The freight transportation system in the United States is a fundamental part of our economy, infrastructure and environment, but many freight system frontline workers labor in arduous conditions yet receive low wages and limited benefits.

Freight Automation: Dangers, Threats, and Opportunities for Health and Equity explores how automation in the freight transportation system affects the health of workers, communities, and the environment—and also how these effects will be inequitably felt by people with low incomes and communities of color. Created PHI’s Regional Asthma Management and Prevention, Moving Forward Network, Human Impact Partners and community partners, the report also provides recommendations for policies and programs that promote health and equity for frontline workers and fence-line communities.

Labor Principles for Transportation Electrification

The Labor movement stands united in our support for good, middle-class jobs, policies that address climate change, and safe transportation that brings equitable benefits to communities across the country. As our infrastructure evolves and adapts to new challenges, new technologies, processes, and business models meant to face these challenges must advance these goals. Today, our nation is grappling with the challenge of transitioning to zero-emission transportation vehicles and infrastructure over the next few decades.

We cannot let the Wall Street and multinational corporations alone decide how to move forward on these issues. While we will all continue to advocate for modal and union specific concerns, the undersigned unions have come together to adopt the following principles that will guide our policy advocacy, collective bargaining, and organizing efforts as we all work to reduce greenhouse gas emissions in our industries and advance racial and environmental justice.

Workers and the Green New Deal Today

Teamsters at Marathon’s St. Paul Park refinery strike over safety

Operations and maintenance workers at Marathon Petroleum’s refinery in St. Paul Park went on strike today. Members of Teamsters Local 120 say they are taking a stand not just for good jobs, but also for the safety of their community.

At issue in the dispute is management’s ability to replace union members with workers from lowest-bidder subcontractors, including firms from outside Minnesota.

“We want a contract that protects jobs where the money goes back into our communities, jobs for people who have an interest in the safety of our community,” Local 120 Business Agent Scott Kroona said. “If somebody comes in from Texas or Indiana, which is what the company wants, their money goes back to Texas or Indiana. And they don’t care about St. Paul Park.”

Local 120 represents nearly 200 workers at the Marathon refinery.

Picket lines went up at each of the facility’s gates at 5 p.m., and they will stay up around the clock indefinitely, Kroona said.

With Teamsters outside, it raises the question of who’s doing the work inside the refinery. Kroona said he expected the company to bring in replacement workers.

“I have to believe they are not as skilled or well-trained as the workers we have in there,” he said. “And when you’ve got petroleum products under high temperatures and high pressure, every job is dangerous. I don’t care how minor a job you’d call it.”

As proof, the union pointed to an April 2018 explosion at the Husky refinery in Superior, Wis., which resulted in worker injuries and residential evacuations in the area. Contractors working in the refinery at the time later sued the company.

That mobilization can provide a historic opportunity to create millions of good, high-wage jobs, virtually eliminate poverty, provide unprecedented levels of prosperity and economic security, and counteract systemic injustices. So far discussion about the Green New Deal has rightly focused on values and goals. But there are many practical problems that will have to be solved as well.

Why has the Dakota Access Pipeline become a divisive issue for U.S. Labour?

Protests against the Dakota Access Pipeline in North Dakota are continuing, according to Democracy Now on October 7.  On October 5, three U.S. federal judges heard arguments  over whether to stop the construction, but they are not expected to make a ruling for three or four months.  Meanwhile, Jeremy Brecher of the Labor Network for Sustainability released a new post , Dakota Access Pipeline and the Future of American Labor,  which asks “Why has this become a divisive issue within labor, and can it have a silver lining for a troubled labor movement?”  The article discusses the AFL-CIO’s  statement  in support of the pipeline, and points to the growing influence of the North America’s Building Trades Unions’ within the AFL-CIO through their campaign of “stealth disaffiliation”.  It also cites an “ unprecedented decision” by the Labor Coalition for Community Action,  an official constituency group of the AFL-CIO , to issue their own statement in support of the rights of the Standing Rock Sioux Tribe, in direct opposition to the main AFL-CIO position. The Climate Justice Alliance, an environmental justice group of 40 organizations, has also written to the AFL-CIO in an attempt to begin discussions.  Brecher’s article concludes that the allies and activist members of the AFL-CIO are exerting increasing pressure, and asks “Isn’t it time?” for a dialogue which will shift direction and build a new fossil-free infrastructure which  will also create jobs in the U.S.    For unions interested in supporting the protests against the Dakota Access Pipeline, a sample resolution for local unions is available from the Climate Workers website.

We are unions representing members in health care, domestic work, public transit, railroads, manufacturing and other sectors.

We congratulate leaders of the Standing Rock Sioux Tribe and thousands of supporters for the news that the federal government will deny authorization for the Dakota Access Pipeline to go through tribal lands posing a threat to water sources and sacred sites.

The Obama Administration’s decision respects the sacred grounds of the Standing Rock Sioux and takes into consideration the potential of a hazardous pipeline leak that would harm the community’s life and livelihood.

This is a historic victory, and an organizing victory that every union member can identify with, against one of the most powerful economic and political forces in the world: the fossil fuel industry and its many allies inside and outside government. These forces have used private police that have not hesitated in using violence to intimidate those participating in peaceful protest.

Mindful of our own history in facing private police and vigilantes in the fight to establish workers’ rights, trade unionists have stood shoulder to shoulder with the First Nation water protectors, environmental and community supporters, and many allies who have mobilized and rallied for months against huge odds.

Our unions will continue to join with opponents of the Dakota Pipeline along other routes and fight to halt similar projects that transport dirty crude oil that jeopardize public health and contribute to the climate crisis.

We also stand in solidarity with the construction workers who build our country’s infrastructure, and also with the workers in coal, oil and gas, many of whom have lost their jobs due to the collapse in global prices. In accordance with the Paris Climate Agreement, we call for a “just transition” for workers whose jobs and livelihoods may be threatened by the move away from fossil fuels.

But there is much work to be done in modernizing and repairing bridges, roads, tunnels, public transit systems, etc., many of which have become dilapidated and dangerous to workers and the public.  But jobs based on expanding (and exporting) fossil fuels will simply lead to more environmental destruction, worsening health, climate instability and social upheaval at home and abroad.  Business as usual is not an option.

Together we can demand the development of sustainable energy production and resource initiatives that unequivocally provide good, safe union jobs while salvaging the health and well-being of the earth’s population.

Our future depends on our willingness to engage and organize among progressive forces and social movements in order to effectively meet the challenges ahead.

Unprecedented? Unions and community unite to halt plans to build coal export terminal in Oakland, California

A short but well-organized campaign to stop plans to build a coal export terminal in the Oakland Port resulted in a packed Oakland City Council meeting on September 21, and a vote requiring a public health impact study to guide the Council’s action, up to and including a moratorium on coal.

Screenshot 2015-09-26 10.47.56The campaign, “Coal Free Oakland,” led by the Sierra Club and others, brought together a very broad coalition (more than 80 organizations), with significant union participation, including the Alameda Labor Council, which passed a resolution calling on the city to reject the coal export plan.

Among those coordinating the labor outreach was Climate Workers, a project of Movement Generation Justice & Ecology Project.

Labor and climate justice organizer Brooke Anderson, who heads up Climate Workers, called it “hugely significant — precedent setting — that labor came out in this way and opposed coal coming through the neighborhoods where their members live.” Unions signing on to the petition against the coal facility include the California Nurses Association; SEIU 1021 and United Service Workers West; the American Postal Workers Union (Oakland’s largest post office is next to the port); ILWU Local 10, Local 6 and Northern California District Council; UniteHERE Local 2850; the Peralta Federation of Teachers; the Oakland Education Association; UAW Local 2865; the Amalgamated Transit Union Local 192; and AFSCME District Council 57.

Trashed: Inside the Deadly World of Private Garbage Collection

Shortly before 5 a.m. on a recent November night, a garbage truck with a New York Yankees decal on the side sped through a red light on an empty street in the Bronx. The two workers aboard were running late. Before long, they would start getting calls from their boss. “Where are you on the route? Hurry up, it shouldn’t take this long.” Theirs was one of 133 garbage trucks owned by Action Carting, the largest waste company in New York City, which picks up the garbage and recycling from 16,700 businesses.

Going 20 miles per hour above the city’s 25 mph limit, the Action truck ran another red light with a worker, called a “helper,” hanging off the back. Just a few miles away the week before, another man had died in the middle of the night beneath the wheels of another company’s garbage truck. The Action truck began driving on the wrong side of the road in preparation for the next stop. The workers were racing to pick up as much garbage as possible before dawn arrived and the streets filled with slow traffic. “This route should take you twelve hours,” the boss often told them. “It shouldn’t take you fourteen hours.”

Working 10- to 14-hour days, six days per week, means that no one is ever anything close to rested. The company holds monthly safety meetings and plays videos, taken by cameras installed inside the trucks, of Action drivers falling asleep at the wheel. “You’re showing us videos of guys being fatigued, guys falling asleep,” a driver told me. (All Action employees asked for anonymity for fear of retaliation.) “But you aren’t doing anything about it.”

“In the history of the company I am sure there have been times where supervisors have inappropriately rushed people,” said Action Carting CEO Ron Bergamini. “They shouldn’t be, and they’d be fired if they ever told people to run red lights or speed. But you have to find the balance between efficiency and safety, and that’s a struggle we work on every day. But you cannot turn around and say, ‘Hey just take your time, go as long as you want.’” He pointed out that workers can anonymously report concerns to a safety hotline. As to the questions of overwork and driver fatigue, Bergamini responded, “That’s a struggle that the whole industry has — of getting people to work less.”

In the universe of New York’s garbage industry, Action is considered a company that takes the high road. A union shop, it offers starting pay of about $16 per hour for helpers and $23 for drivers, far more than many other companies. And unlike some other companies, Action provides high-visibility gear and conducts safety meetings. But since 2008, the company’s trucks have killed five pedestrians or cyclists.

In New York City overall, private sanitation trucks killed seven people in 2017. By contrast, city municipal sanitation trucks haven’t caused a fatality since 2014.

Pedestrians aren’t the only casualties, and Action isn’t the only company involved in fatalities. Waste and recycling work is the fifth most fatal job in America — far more deadly than serving as a police officer or a firefighter. Loggers have the highest fatality rate, followed by fishing workers, aircraft pilots and roofers. From the collection out on garbage trucks, to the processing at transfer stations and recycling centers, to the dumping at landfills, the waste industry averages about one worker fatality a week. Nationally, in 2016, 82 percent of waste-worker deaths occurred in the private sector.

There are two vastly different worlds of garbage in New York City: day and night. By day, 7,200 uniformed municipal workers from the city’s Department of Sanitation go door-to-door, collecting the residential trash. Like postal workers, they tend to follow compact routes. They work eight-hour days with time-and-a-half for overtime and snow removal and double-time for Sundays. With a median base pay of $69,000 plus health care, a pension, almost four weeks of paid vacation and unlimited sick days, the Department of Sanitation workforce is overwhelmingly full time and unionized. It’s also 55 percent white, and 91 percent male.

But come nightfall, an army of private garbage trucks from more than 250 sanitation companies zigzag across town in ad hoc fashion, carting away the trash and recycling from every business — every bodega, restaurant and office building in the five boroughs. Those private carters remove more than half of the city’s total waste.

Worker Solidarity with Camp Makwa and the Movement for Environmental Justice

On Tuesday, December 5, 2017, the Twin Cities IWW unanimously passed a resolution reaffirming the IWW’s opposition to the construction of the Dakota Access Pipeline and the Keystone XL Pipeline as well as officially declaring its opposition to the construction of the Enbridge Line 3 Pipeline. The Twin Cities IWW pledged material support to water protectors, rejecting Enbridge’s arguments that the pipeline is necessary for jobs and prosperity for working class people, and put forward a vision of a “Just Transition” to a sustainable economy.

The resolution pledged two donations of $100 each to the legal defense fund and the supply fund of Camp Makwa, a resistance camp using direct action to protect the land and water that Anishinaabe people and other working class Minnesotans depend on. The resolution further endorsed the Black Snake Killaz Circuit, a series of fundraising concerts for Camp Makwa running across the Twin Cities and other towns in Minnesota and Wisconsin throughout the winter.

No Jobs on a Dead Planet

In the resolution, the Twin Cities IWW rejected the attempts by Enbridge and certain unions to paint the pipeline as good for workers. Instead, the resolution focuses on the harm that the oil industry does to its workers, surrounding communities, and the environment.

Enbridge’s existing Line 3 is the cause of the largest inland oil spill in US history, spilling 1.7 million gallons of oil into the Prairie River in 1991. In 2007, tragedy struck in Minnesota again with a pinhole leak explosion in Clearbrook, killing two workers, sparking a large fire, and spilling 15,000 gallons. This spill burned for three days, contaminating the air in the surrounding community. In 2010, Enbridge’s Line 6B pipeline also spilled, releasing around a million gallons of oil into Talmadge Creek and the Kalamazoo River and causing 30,000-50,000 houses to evacuate—and leaving twice as many without clean drinking water. In the aftermath of these spills, union workers have spoken out against Enbridge for failing to clean up their mess which has resulted in birth defects, illness, cancer, and death of both humans and animals in the area of the disaster.

In addition to these specific acts of negligence, the resolution noted the way in which the oil industry exposes working class communities and especially communities of color and indigenous people to the worst risks. These communities are often ignored and their well-being violated during the permitting process for pipelines and other infrastructure projects. For example, pipeline routes often avoid wealthier or majority-white towns and are directed rather through poorer areas, especially near indigenous land. This was the case with the Dakota Access Pipeline, and the same pattern can be seen with Line 3.

The resolution further emphasizes the reality of climate change, an accelerating trend that is already disrupting and destroying lives, economies, ecologies, and communities around the world. As the resolution notes, “there are no jobs on a dead planet.”

Faced with environmental dangers on a local and global scale, and unable to stop the lobbying power of well-connected companies, marginalized communities of workers are left with few choices except direct action. Water protectors face violence from the state and private security to defend the land and the people who live on it from the harm done by the oil industry.
