Food-service workers are suffering from extreme heat; Few rules exist to protect them

With record-breaking temperatures blanketing the country and no federal heat standard in place, workers find they have no choice but to walk out.

As a heat dome blanketed Portland, Oregon in late June, workers at Voodoo Doughnut’s Old Town location found themselves crumbling in their store. Even with air-conditioning in the shop, ambient thermometers brought in by staff recorded interior temperatures upward of 96 degrees. Workers were breaking out in heat hives and doubling over from nausea. The company’s iconic Bacon Maple Bar doughnuts, with their frosting unable to set due to the heat, literally melted into soggy brown mush.

The high-90 temperatures in the Old Town location were already a drastic surge from the more routine ambient summer heat, which was estimated to be around 80 degrees in the store, even with the fryers running all day. But on June 27, when temperature highs in Portland would eventually reach a record-breaking 112 degrees, it reached more than 100 degrees inside Voodoo Doughnut. Workers went to management and suggested that they close the shop early for their safety. After their demand was waved off, a group of employees walked out and went on strike through Monday, when the city’s temperatures soared even further to 115 degrees

“We would rather walk out on strike than to see a coworker collapse and hurt themselves or suffer heat stroke or worst case scenario, you collapse while you’re over a fryer,” said Samantha Bryce, a Voodoo Doughnut employee in Portland, who participated in a strike with her colleagues over workplace safety in June. “We don’t want someone to get hurt before the company takes action.”

The IPCC’s Sixth Assessment Report: A Green-Syndicalist Analysis

Earlier this month, the United Nations Intergovernmental Panel on Climate Change (IPCC) released the first part of its Sixth Assessment Report (AR6) of ongoing global warming. This study of the “Physical Science Basis” of climate change concludes that the situation is very alarming. As such, the AR6 may be taken as “code red for humanity.” In less than 300 years, the carbon emitted to power industrial capitalism has intensified the greenhouse effect, causing Earth’s global temperature to rise on average by 1°C, or 1.8°F (A.1.3). Overall, the AR6’s authors project the impacts of five trajectories of climate change in what remains of the twenty-first century, from courses that limit warming to a 1.5-2°C (2.7-3.6°F) average increase, to paths promising a rise of 3-5°C (5.4-9°F)—or worse. While these latter scenarios would hasten the Sixth Mass Extinction and threaten humankind’s self-destruction through precipitous global ecological collapse, even in the less destructive cases of increases of 1.5-2°C, “[m]any changes due to past and future greenhouse gas emissions are irreversible for centuries to millennia, especially changes in the ocean, ice sheets and global sea level” (B.5). Indeed, global temperatures will rise this century in all scenarios under consideration, and limiting this increase to 1.5-2°C is only possible with “deep reductions in CO2 and other greenhouse gas emissions” now, and in the coming years (B.1)


Since publication of its first assessment report in 1990, the IPCC has borne witness to the ever-worsening problem of anthropogenic climate disruption, together with what amounts to humanity’s suicidal failure to address the factors threatening collective destruction. The AR6 reflects the latest and starkest findings from the field of climatology. Given that each successive report takes 6-8 years to produce, as Guardian environment correspondent Fiona Harvey adds soberly, the AR6 also constitutes “the last IPCC report to be published while we still have a chance of averting the worst ravages of climate breakdown.”

In this article, we will review the IPCC’s AR6 Summary for Policymakers (SPM). The SPM is a much-condensed version of the full report on the “Physical Science Basis” of global warming, which runs to nearly 4,000 pages. We encourage readers to read either or both reports for themselves. After considering the latest findings from climatology, we will conclude by considering possible remedies to the grave problems highlighted by the AR6 SPM. As summarized in the concept of green syndicalism, we will avow egalitarian and socially transformative approaches to radically reducing emissions, in the hopes of minimizing the grave risks posed by the climate crisis. From Climate Strikes to the Union Hall

The Young Worker Listening Project (YWLP), an initiative of the Young Worker Committee of the Labor Network for Sustainability, is an effort to challenge the “workers versus the environment” narrative by collecting and developing stories of how young workers are pushing climate activism in their jobs, in their unions, and in their communities. In recent years, we’ve seen the right attempt to pit labor and climate activists against each other through an argument that environmental regulations will take away good union jobs. But as leaders in our respective unions and labor-climate network, we’ve learned that building worker power and fighting climate change are connected and that young workers are especially eager to tackle the climate crisis through workplace organizing. The young people we have interviewed as part of our Young Worker Listening Project recognize the jobs versus environment choice is a false one. They want the labor movement to be a mechanism for enacting major economic and environmental change, and they can envision a way to get there.

The Young Worker Committee was formed in the summer of 2020 to strategize how best to organize young workers to take an active role in bridging the labor and climate movements. We had a hunch that engaging young workers on issues – like climate change – that extend beyond mandatory subjects of bargaining would help revive the labor movement and give it the power necessary to lead a just transition to a sustainable future. Indeed, for the first time in a long time, young people are largely pro-union. According to a 2020 Gallup poll, 71 percent of people ages 18-34 approve of unions, compared to 63 percent of other age groups. Young people have also been at the forefront of recent climate activism, including the climate strikes of 2019 and protests against the Dakota Access Pipeline at Standing Rock. They’ve also driven the explosion of youth-led climate organizations like the Sunrise Movement and Zero Hour.

Voodoo Doughnut Workers Hold National Day of Action

Our changing climate is increasingly becoming a workplace issue. because these workers engaged in strike action to protest being forced to work in the extreme heat which hit the Pacific Northwest in Summer of 2021, as this article details:

Workers at Voodoo Doughnut in Portland held a national day of action on July 29 to protest against the allegedly illegal firing of staff and to demand better working conditions. The workers, unionized as Doughnut Workers United with the Industrial Workers of the World, were supported by IWW branches in Portland, Eugene, Austin, Houston, Orlando and Los Angeles, who organized actions outside of local outlets of the Portland-based doughnut chain.

The workplace organizing campaign at Voodoo Doughnut goes back several years. Workers tell Mark Medina, an organizer with the Portland IWW who is supporting the campaign, that they earn minimum wage, receive little respect from management, and feel they are at all times close to being demoted or let go altogether. They have also complained of being harassed and even assaulted when leaving the store. During one robbery, an assailant jumped over the counter and threatened staff with a hatchet. Despite the danger, management refused to hire security until pressured to do so by the union.

The ongoing COVID-19 pandemic further deteriorated working conditions at Voodoo Doughnut. Forty workers were initially laid off, with only three being reinstated. Workers allege that management chose to rehire the minimum number of workers necessary for the company to qualify for pandemic-related relief funds from the federal government and that pro-union workers were intentionally excluded. Workers have also had to procure their own personal protective equipment, which management inexplicably asked them to discard, promising replacements but never delivering.

More recently, workers at Voodoo Doughnut were forced to contend with a heatwave that swept through the region from late June to mid July. Management refused workers’ request to close the shop due to inadequate climate control, forcing them to stage a two walk-out involving nearly the entire staff.

Hoping to address these grievances, Voodoo Doughnut workers organized the recent national day of action across six US cities. Workers have asked supporters to amplify this effort across social media and to contribute to a strike and hardship fund organized by the union. Together, Medina believes that workers and their supporters can show management that the union means business.

“We outnumber them,” he says.

Death or Renewal: Is the Climate Crisis the Final Crisis?

Classical socialists, both anarchists and Marxists, have written of the eventual end of capitalism--either through a popular revolution creating a new society or through the self-destruction of capitalism. Global warming raises the question of whether humanity is now facing such a possible total crisis, of choosing between socialism or social ruin.

Recently a friend sent me an article by Simon Lewis, a professor of global change science at the University College of London. Its title (Lewis 2021) was, “Canada is a warning: more and more of the world will soon be too hot for humans” and its subtitle was, “Without an immediate global effort to combat the climate emergency, the Earth’s uninhabitable areas will keep growing.

This led me to think of the apocalyptic warnings of the socialist tradition, the most well-known, perhaps, being Rosa Luxemberg’s “socialism or barbarism.” In 1878, Friedrich Engels wrote that the bourgeoisie was “a class under whose leadership society is racing to ruin…If the whole of modern society is not to perish, a revolution in the mode of production and distribution must take place, a revolution which will put an end to all class distinctions.” (Engels 1954; 217-8) Capitalism’s “own productive forces…are driving the whole of bourgeois society towards ruin or revolution.” (228)

Marx began his 1848 Communist Manifesto by claiming, “The history of all hitherto existing society is the history of class struggles…that each time ended, either in a revolutionary re-constitution of society at large, or in the common ruin of the contending classes.” (2013; 60-61) So, there is an historic choice between “revolutionary re-constitution” or “common ruin.” (This raising of two possible outcomes seems to be contradicted by the Manifesto’s later statement—about the capitalist class, “Its fall and the victory of the proletariat are equally inevitable.” [73] I will not discuss whether Marx was a determinist, and, if so, of what kind.)

This was also an anarchist concept, integrating the problems of capitalism and its state. In 1898, Peter Kropotkin concluded The State--Its Historic Role, "Death--or renewal! Either the State for ever, crushing individual and local life, taking over in all fields of human activity, bringing with it all its wars and domestic struggles for power...which only replace one tyrant by another, and inevitably at the end of the development there is--death! Or the destruction of States, and new life starting again in thousands of centers on the principle of the lively initiative of the individual and groups and that of free agreement. The choice lies with you!” (1987; 60)

Power, Workers, and the Fight for Climate Justice

Who has more power than Shell Oil? This is one of the first questions a climate activist should ask themselves, because without finding an answer, we can’t win.

The power of the fossil fuel industry is massive. Fossil fuel companies are worth at least $18 trillion in stock equity, which represents about a quarter of total global stock markets. These vast resources and their outsized share of the world economy allow the industry to continually assert their interests, no matter the destruction this entails. They do so through any means available, of which there are many.

The notorious work of Exxon in first understanding, and then deeply misrepresenting, the science on climate change is one example. After generously funding its own climate research, and being told explicitly in 1977 that global warming due to the burning of fossil fuels was likely to lead to a two- to three-degree increase in global temperatures, Exxon embarked on an industry-wide quest to promote doubt in the science. This lengthy “fake news” campaign cost millions of dollars, and arguably set back the climate movement by decades.

However, the power of the fossil fuel industry goes well beyond the manipulation of global public thought. From the time of the industrial revolution in the 19th century, the history of modern capitalism has been replete with wars fought over fossil fuels. These have served to maintain strategic interests and, just as importantly, the profits of fossil fuel companies. A map of twentieth-century imperial conquest would show the disproportionate number of wars waged in the Middle East, where the world’s largest and cheapest oil deposits lie. As Alan Greenspan, a former chair of the US Federal Reserve, stated about one of these wars: “I am saddened that it is politically inconvenient to acknowledge what everyone knows: the Iraq war is largely about oil.”

How, then, do we go about exerting equivalent force, in order to dismantle the fossil fuel industry within the limited timeline outlined by scientists, while at the same time building an equitable, habitable, and just society?

There are a number of competing answers to this question. 

The Sydney “Green Bans” Show How We Can Transform Our Cities

In the 1970s, trade unions in Sydney began imposing “green bans” on property developments that were going to cause social and ecological harm. The movement should be an inspiration for challenges to the power of big business everywhere.

Fifty years ago, in June 1971, the New South Wales branch of the Builders Labourers Federation (NSWBLF) voted to ban construction of a luxury housing development in the Sydney harborside suburb of Hunters Hill. Their bulldozer-driving comrades in the Federated Engine Drivers and Firemen’s Association followed suit. The goal was to protect Kelly’s Bush, one of the last undeveloped areas of bushland on Sydney Harbour.

Over time, the tactic they used came to be known as a “green ban,” distinguishing it from a more conventional “black ban.” While trade unions imposed the latter in disputes over wages and conditions, green bans blocked construction on projects that were environmentally or socially destructive, or that threatened sites with heritage value.

The Kelly’s Bush green ban resulted from an unlikely alliance. Hunters Hill was a wealthy suburb, and most residents had little to do with the workers’ movement. Earlier that month, however, the Battlers for Kelly’s Bush — a resident action group — held a meeting of over six hundred people. It called on the unions to protect the bushland.

The NSWBLF was militant, proudly working-class, and maligned by respectable opinion. It was led by socialists and communists. Yet the union found common cause with the middle-class Battlers for Kelly’s Bush.

NSWBLF secretary Jack Mundey explained the union’s decision in a 1973 interview:

What is the good of fighting to improve wages and conditions if we are going to choke to death in polluted and planless cities? We are fighting for a shorter working week. If we get it, we still have to live in these cities. So “quality of life” should not just become a cliché. It should become a meaningful thing, and the workers should be concerned about every aspect of life — not just their working conditions.

Developer AVJennings attempted to circumvent the green ban by using nonunion labor. The NSWBLF hit back. Union members employed at another Jennings site sent a telegram to the developer’s head office: “If you attempt to build on Kelly’s Bush, even if there is the loss of one tree, this half-completed building will remain so forever, as a monument to Kelly’s Bush.”

The NSWBLF executive backed up their members’ threat. In August, AVJennings shelved their development plans. Kelly’s Bush remains untouched to this day.

Houston, We Have a Labor Dispute

It has long been rumored that a strike in outer space occurred in 1973. Astronauts say that isn’t quite true, but the real story is still a testament to the potential of strikes — or even just the threat of strikes — to shift the balance of power in the workplace.

For decades, rumors have circulated about a strike in space. The story goes that in 1973, the three astronauts on the Skylab 4 mission took an unplanned day off to protest ground control’s management style, and the job action resulted in improved working conditions. It’s a great story.

According to Skylab 4 crew member Ed Gibson, that’s not exactly what happened. But his telling of events, though it differs from the tidy and entertaining “space strike” narrative, is still a tale of overwork, micromanagement, and perceived noncompliance bringing management to the table. And Gibson’s account still confirms that even a whiff of collective action can shift the balance of power in workers’ favor.

Earlier this year, the BBC broadcast an interview with Gibson, the last surviving Skylab 4 crew member, conducted by Witness History producer and presenter Lucy Burns. “We’ve only had one reporter other than you talk to us in the past forty-seven years,” Gibson told Burns. He set out to correct the record.

Gibson maintains that the crew didn’t mean to go on strike. But what did happen had a similar effect in terms of giving the astronauts leverage and intervening in a bad (extraterrestrial) workplace dynamic.

Try Filling Jails Before Blowing Pipelines

While the year 2020 saw numerous activist mobilizations, it was the police murder of George Floyd that instantly filled streets around the world with outraged protest. People marched, torched police stations, tore down statues, and confronted police in actions noticeable both for their dedicated persistence and the diversity of participants. There is no question this uprising was effective in certain ways; a much-needed spotlight has been focused on racialized, militarized policing, on the lack of accountability within police unions, and on the basic injustice of the carceral state in general.

And yet. Given the level of outrage, it must be acknowledged that little change has occurred at the policy, much less the institutional level. Commissions are formed, local reforms proposed, and a predictable backlash invigorated, replicating a long-established pattern of protest followed by bureaucratic inertia. Time and again we witness the absorption of movement energy into the grinding processes of the regulatory labyrinth.

As with gun control following school shootings, with climate action following extreme weather events, with antiwar protests in anticipation of invasions, with international trade deals, with Occupy or pipeline blockades, the pattern is clear. I am not saying that protest is dead. My argument is that these particular forms of reactive protest are no longer effective.

What I would like the Climate Movement to consider is a tactic that moves beyond protest as it is now conceived and practiced. This nonviolent, direct action tactic is best described as “fill the jails.”

While the mass civil disobedience of both anti-KXL in Washington DC in 2011 and Extinction Rebellion more recently were steps in the right direction, the historical examples of mass arrest I am promoting have a qualitative difference.

I first learned of “fill the jails” when researching the free-speech fights conducted at the beginning of the 20th century by the Industrial Workers of the World. From San Diego, California to Missoula, Montana, Wobblies defied local ordinances that banned impromptu public speaking. They gained the right to openly organize by calling in masses of fellow workers to be arrested and fill jails until the burden on local authorities became overwhelming. Another historical example is Gandhi’s India campaign, where he vowed to “fill the prisons” in order to make governing impossible for the British.

Perhaps the best-known example of this tactic being applied successfully is the Civil Rights Movement, especially the campaign centered in Birmingham, Alabama (the “most segregated city in America”), in 1963. This is how the large-scale, non-violent direct action was described by historian Howard Zinn:

“Thursday, May 2nd, is ‘D-Day’ as students ‘ditch’ class to march for justice. In disciplined groups of 50, children singing freedom songs march out of 16th Street Baptist church two-by-two. When each group is arrested, another takes its place. There are not enough cops to contain them, and police reinforcements are hurriedly summoned. By the end of the day almost 1,000 kids have been jailed. The next day, Friday May 3rd, a thousand more students cut class to assemble at 16th Street church. With the jails already filled to capacity, and the number of marchers growing, Eugene ‘Bull’ Connor, the Commissioner of Public Safety in charge of the police and fire departments, tries to suppress the movement with violence.”

Between April 3 and May 7 roughly three thousand were arrested and booked, filling not only the jails but an “improvised fairground prison … and open-air stockade” as well. This all took place in conjunction with a well-organized boycott of downtown businesses and public transport. Televised scenes of savage reaction by the racist police were broadcast throughout the stunned world and a horrified nation — which was then forced to confront the injustice.
