown on railroads that seem all too willing to trade safety for higher profits," Eddie Hall, national president of the Brotherhood of Locomotive Engineers and Trainmen (BLET), said in a statement.

There’s a big pot of climate bill money waiting to be seized: activists can’t miss the opportunity

The Inflation Reduction Act wasn't written for climate justice, but there’s a ton of money for organizers and movement players to access.

Yes, the Inflation Reduction Act is the most consequential piece of climate legislation in the U.S. Yes, it’s also the only federal legislation. Yes, it’s imperfect. Yes, parts of it are downright vile. Yes, the negotiations exacerbated tensions between insider green organizations and those on the frontlines. 

But let’s be real, nothing more is going to pass at the federal level in the foreseeable future. So now that the IRA is the law of the land, how do organizers and movement players work with it? 

As long-time organizers and climate justice activists, we see organizing opportunities in the roughly $390 billion in climate funding available. As an analysis from Just Solutions points out, the bill was not written for climate justice. But there’s a ton of money that suddenly we can access for poor and disenfranchised communities — and it would be a wasted opportunity to leave that money on the table.

With all its limitations, the IRA can further our campaigns if we use the opportunity.

The Democratic Party Failed Striking Warrior Met Coal Miners in Alabama

Web editor's note: the author repeats the debatable claim that working class voters have gravitated towards Trumpism and the Republican Party, but in actual fact, it's white, rural, (mostly male) residents who earn less than $70,000 US annually without college degrees that have made this shift, but such voters do not represent the majority of the working class, and many of them are not actualy working class at all, so this shift is vastly overstated. That said, the condemnation of the Democratic Party us well deserved anyway:

Political strategists seem content to cede red states to Republicans, and thereby confirm for the working people living in those states that their belief that Democrats don't really care about them is justified.

After almost two years on the picket line, the hundreds of United Mine Workers of America members who have been on strike at Warrior Met Coal in Alabama have offered to go back to work. They still do not have the fair contract they have sacrificed so much for. Their negotiations will continue, but they did not win this strike—and that is tragic. The company and its private equity owners bear the most direct responsibility for precipitating this heartless, inhuman struggle. But if you are looking for a meaningful place to focus your rage over the way that this strike has turned out, look directly at the Democratic Party.

Imagine, hypothetically, that we were living in a period of history in which inequality has soared for a half-century, thanks in large part to the decline of unions and working-class bargaining power; in which the American Dream has been hollowed out, and decades of economic gains have flowed almost exclusively to the rich; in which poorly designed free trade policies supported by Democrats have sucked middle America dry of once-abundant blue-collar jobs; in which the obvious failures of neoliberalism to rectify this situation have soured millions of once-reliable blue voters on the Democratic Party, and tempted them into a Republican Party that offers easy scapegoats for systemic problems; in which this toxic lack of opportunity paved the way for a xenophobic, lying narcissist to spend four years in the White House on the strength of racist fables about making America great again. Imagine, further, that after those dark four years, Democrats were back in power; that they had a leader who proclaimed himself the most pro-union president of our lifetimes; and that he led a party that fretted continuously about how to win back working-class voters from the clutches of Trumpism.

Then imagine that there was a long, grinding strike. By coal miners. In Alabama. Who were fighting against the predations of the sort of ultra-insulated capitalist financiers who are accelerating the inequality crisis. Imagine that walkout became the longest major strike in America, dragging on well past the point when most people would have given up, with the strikers assaulted by oppressive police and court rulings. And yet, for month after month, these workers persevered, held the line, and sacrificed greatly in order to fight for dignity and the fundamental ability for working people to be treated fairly by the faceless forces of capital.

Progressives Demand Buttigieg Act on Rail Safety Amid Toxic Ohio Disaster

The transportation secretary's refusal to fortify freight train regulations and crack down on Norfolk Southern "only signals to the railroads that this type of incident will be tolerated," said one watchdog.

Progressives are demanding that U.S. Transportation Secretary Pete Buttigieg improve rail safety regulations in response to the unfolding public health disaster in East Palestine, Ohio—the site of a recent fiery train crash and subsequent "controlled release" of toxic fumes that critics say was entirely avoidable.

"The Obama administration attempted to prevent dangerous derailments like the one in East Palestine by mandating better brake systems on freight trains," Jeff Hauser, executive director of the Revolving Door Project, said Tuesday in a statement. "But this effort was watered down thanks to corporate pressure, first by writing in many exemptions to the proposed rules and then, under [former President Donald] Trump, by repealing the requirement altogether."

Recent reporting from The Lever revealed that Buttigieg's Department of Transportation (DOT) "has no intention of reinstating or strengthening the brake rule rescinded under Trump," said Hauser. "Additionally, The Leverreports that the train was not being regulated as a high-hazard flammable train, despite it clearly being both high-hazard and flammable. These types of failures to protect the public are invited by perpetual lax enforcement and laziness toward even getting back to the too-low regulatory standards under Obama."

"Now, all eyes are on Secretary Buttigieg," he continued. "For too long he has been content to continue the legacy of his deregulatory predecessor, Elaine Chao, rather than immediately moving to reverse her legacy upon becoming secretary."

"Norfolk Southern's environmental disaster is the latest in a long string of corporate malfeasance committed right under the secretary's nose," Hauser observed, referring to the company that owns the derailed train. "As I've warned before, corporations do not respect Buttigieg as a regulator."
