The U.S. Export-Import Bank’s Dirty Dollars: U.S. tax dollars are supporting human rights, environment, and labor violations at the Sasan Coal-Fired Power Plant and Mine in India

In January and May 2014, a coalition of non-governmental organizations (NGOs), the Sierra Club, 350.org, Carbon Market Watch, Pacific Environment, and Friends of the Earth U.S. (hereafter referred to as the Fact Finding Team), undertook two field visits to Singrauli, India, to meet with communities affected by Reliance Power’s Sasan Ultra Mega Power Project (UMPP) and its associated mine to assess the project’s effect on local communities and the environment.

Since the U.S. Export-Import Bank (Ex-Im Bank) approved over $900 million in financing for the coal project in October 2010, little information has been provided by the agency about Sasan’s compliance with Ex-Im environmental, social, human rights, and corruption policies. This includes the Bank’s commitments under the Equator Principles1 and the International Finance Corporation (IFC) Performance Standards,2 the agency’s environmental, social, human rights and corruption policies, as well whether or not the project has lived up to the expectations laid out in the Environmental and Social Impact Assessment (ESIA) documents for the mine and the power plant. An apparent lack of oversight prompted the NGOs involved in this report to conduct this independent investigation. The Fact Finding Team has uncovered numerous reports of corruption and human rights and labor violations associated with the Sasan coal project, all of which have largely been ignored by the Ex- Im Bank.

Railroad Worker Jen Wallis: "The Fence is Capitalism...It's Time to Take it Down!"

Editor's note: Jen Wallis meant to give the following speech at the People's Climate March in Seattle on Sunday, September 21, 2014, but had to abbreviate it due to time constraints. Here is the entire speech she would have given:

Hi my name is Jen Wallis, and I’m a founding member of Railroad Workers United. We are a rank-and-file caucus of the various national and international railroad unions. A few of us started this organization to respond to the decades of infighting created by the carriers to keep us divided.

I've been a conductor with BNSF Railway for over ten years. In 2008, I was injured on the job through no fault of my own. I was one of the first workers to file a whistleblower suit against a major railroad for retaliation for reporting a work-related injury. After 6 years of litigation, I won my case in Federal Court this past March, so I know a little bit about what it takes to fight corporations and what they will do to you and your family. I lost much of my support system, and I lost my house to foreclosure. And just as a side note, I first met Kshama Sawant when she showed up and got arrested for those of us fighting foreclosure. She is amazing!!! Over 1,000 railroaders who filed similar complaints have lost. I’m one of a handful to have won. The railroads have a lot of money to fight you, and they usually win.

I’ve taken it upon myself to use my victory to speak out for safety on the railroad because I’m one of the few people who can and not get fired for it, and I was actually in San Francisco speaking at a labor conference this past July when I got word that a group of unelected union officials from the conductor’s union had been meeting in secret with BNSF for 18 months, and unleashed a proposal that would have ended the job of the conductor on freight trains right here in my territory. My job. One person running trains at least a mile long through our communities where there have always been at least two, and engineer and a conductor. 140 years of railroading tradition gone with one contract. All the railroads would follow that precedent.

So we at Railroad Workers United went into what I can only call DEFCON 1 organizing. We had less than a month to mount a campaign to vote no before ballots were to be sent out. There were plenty of carrots in the agreement being dangled for the huge numbers of new hires we have, with things like “worker retention board” which claimed if you can’t hold a job, we’ll pay you to sit at home and not work, ending pay scale for new hires, and huge buy-outs for those getting close to retirement anyway. It was the standard concessionary agreement. Now those of us who have been in the game long enough knew these were only empty promises. We’ve seen enough of these broken in our careers, but the massive numbers of new hires did not, and we saw what scare tactics do at places like Boeing. Unions usually don’t defeat concessionary contracts, even when those companies are swimming in profits.

We knew we had to be bold, as bold as they were. I immediately started a FB group to protest the meeting in Sea-Tac where the officers would be to give us the hard-sell pitch. Now railroaders aren’t allowed to strike, and we haven’t done much in terms of organizing anything since 1894. You won’t find many of us who have ever so much as held a sign on a picket line. So I invited people who are more comfortable with holding signs - I invited my environmentalist friends I’d been trying to build alliances with these last couple of years - people from Backbone, from 350.org, Rising Tide, and members of the more radical unions like the Teamsters and Teachers and ILWU, and they showed up for us. Jess Spear showed up for us. The media we got in Seattle from that little picket inspired towns all across the country to follow suit. In places like Greybull, Wyoming and Creston Iowa, we got the spouses and families out there holding signs, (probably for the first times in their life), because they know our jobs and how terrifying it would be to have their loved ones out on these dangerous trains by themselves working under extreme fatigue in every kind of weather. We added over 2,000 new members to our facebook group in a month, distributed thousands of stickers and flyers and talking points. Many of us put our lives on hold and spent every waking moment organizing around this.

Finally, on September 10th, less than two months after we first got wind of it, the results were in. From the Gulf Coast to the Great Lakes to right here in the Pacific Northwest, our members voted that proposal down. It was one of the proudest moments of my life. But as sweet as that victory was, none of that means anything compared to this fight against climate change. I have a 9 year-old son. I read recently that by the time he is my age, at the rate we’re going, this planet will experience a mass extinction. Extinction! And I can’t help but wonder If I’ve really done enough to protect him from that future.

Now our recent victory was a huge inspiration to all of us. We now know what we have to do, and we know what it takes to do it. We understand completely now that we are fighting an industry that cares as much about us as they do the environment, which is not at all...It might seem a little scary for environmentalists to approach labor, and sometimes the feeling is mutual, but when my co-workers saw that tripod up in Everett with the sign that said “Cut Oil Trains, Not Conductors”, they were blown away. Nobody has stood up for us in a very long time. America has what I call an epidemic of fence-straddling. Most people like to be perched up there, listening to information from both sides and occasionally hopping down from one to the other based on the news we get or the friends we know or which side has the most money or slickest campaign. But my friends, the fence is an illusion. If we could all just step back for a minute and notice that big field we’ve been in together this entire time. The fence is capitalism and corporate plutocracy, and it’s time to take it down!!!

SMART Railroad Workers Rejection of Single Employee Crews is a Victory for Workers AND the Environment

On Tuesday, September 10, 2014, the rank and file union members of the International Association of Sheet Metal, Air, Rail & Transportation Workers (SMART) General Committee GO—001 overwhelmingly voted down a concessionary proposal to reduce train crew size from 2 to 1 by a margin of 2 to 1 against the proposal.

The proposed change would have resulted in conductorless train operations over more than half of the Burlington Northern Santa Fe Railway (BNSF), the second largest rail carrier in the U.S. According to Railroad Workers United, a coalition of rank and file union members from various railroad workers' unions, this was part of a campaign by the major rail carriers to weaken the already weak and divided rail unions further. Over the past half-century, the railroad bosses have taken advantage of the craft divisions among their workers to reduce crew sizes from a standard of 5 to 2. Now they're pushing to reduce that number to 1. The fact that BNSF was able to convince the leadership of one local to go along shows just how beaten down these unions are.

Fortunately, rank and file militants--some of them dues paying members of the IWW--formed RWU to beat back just such an offensive by the bosses, and--perhaps--turn the tide in what has hitherto been a one-sided class war waged against the workers by the bosses.

The RWU strategy mixed a whole variety of tactics, both old (including "silent agitators" and graffiti) and new (social media), many of them pioneered by the IWW:

Upon learning of the BNSF TA, RWU convened an “emergency meeting” of the Steering Committee and instantly mobilized the network. Thousands of buttons and sticker, flyers and leaflets, “Talking Points” and more were disseminated to BNSF railroad workers in the following weeks. A press release was issued that was picked up by a number of newspapers. RWU members spoke out on radio and TV stations, and organized rallies, pickets and demonstrations at numerous terminals, from large cities like Chicago and Seattle to small towns like Creston, Iowa. RWU members intervened in the debate at the SMART Convention in August, and held a series of telephone conference calls open to all railroad workers to voice their concerns, ask questions, and devise strategies and tactics. A regular e-newsletter with the latest flyers, leaflets, stickers, articles, songs, graffiti and cartoons were issued weekly.

In the end, the workers beat back the bosses attack, and this campaign should provide (the beginnings, at least, of) a model for rank and file workers in business unions to overcome entrenched bureaucratic interests that serve the bosses and not the workers. It can also serve as a model for the IWW's "dual card" strategy.

The vote was also a small victory for the environment and efforts to build bridges between environmental activists and workers. As has been widely reported, the accident that blew up Lac Magentic was the result of a single employee train, and while derailments involving two employee crude-by-rail trains have occurred, the chances of them happening are substantially greater if the crew size were to be reduced to one. Further, the push to reduce crew sizes is part of the ongoing efforts by the rail carriers to maximize their profits by cutting corners on labor costs, safety procedures, and best practices. The workers' victory will likely embolden them to take stronger stands against other initiatives by the bosses that would increase the risk of accident or derailment, and should the workers gain sufficient momentum, they can actually go on the offensive and force the carriers to increase safety, which will reduce environmental impacts significantly.

Re-Identifying Environmentalism

Several people have asked me whether or not I will be attending the upcoming climate action march in New York. The answer is no. In light of my intended absence, I wanted to share with you some of my thoughts on the subject.

While I am unaware of a detailed history on environmentalism, I do know that modern environmentalism was born from naturalists and the conservation movement most often attributed to men such as John Muir, the “Father of the National Parks.” His activism preserved some of the most spectacular natural places in North America, yet, we must admit that on the whole, the creation of the national parks and all subsequent environmental protections have been miniscule wins in a full out war on the ecological systems of our planet. The results are plain to see throughout the world from global deforestation to dead zones in the oceans, rivers that change colors or catch on fire to toxic waste water ponds that are visible from space. 

Some have sought to address the underlying problems feeding the immensity of our present day version of a world war. Of those, Wendell Barry, David Orr, and Wes Jackson come to mind, each speaking volumes to the ways in which present day education, culture, and economy combine to destroy the future health and happiness of most species on this earth. As such, and I am not stating anything new here, it should come as no surprise that until we are able to bring ecological understanding into every classroom, altruistic ideals back into every community, and moderation into the economic principles of the world, we will have no chance of saving future generations from such peril. These are truths that each of us must face, a knowledge that Aldo Leopold began sharing with us long ago.  Anyone who has been within the environmental movement long enough can attest to having found themselves in an emotional dilemma:  spend time fighting inevitability or search out the best place to lead a peaceful life.

In February of 2013, I marched alongside an estimated 40,000 people through the streets of Washington DC at the Forward on Climate Rally organized by 350.org. As we marched down Constitution Ave, I recollected images and stories of a rally my father attended in Washington DC on Labor Day in 1991. The National Park Service estimated that 250,000 laborers were in attendance: coal miners, nurses, auto workers, steel workers, migrant workers, and a variety of social activists. A quarter of a million people had descended upon DC, receiving extended national news coverage (compared to the climate rally), all of them people that millions of Americans could identify with. They were trying desperately to keep labor alive, to reverse the anti-union trends that were crippling the middle class of this nation. My father was among those marching with the United Mine Workers, still unsure of what life had to offer after his recent lay off at Beth-Elkhorn's Deep Mine 26 after 16 years there.

Despite the 3,500 tour buses that brought the cries of those hundreds of thousands of people to Washington on a hot summer day, the demise of the labor movement has continued. Today more and more states are incorporating right to work laws, more people are forced to work mandatory overtime for wages that have barely increased over 20 years. As I marched along side people wielding their homemade wind turbines on that bitter February day, I kept thinking to myself,  "What makes a group of environmentalists, already ostracized by a nation as unemployed hippies, believe a march will actually garner the support needed to save the world from greed driven over consumption?"

350.ORG Seattle Opposes Single-Employee Trains

Whereas, 350 Seattle supports the use of railroads to transport mixed freight and passengers as the most environmental and less carbon intensive way of doing this; and

Whereas, a single freight train can take the load of several hundred trucks off the highway, but due to the over congestion of unit trains carrying crude petroleum products and coal forces grain producers and others to transport their products once again by trucks on the highways; and

Whereas, the number of trains carrying crude petroleum products and coal has skyrocketed and they are a lot more dangerous to railroad workers, our communities, and fragile ecosystems on land and water; and

Whereas, in the wake of the Lac Megantic tragedy and numerous other train wrecks in the last year, we have an historic opportunity to build alliances with community and railroad worker groups to outlaw single employee train crews;

Whereas, we at 350 Seattle universally support a minimum of two crew members on every train, an engineer and a conductor, for the purposes of basic railroad safety; and

Whereas, the BLET and the SMART have joined forces and have been working hand in hand to outlaw Single Employee Train Crews; and

Whereas, a rogue general committee of the SMART–TD has recently announced a tentative agreement, that would, if implemented, eliminate the road conductor on through freight and allow single employee crews;

Therefore, be it resolved, that 350 Seattle affirms our opposition to single employee train operations and that we support an engineer and a conductor on every train; and

Be it further resolved, that 350 Seattle supports HR 3040, which would mandate a conductor and engineer on every train; and

Be it further resolved, that 350 Seattle urges all rail union members to actively oppose contracts that would allow single employee operations of trains; and

Be it finally resolved, that 350 Seattle stands in solidarity with all rail road worker unions and union members who are standing up and fighting back against the tentative agreement by SMART-TD and the BNSF to eliminate the road conductor on through freight and allow single employee crews;

Adopted by the general membership of 350 Seattle on August 6th, 2014.

The State of the Environmental Movement

Recently, the Washington Post covered a 192-page study that struck to the heart of the big environmental organizations. As summarized by reporter Darryl Fears of the Post, who covers wildlife and the Chesapeake Bay, the study showed that the US's biggest environmental groups have “failed to keep pace with the nation's expanding minority populations—and remain overwhelmingly white.” Rather than going into the specifics of certain numbers in the article and the study, this article will be a reaction to what the Post wrote and my thoughts on the current state of the environmental movement.

As the article notes, the study, which was one of the first investigations “of diversity within green groups in years,” was supported financially by the Sierra Club, the National Fish and Wildlife Foundation, and Green 2.0. Through some further research I found that Green 2.0. is clearly a mainstream environmental organization since it has a working group composed of people from top environmental groups, academics, nine individuals from a lobbying and consulting group with clients including big foundations, big corporations and nonprofits (The Raben Group), governmental officials and other green activists. What about the study itself? The article talks not only about the lack of diversity in the environmental organizations, but why people of color don't join such organizations. This was part of the article I found most interesting since it noted that people of color who are employed at such organizations feel “alienated” and not welcome, while “recruitment for staff frequently occurs through word-of-mouth and informal networks...[which] makes it difficult for ethnic minorities, the working class” or anyone outside “traditional environmental networks” to know about job openings and then apply for such jobs.

This was only the first part of the article that made me realize the divide in the environmental movement. This divide is a racial one. As the article notes, during the civil rights movement, people of color joined big environmental organizations in an effort to “battle the power plants, petrochemical refineries, railroads, sewers, and other polluters operating in their communities,” but they were “unwelcome” in these organizations. Eventually, there was a summit of environmentalists who were people of color which condemned the big environmental organizations for not having diversity among their members and taking in a “lion's share of funding.” Recruiters from some of the groups responded, saying, in an almost a racist way, that “they tried to be more inclusive, but minorities lacked the education and skills needed to be effective advocates,” which implied that white advocates had the skills and education. While it is true that some people of color don't have such skills, others do. Additionally, the social environment certain people of color grow up in, especially in ghettos or slums in the inner-city areas, could result in not having these skills. As I wrote in a paper about the conditions inside prisons and the reasons for the rise of mass incarceration, that not only is the mass arrest of people within the US, the war on drugs, and the education system bias against people of color, but the hope for “a better world is to be in the 'next generation'” is greatly diminished when “when many of these people [of color] are these people are in jail or in prison.” Even so, it is still unacceptable that people would be excluded since all the environmental groups would have to do is teach someone skills if they did not know them already. It's not that hard. As a result of such opinions and the treatment of people of color inside such organizations, it is not a surprise that it's hard to retain people of color.

Warren Buffett's Coal Problem : To run his coal trains, the billionaire investor needs to seize land from a bunch of Montana cowboys; That's not going over very well

It's easy to see why Warren Buffet is called America's most admired investor. The 82-year-old chairman and CEO of Berkshire Hathaway has made gobs of money—$53.5 billion, at last count—and has pledged to give away 99 percent of it. Despite his wealth, Buffett is folksy, unpretentious, and grateful for what he describes as his good luck. He lives in the modest Omaha, Nebraska, home that he bought in 1958 for $31,500 and eats at the local Dairy Queen. (He owns the chain.)

Buffett also gets favorable attention—and deservedly so—for Berkshire's large investments in solar power, wind farms, and the Chinese electric car company BYD. When Berkshire's Iowa-based MidAmerican Energy Holdings Company bought a 579-megawatt solar photovoltaic project in California's Antelope Valley in January, the headlines read, "Warren Buffett in $2 Billion Solar Deal" and "Warren Buffett Continues His Solar Buying Spree." So influential is Buffett as an investor that solar stocks surged on the news. MidAmerican's renewable energy unit also owns a 550-megawatt solar project in San Luis Obispo County, California, and a 49 percent stake in a 290-megawatt solar plant in Yuma County, Arizona. Those are among the biggest solar projects in the world.

A subsidiary of MidAmerican, called MidAmerican Energy Company, a regulated utility with customers in Iowa, Illinois, South Dakota, and Nebraska, has helped build Iowa's thriving wind power industry. Thirty percent of its portfolio is wind-powered generation. "It has been a great and low-key leader," says Bruce Nilles, senior director of the Sierra Club's Beyond Coal campaign.

But Buffett has a problem—a coal problem. In addition to its solar and wind operations, MidAmerican Energy Holdings relies on coal for roughly half of its 18,000-megawatt generating capacity. Buffett's Burlington Northern Sante Fe (BNSF) Railway Company derives a quarter of its $20 billion in annual revenues from transporting coal, and it lobbies aggressively on the industry's behalf. Berkshire Hathaway is one of the very few major U.S. companies that don't disclose their greenhouse gas emissions, and it has opposed shareholders who ask it to do so.

Nowhere is Buffett's green reputation taking more of a beating, though, than in a remote and sparsely populated corner of southeastern Montana. Ranchers, Native Americans, and Amish farmers there are fighting to preserve their livelihoods and landscapes, which are threatened by what, if developed, would be one of the biggest coal strip mines in the West. And shipping all that coal to West Coast ports would be Warren Buffett's BNSF Railway.

People's Climate March and People's Climate Justice Summit

On September 23rd, political and corporate leaders are meeting at the United Nations in New York City for the Climate Summit 2014. This summit represents yet another step towards the corporate takeover of the UN climate negotiations, and the privatization of land, water and air resources under the guise of a global climate compact. Meanwhile, as communities on the frontlines of climate change, we are the ones cultivating real, place-based solutions to address the global ecological crises. Indigenous peoples’ communities, communities of color and working-class white communities that are the first and most impacted by the storms, floods and droughts, are organizing to create millions of family-supporting jobs in clean energy, public transportation, zero waste, food sovereignty, community housing and ecosystem restoration.

We are also organizing to stop pollution and poverty at the source, confronting the extreme energy corporations causing the climate crisis. As we write, our friends and comrades around the world are putting their bodies on the line to stop the corporations responsible – mining corporations; oil, coal and gas companies; pipelines and refineries; biofuels plantations; nuclear power plants; waste and biomass incinerators, and a myriad other industries profiteering from the destruction of our communities, our cultures and our ecosystems.

From Mesa to Mountaintop, from Hood to Holler – join us as we meet the scale and urgency of the crisis by standing in solidarity with all frontlines of resistance and resilience around the world, and taking non-violent direct action against the corporations driving the extractive economy. We call on our allies to:

  • Join us in the streets of NYC for a week of creative non-violent actions for Climate Justice
  • Organize a delegation to join the People’s Climate March & People’s Climate Justice Summit in NYC
  • Organize a creative action in your home community that highlights local solutions to climate change
  • Spread this call to action amongst your respective networks and social media outlets

Our demands of local, national and international decision-makers are simple: Support us in building Just Transition pathways away from the “dig, burn, dump” economy, and towards “local, living economies” where communities and workers are in charge! Join us in solidarity – in the streets of New York City, in your own community, and around the world!

On Bill McKibben’s ‘call to arms’ for the New York Climate Summit

The September climate march was called for by Big Green NGOs 350.org and Avaaz, who have thrown copious quantities of cash at it. But many environmental and climate justice organizations and alliances based in the New York/New Jersey region and across the US have demanded a seat at the organizing table to ensure that the voices of front line and impacted communities are heard, despite their small budgets.

The demands of the march: there will be none. That’s right. The march will simply bring together an estimated 200,000 people to march through the streets of New York and then…  There will be no rally, no speakers, no strong political demands.  Just people showing up with the overarching message that the world’s leaders should take action on climate change.

Please.

What kind of climate action should be taken is a question that has long been debated by climate justice activists, organizations, social movements and Indigenous Peoples all over the world for decades.   “Climate action” can include things like geoengineering schemes–manmade manipulations of nature on such a massive scale that the impacts can’t possibly be known, but could definitely be catastrophic.  They can also include actions already taking place, such as the building of vast hydroelectric dams that flood vast expanses of land and displace thousands of Indigenous Peoples or land-based communities. Climate action can also include ongoing grabbing of land for the development of vast plantations of oil palm, GMO soy or non-native trees for so-called bioenergy.

So no, not all “climate action” is created equal.  A lack of clear justice-based and ecologically sound demands in this “historic” march will leave a vacuum.  And no vacuum remains empty for long.  It’s simple physics.  The media will not cover a march with no demands. They will find a message.  And likely, as so often happens, those with the connections and the money will win the messaging game.
