Bay Area protests Paris climate talks

Organized by a broad coalition of environmental, social justice, labor, antiwar, anti-racist, and faith-based groups across Northern California, some 3000 mobilized on Saturday, Nov. 21, to demand immediate action to stop and reverse global warming and associated climate-change-influenced catastrophes.

The mobilization was part of the worldwide effort to protest the Nov. 30–Dec. 12 UN COP21 Paris climate conference, where little or no substantial actions were expected to stop and reverse the climate crisis.

Major organizing efforts began here some five months ago, an important factor that made the Oakland march and rally the largest in the U.S. to date among the many planned in cities across the country both before and after the UN-sponsored Paris talks.

Some 200 groups endorsed this action, initiated and sponsored by the Northern Climate Climate Mobilization. Fifty to sixty dedicated activists, representing almost as many organizations, met bi-weekly for months and then weekly to broaden and build this essential “movement of movements” to demand immediate action to eliminate fossil fuel-based energy systems and rapidly replace them with 100 percent clean, safe, and sustainable alternatives to “Defend the Planet.”

In fact, “Defend the Planet” against corporate and government polluters soon became the eye-catching focus of coalition flyers and of the eight-foot advertisements that were posted at seven BART (Bay Area Rapid Transit) train stations, at a cost of $7000. There was little or no doubt among the coalition activists that the consequences of the corporate polluter profit-driven polices to increase fossil-fuel extraction, and the government’s associated actions to promote these policies, threaten life on earth.

The high-spirited and colorful march was led by some 100 Native American Idle No More frontline community activists from Sonoma County to San Jose. It contained new, diverse—but still only modest—representation from the critically necessary sectors of the country’s labor, youth, and oppressed nationalities. The multi-cultural outpouring, included several bands and singing groups, youth contingents, socialist contingents, LGBT groups, high school student organizations, and more.

Speakers at the rally included the main leaders of the San Francisco and Alameda country labor councils, an IBEW local president, and a key representative of the California Nurses Association. All these organized modest contingents of workers in the mile-long march from the Lake Merritt Amphitheater to Oakland’s Frank Ogawa/Oscar Grant Civic Center Plaza. Keynote speaker May Boeve, national executive director of 350.org, stressed the need for a united mass movement to challenge the governments worldwide whose UN climate proposals fall far short of the measures needed to stop and reverse the horrific consequences of global warming.

The adopted demands included opposition to oil wars, racism, the Trans Pacific Partnership (TPP) agreement, corporate and government-backed and implemented policies that foster increased, not decreased, fossil-fuel extraction as well demands for reparations to fund poor nations around the world to guarantee the introduction of sustainable energy systems, a just job transition for all workers at union wages, civil and democratic rights for all in a world where Black Lives Matter, for immigrant rights, and an end to environmental racism.

Following a month of democratic discussion and debate, these points of unity and demands were hammered out and adopted unanimously, an indication of the growing radicalization and sophistication of the climate-crisis movement. Indeed, the ideas presented by the local chapter of System Change Not Climate Change and various socialist groups found a hearty reception among virtually all the activist participants. A spirited and enthusiastic post-Nov. 21 evaluation meeting on Dec. 3 attributed the fact that this year’s march was not qualitatively different in size from last year’s Sept. 21 effort to the relative lack of national coordination.

It was noted that local climate actions initiated by national 350.org were organized mostly on a last-minute basis and on a number of different dates before and after the Paris talks. In contrast, last year’s Northern California mobilization significantly benefited from the “wind in our sails” flowing from the New York City mobilization of 400,000 organized by the People’s Climate March.

This year’s relatively diffuse choice of mobilization dates and organizing activity limited most U.S. actions to a few hundred participants at best. The post-COP 21 Dec. 12 national and international mobilizations promoted by 350.org and other world environmental organizations have been called to make the point that an ongoing movement is sorely need “through” Paris and afterward.

At the close of the UN conference, 350.org leaders are expected to set a national date for coordinated May 2015 spring regional mobilizations in some nine to 12 U.S. cities.

Meanwhile, the Nor Cal Climate Mob, as this new Oakland-based united front mass action coalition is popularly known, voted unanimously at its Dec. 3 evaluation meeting to continue its efforts through the spring actions.

The S.F. Bay Area branch of Socialist Action played an important role in helping to initiate the Nor Cal Climate Mob and build its September 2014 and November 2015 marches. Socialist Action’s tent was a popular rally attraction, with activists purchasing some $150 in Socialist Action newspapers and pamphlets. Solidarity is the new I love you

Hey Kentucky, I’ve got good news for ya! The death of coal companies has been largely exaggerated, it turns out your coal companies are fine, they are just busy destroying Utah and Oakland now. Oh, and New Mexico and Colorado, too, just as they have destroyed the health and environment of Appalachia for decades. Now, after destroying Kentucky’s economy and abandoning communities via a vanishing act, and leaving that mess behind, we’ve figured out where they are and what they are up to, well at least one of them.

Bowie Resource Partners, a decidedly non union company, based in Louisville, Kentucky, has recently popped up in Oakland, California, with a plan to ship in their Utah coal via rail through working class communities of color in West Oakland to a proposed coal export terminal to be built for shipping coal to China, India, etc. Far from going out business, Bowie is currently expanding and buying new mines out west, while coal field communities in Appalachia are suffering devastating economic times.

I’ve previously blogged about this for OVEC back during the last Oakland City Council hearing, which was jam packed with hundreds of residents waiting hours to speak. It turns out that hot button environmental justice issues will do that. Yeah, it turns out that the health and environmental impacts of breathing toxic coal dust has a lot of West Oaklanders pretty damn pissed off. These same communities fighting against police violence to let the world know that #blacklivesmatter, now need to tell Bowie Natural Resource to respect black lives, black health and black neighborhoods as well. West Oakland was the birthplace of the Black Panther party, afterall.

Louisville, Kentucky, with the largest black population in the state, with many historically living in West Louisville, is no stranger to environmental injustice as well. The West End is not only home to most of the environmental hotspots in the city, there is also currently “a campaign to block recycling food waste into methane at a facility in western Louisville.” So, black lives are being disrespected in a lot of the same ways by similar corporate assholes from Louisville all the way to Oakland, and this has to stop.

Community Hosts Teach-In on Environmental Justice as Oakland City Council Delays Action on Coal Exports

Oakland, Calif. - Activists and community leaders from groups including No Coal in Oakland, Fight for 15 and Black Lives Matter rallied today at Oakland City Hall. Along with SEIU Local 1021 they hosted a teach-in on the alignment of the campaign to block coal exports with struggles for social, economic, and racial justice. At its September hearing on the health and safety impacts of a proposal to export millions of tons of Utah coal through a new terminal at the former Army Base, the Oakland City Council committed to acting by December 8th. They have since delayed their action to February. Activists gathered at City Hall nonetheless, to make their voices heard and gather for a community teach-in that brought together a broad intersection of Oakland’s progressive activists.

“If Oakland Bulk and Oversized Terminal is allowed to store coal on City of Oakland-owned land, it will greatly impact the lives and lungs of people in the Oakland flatlands, who are the most vulnerable members of our community,” said Margaret Gordon, co-founder of West Oakland Environmental Indicators Project. “The developer never proposed coal as a commodity until after agreements were signed with the City. Even now, the developer doesn’t have the funding together to make this terminal a reality without the cooperation of state and local government. The City of Oakland should take the strongest possible stance in opposing the storage of coal at the Oakland Bulk and Oversized Terminal.”

"Low-income communities of color disproportionately overburdened by pollution are on the front lines of potential train derailment in West and East Oakland,” said Ernesto Arevalo, East Oakland environmental justice and housing advocate. “The transportation of coal is another burden to these communities that are already facing other environmental risks and displacement."

"What does social justice look like?" said Shonda Roberts, activist with Fight for 15. "To me it looks like a livable wage, a clean environment and safe communities. The only way that would be attainable is
solidarity."

"We believe it is so important that there be no coal in Oakland because of profound health concerns of residents," said Dominic Ware and Chris Higgenbotham of Black Lives Matter Bay Area. "We've already seen the impacts of gentrification in West Oakland. Now we're being exploited in another way by coal companies who want to pollute our communities."

"Oakland should not be involved in shipping coal overseas, since this fossil fuel is the major contributor to climate change,” said Margaret Rossoff of the Sunflower Alliance. “Coal needs to be left in ground and replaced with renewable resources." 

“The City Council can delay all they like, but we’re not going anywhere,” said Brittany King of the SF Bay Chapter of the Sierra Club. “So much is at stake here, from our global climate to the health of the West Oakland community. Today concerned Oaklanders from many different struggles came together to speak with one voice: We say no to coal exports in Oakland.”
Background: A portion of the former Oakland Army Base is being developed as a bulk export facility, known as the Oakland Bulk and Oversized Terminal (OBOT). CCIG, the developer, promised not include coal as a commodity handled by the terminal, but is now soliciting a partnership with four Utah counties that could allow the terminal to export up to 10 million tons of coal from their mines each year. A Utah funding body approved $53 million to buy space at Oakland Bulk Terminal for these exports. This deal is being conducted behind the backs of the Oakland City Council and the Port, both of which oppose coal as a commodity for shipping in Oakland. While the Mayor, members of the council and residents have demanded a stop to this backroom deal, the developer has yet to abandon the plans.

Those opposing the plan to export coal through Oakland have voiced concerns over how this decision will affect the community’s safety, the environment, and public health. According to a national train company, each open-top rail car of coal can lose up to one ton of dust between the mines and the port, resulting in the release of 60,000 pounds of toxic fine particulate matter in communities near the rails. Additionally, this deal will stifle California’s strong commitment to cutting carbon pollution, especially as the state continues to suffer from extreme drought, forest fires, and other signs of climate disruption.

Green versus Yellow Unionism in Oakland

Author's Note: This article is a sequel of sorts to my previous piece, Unions and the Climate Justice Movement, which briefly mentions the No Coal in Oakland campaign. The image, depicted at the right, compares a pro-capitalist-logging poster (yellow, near right) ostensibly created by timber workers (but actually crafted by the employers) to mobilize support for a counter-demonstration to a rally and march, held in Fort Bragg in July 1990, organized by the Redwood Summer coalition (which included timber workers). At first glance, the Oakland City Council meeting, held on September 21, 2015 looked much like many public hearings where public opposition had organized in response to the plans, practices, or proposals of capitalist interests that threatened the environment. For most of the evening, and well into the night, council members and the Mayor watched and listened as speaker after speaker (out of a total of over 500) either spoke in favor (or against) coal exports or ceded their time to their allies. On one side were a widely diverse group of activists, organized by a coalition known as No Coal in Oakland-- adorned in red (union made and printed) T-shirts--opposed to plans to export coal through a proposed Oakland Bulk and Oversized Terminal (OBOT), as part of the Oakland Global Trade and Logistics Center (or Oakland Global), and on the other were the project's supporters, dressed in business attire accompanied by several dozen union workers, many of them from the Laborers' Union, dressed in yellow.  As is often the case, the project's supporters tried to frame the opposition as being composed of insensitive outsiders, and themselves and the supporting "workers" as placing the economic interests of Oakland and its residents above all else. "We support good paying union jobs that will help the struggling, predominantly African-American residents of west Oakland" opined the supporters, trying to suggest that those in opposition didn't.

This is an old, and shopworn script, that has been trotted out numerous times in the past quarter century or more. Anyone who has experienced or studied the "Timber Wars" that took place in the Pacific Northwest during the late 1980s and early-to-mid 1990s will recall the armies of loggers and mill-workers decked out in yellow shirts, sporting yellow foam car radio antennae balls or yellow ribbons who would show up en massé (at the behest of their employers, often with pay) to oppose limits to clear-cutting or protections for the Northern Spotted Owl and to denounce (often) green shirted environmentalists as "unwashed-out-of-town-jobless-hippies-on-drugs" and/or upper middle class "elitists" (or--defying logic--both). Sometimes, in drawn out campaigns, the employers have often furthered this illusion by creating false front "Astroturf" groups, ostensibly composed of workers, to distract attention away from themselves.

The truth is far much more complex and nuanced, of course. Usually the "jobs" promised by the projects' supporters often don't materialize (indeed, the opposite--namely automation, downsizing, and outsourcing--usually occurs). Those in opposition to environmentally destructive practices and proposals are usually composed of and led by locals, most of whom are, themselves, gainfully employed, and sympathetic to the needs and concerns of the affected workers (in fact, the opposition's counter proposals, if well thought out, do more to create "jobs" and job security than those in support of the project). Meanwhile, the actual level of support among the rank and file workers purportedly backing up the capitalists interests could accurately be described as a mile wide and an inch deep, at best. And the bosses? When they speak of jobs, they actually refer to profits. Nevertheless, in the past, the capitalist media has typically and dutifully reported that these projects are opposed by "green clad environmentalists" (or red in this particular case) and supported by "yellow clad workers" (often neglecting to draw any distinction between the workers and their employers).

Therefore, it is both surprising and refreshing, that in spite of the attempts by the employing class to replay that same script on September 21, 2015 in Oakland, the attempt backfired, due to the diligent and tireless organizing by their grassroots opposition. A closer examination of what happened, and how the opposition organized, will illustrate why this is so and how others can duplicate the organizers' efforts to defeat further attempts by capitalist interests to use divide and conquer tactics to push their climate and environment (not-to-mention job) destroying projects through.

Unions, Environmental Justice Advocates Say “No!” To Coal Transport through Oakland

The Alameda Labor Council was a key player in the nearly 100-member Coal-Free Oakland Coalition of unions, climate justice advocates and environmental groups that has halted the proposed transport of coal through Oakland in its tracks, pending a health impact study by the Oakland City Council.  The coalition includes unions representing nurses, teachers, longshoremen, city workers, recyclers, housekeepers, postal workers, bus drivers, custodians and security officers. City Council staff are to report to the council on their public health study and propose next steps by December.

As part of its strategy, the Labor Council passed a hard-hitting resolution opposing a coal export terminal in the new Oakland Global Trade and Logistics Center. Not only was that document key to the coalition’s win, it also firmly aligned organized labor in Oakland with the city’s environmental justice and climate movements. It did so by acknowledging and commending labor’s growing commitment “to environmental justice issues that affect workers, communities and future generations. ”

According to Emerald Cities Oakland Director Tara Marchant, “This coalition and its victory reflect years of work building alliances along environmental justice and labor unions to reject old, polluting energy."

ILWU members tell Oakland City Council to kill coal terminal plan

An overflow crowd at the Oakland City Council meeting on September 21 heard ILWU leaders taking passionate positions against a controversial coal export terminal that developers and coal industry lobbyists want to build on a private dock with public subsidies. Six hundred citizens submitted requests to speak at the hearing which began at 4pm and went late into the night.

Developer hiding

Master developer Phil Tagami was noticeably absent from the public hearing on the coal export terminal which has become a centerpiece of his redevelopment scheme that promised to transform Oakland’s former Oakland Army base into a mix of modern warehouses, intermodal hub and a “state of the art” privately-owned break-bulk dock.

Jobs Promised

To win crucial political support, Tagami claimed his project would create thousands of good-paying jobs, and told community and labor groups that most of those jobs would be union. But many of the groups negotiating with Tagami were unfamiliar with industry employment practices, which may have allowed the developer to use inflated and unrealistic numbers. Now Tagami has hitched his project’s to a controversial coal export terminal, and suggested that the entire project and thousands of jobs depend on the coal deal.

Coal lobbyists & lawyers

Instead of appearing in person at the September hearing, Tagami hired a slew of well-dressed lawyers, lobbyists, businessmen and preachers to make his case for the coal terminal. Lawyers made thinly-veiled threats that lawsuits would be filed if the developers didn’t get their way. One Washington D.C. lawyer declared that the city had no authority to regulate or limit railroads shipping coal to the export terminal.

Buying turnout

But despite hiring big guns, Tagami’s team had a hard time finding actual “concerned citizens” who supported the coal terminal, so they resorted to paying people to fill seats and wear t-shirts. The plan backfired when news reporters interviewed apparent “coal supporters” in the audience who quickly admitted they only came because they were paid. Some even expressed confusion about which side they were supposed to support.

Buying loyalty

The pay-to-play tactics included generous “offers” from the coal lobbyists to local churches and environmental groups – in exchange for backing the coal terminal. A team of former executives from the Port of Oakland reportedly offered church leaders 7 cents for every ton of coal that would be exported; environmental groups were offered a more generous 12 cents per ton. The environmental groups declined the offer; while some church leaders apparently accepted and attended the hearing to praise the proposal.

Labor unity & exceptions

The Alameda County Central Labor Council told City officials that unions had just passed a strong resolution opposing the coal export terminal, because it would provide few jobs, threaten nearby residents and harm efforts to control climate change. Two unions, the Teamsters and Laborers, tried but failed to stop the labor body from adopting the coal terminal resolution.

Both were told by the developer that the good union jobs being promised could not be delivered without the coal terminal. Teamster officials joined developer Phil Tagami in avoiding the public hearing, but lobbied for the coal project behind the scenes.

East Bay Unions Don't Want Your Coal

Coal is the energy source of the past, so what is it doing in plans for our future? It's a question that was asked by labor, environmental and community activists as they learned about plans for a new bulk commodities terminal proposed for Oakland's former army base by developer Terminal Logistics Solutions. The company is backed heavily by major coal producers in Utah looking for a way to get their product to U.S. ports for shipment, and while they thought they could sneak it by quietly, the ever-vigilant community in the Bay Area found out anyway, and the result was explosive. Opposition to the terminal is coming from a variety of angles, but one is particularly important: the labor community.

Oakland's workers, especially its dockworkers, have always been highly active in their community. Many live and work in and around West Oakland, near the city's port, and they have a vested interest in community health and welfare in addition to safe working conditions. They live in the awareness that the region has extremely high rates of respiratory disease and other pollution-related illnesses, something coal shipping would only exacerbate, and that working on a daily basis with the dusty and dangerous commodity would put their health at risk as well. So they had a personal interest in keeping coal out of Oakland, but it went deeper than that.

In a statement issued September 18—immediately before a city council meeting scheduled for the 21st—the Alameda Labor Council put forward a firm case against coal. "The Alameda Labor Council [expresses] opposition to the export of coal through Oakland and specifically the Oakland Global Trade and Logistics Center at the former Oakland Army Base," they explained, citing environmental and human health risks associated with coal exports. They also noted that the coal industry is notoriously anti-union, and that it doesn't offer as many jobs as work in other commodity industries. Moreover, union advocates argued, they welcomed development of other commodities shipping at the Port of Oakland, as long as it involved less toxic and environmentally harmful products.

Longshore Workers Vote to Oppose Coal Exports in Oakland

SAN FRANCISCO, CA – Longshore workers and marine clerks who have moved cargo at the Ports of Oakland and San Francisco since 1934 have rejected a developer’s plan to export coal through former Oakland Army Base. International Longshore and Warehouse Union elected officials say coal is an undesirable, low-value cargo and a broken promise on the part of the developer, and longshore workers are standing by community members who do not want the worry and risks of nine million tons of coal passing through their neighborhoods on trains each year. After much research and discussion, the rank and file members of ILWU Local 10 and ILWU Local 34 have voted to oppose the handling of coal at the site.

“When the developers of the project were seeking tax money and public support to develop the Oakland Army Base, they talked about exporting cargoes like grain and potash,” said Sean Farley, President of ILWU Local 34. “They made a ‘no coal’ promise to workers, the community and elected officials, and they need to make good on that promise. Waterfront space is in short supply on the West Coast, and it would be a mistake to lock Oakland into a decades-long lease with a coal industry that many say is dying. Coal proposals have failed up and down the West Coast, and Oakland shouldn’t become the dumping ground for dirty, low value cargoes that no one else wants.”

After the Oakland City Council granted the California Capital and Investment Group (CCIG) the right to develop the former army base adjacent to the Port of Oakland, CCIG planned to build the Oakland Bulk and Oversized Terminal (OBOT) on the site. CCIG has since turned its “no coal” promise into a “coal or nothing” threat, claiming no other cargo will pay the bills. Meanwhile, other West Coast ports are thriving while exporting products like grain, potash, soda ash, salt, and other commodities and bulk products.

“Coal is not the right way to bring jobs to Oakland,” said ILWU Local 10 Business Agent Derrick Muhammad. “Oakland families are already worried about asthma and other sickness because of highways and port activities. It’s not right to ask them to take on the worry and risk of nine million tons of coal passing through their neighborhoods on trains each year. If the developers haven’t found a cleaner, safer product yet, they owe it to the City of Oakland to make good on their promise and keep looking. They’ll find better cargoes if they are truly committed to bringing good, safe jobs to our community.”

The International Longshore and Warehouse Union’s Coast Longshore Division represents approximately 25,000 longshore men and women in 30 West Coast ports from San Diego, CA, to Bellingham, WA.

The Oak to Ninth Project is the definition of gentrification. "The Oak to Ninth Project would wall off the waterfront, demolish the historic Ninth Avenue Terminal, build housing next to I-880, and create yet more traffic congestion. This deal, which its opponents point out received virtually no coverage in the corporate media, has been called 'shady.' "[1] To add insult to injury they are calling it the "Brooklyn Basin" [2]

The project would build into the estuary which the Sierra Club once again uses their privilege to compromise the environment and state "Rather than approving the developer's request for 3,100 units, the Council should insist on the environmentally superior project of just 540 units."

In 2006 opposition was raised The League of Women Voters, the Sierra Club, the Coalition of Advocates for Lake Merritt (CALM), and the Green Party. They were met with a demand to collect 18,700 signatures in 30 days for the plan for the a referendum [5] They ended up collecting 25,000 but were shut down and in response filed a lawsuit in Superior Court.

“After mounting an enormous and successful effort to alert the public and collect signatures, the Referendum Committee faces an impossible situation,” president of the League of Women Voters of Oakland Helen Hutchison said in a prepared statement announcing the lawsuit. “The city gave us the authorized documents several days into the brief 30-day signature gathering period. Then when we turned in the signatures, they said, ‘we supplied the wrong documents so the referendum petition is invalid.’ Invalidating our petition for this reason completely undermines the right to petition for referendum on a city action"

This project is being pushed forward by Gov. Jerry Brown who recently received an award from the Blue Green Alliance and the Sierra Club for "catalyzing the clean energy economy" This was a complete farce considering Jerry Brown has been attacking unions and the environment for some time now [3] This project may be exactly why he is working to dismantle the California Environmental Quality Act for infill housing development! [4] In the Environmental Impact Report it states:

"The Court Order found that the EIR failed to comply with CEQA by not including a sufficient analysis of the cumulative land use/plans and policies impacts of the proposed project."
