Rail workers score big safety win in California

Rail workers scored a big safety win in California on August 21 as state lawmakers gave final approval to a bill mandating two-person crews on all freight trains.

The measure, pushed by the Teamsters and their California affiliates, the Rail Division of SMART - the former United Transportation Union - and the state labor federation, now goes to Gov. Jerry Brown, D-Calif., who is expected to sign it.

Rail unions nationwide have been pushing for the two-person crews while the rail carriers have been pushing for just one, an engineer. Several months ago, the head of one carrier, the Burlington Northern, advocated crewless freights.

The unionists told lawmakers presence of a second crew member would cut down on horrific crashes such as the one that obliterated downtown Lac-Megantic, Quebec, two years ago. Then, a runaway oil train crashed and exploded, killing 47 people. That train had only an engineer. There has been a string of similar U.S. accidents since, especially of oil-carrying trains. Recent oil train accidents were near Galena, Ill., Lynchburg, Va., and in West Virginia.

The proposed California statute requires trains and light engines carrying freight within the nation's largest state - home to one of every eight Americans - to be operated with "an adequate crew size," reported Railroad Workers United, a coalition of rank-and-file rail workers from SMART, the Teamsters and other unions.

The minimum adequate crew size, the bill says, is two. Railroads that break the law would face fines and other penalties from the state Public Utilities Commission. The commission supported the bill, SB730.

(Re)constructing the Pipeline: Workers, Environmentalists and Ideology in Media Coverage of the Keystone XL Pipeline

Environmental protection is presumed to damper economic growth and media accounts of resource extraction often portray trade-offs between jobs and the environment. However, there is limited evidence that environmental protection universally costs jobs and heavily polluting industries provide few jobs in comparison to environmental impacts.

Therefore, how has media discourse contributed to the taken-for-granted division between the economy and the environment? This paper uses the Keystone XL pipeline controversy as a case of the symbolical conflict between supporters of growth and conservation to explore the role of ideology and power in media discourse.

I use frame analysis of newspaper articles to explore the representations of labor and the environment and how hegemonic ideology legitimizes resource extraction. My analysis reveals binary framing that constructed the pipeline as a political controversy over the trade-off between the environment and the economy, which made conflict between workers and environmentalists sensible, and silenced alternatives.

Stop Retaliation & Hanging Noose Incidents: Defend Recology IBT 350 Member Daryl Washington

The company discriminated against him and sought to buy his silence with a bribe. Speakers pointed out that workplace bullying is a growing issue in the workplace including many other locations.

This rally/press conference which took place on July 27, 2015 was endorsed by United Public Workers For Action, Stop Workplace Bullying Group, and Transport Workers Solidarity Committee.

Boston school bus drivers vote in fired union leaders

In a stunning victory, the militant, fighting rank and file of the Boston school bus drivers’ union, United Steelworkers Local 8751, voted in the full slate of Team Solidarity candidates, led by four illegally fired leaders, on the union’s Executive Board.

The April 30 election was the largest voter turnout in the history of the local and resulted in an unprecedented landslide vote by more than 3 to 1 for the Team Solidarity ticket. The membership sent a clear message to Veolia/Transdev, the union-busting school bus management company, as well as to Boston Public Schools and Mayor Marty Walsh, that they will fight and win a just contract and the rehiring of their leaders. They will also unite with the communities they serve to struggle for Equal Quality Education.

The new executive board-elect of the 850-strong union, whose members are largely Haitian, Cape Verdean and African-American, includes President Andre Francois, long-time chief steward; Vice President Stevan Kirschbaum, a founder of the local; Treasurer Georgia Scott, veteran of the 1965 Civil Rights battle on Pettus Bridge in Selma, Ala.; Financial Secretary Steven Gillis, the outgoing vice president and benefits administrator; Recording Secretary Claude “Tou Tou” St. Germain, a Fanmi Lavalas activist; Grievance Committee members Garry Murchison, a three-term past president, Frantz Mendes, two-term president, and Richard Laine; Trustees Frantz “Fan Fan” Cadet, Fred Floreal and Judy Long; Guide Chantal Suffrant Casimir; Guards Adriano Barbosa and Ludnay Pierre; and Accident Review Committee members Jerome Samir Stanley, Kathy Moore and Robert Salley. Murchison led the local’s last five-week strike in 1991, which ended with a 48-hour occupation of the mayor’s office.

Veolia illegally fired Francois, Gillis, Kirschbaum and Murchison in November 2013, following a company-ordered, police department-enforced lockout on Oct. 8, 2013, which occurred after the local requested an emergency meeting. The lockout occurred in the midst of a three-month fight with the new company over wage theft, its refusal to honor the drivers’ long-standing contract and Veolia’s illegal demand — because it’s in violation of the contract — made the day before, that even 40-year veteran drivers must file new hire applications.

A small clique of business-minded, company-inspired opponents, including the current president — who bowed out during the election campaign — tried to turn the membership against Team Solidarity’s fighting slate. They bombarded members with the message: “Don’t vote for the people who were fired. They won’t do you any good.”

The climax of year-long bargaining over a new concessionary contract was the company’s divisive campaign that included pushing a “final” proposal with no amnesty for the fired leaders and using false “retro-pay” payroll documents produced by management. But the members voted for the new board based on their personal experience with Team Solidarity’s leaders, who have filed hundreds of their grievances, administered and defended their benefits, and fiercely fought for them and the union’s survival during the nearly two years since Veolia and the mayor’s office began their union-busting assault.

ILWU Local 6, strikes Waste Management. AFL-CIO leaders tell their members to scab.

The ILWU Local 6 represents sorters and other workers at the Waste Management recycling center (we used to call them dumps) at the end of Davis Street in San Leandro CA. The workers have not had a raise in four years.

Most of the workers are Latino's, many of them immigrants and they complained to me about disrespect and discriminatory treatment on the job. Workers told Facts For Working People that management is refusing to budge on wage increases and workers don't trust the management to comply with the Oakland City Council's meager wage increase provisions which would raise wages from round $12 an hour now to around $21 an hour by 2019. This is the only possible increase on the table so far. It is a sorry state of affairs when the only chance of making any headway albeit an inadequate one, is relying on a municipal body run by politicians in one of the two Wall Street Parties.

As I walked the picket line, drivers for Waste Management, members of Teamsters Local 70,  drove through the picket lines as the strike does not have sanction from the Alameda Labor Council.  I called the Labor Council to find out why and was told that the ILWU local 6 is no longer affiliated to the AFL-CIO.  The source said that she hoped the strike is successful.  Unfortunately hope doesn't pay the rent and it doesn't win strikes.

Railroad Worker Jen Wallis: "The Fence is Capitalism...It's Time to Take it Down!"

Editor's note: Jen Wallis meant to give the following speech at the People's Climate March in Seattle on Sunday, September 21, 2014, but had to abbreviate it due to time constraints. Here is the entire speech she would have given:

Hi my name is Jen Wallis, and I’m a founding member of Railroad Workers United. We are a rank-and-file caucus of the various national and international railroad unions. A few of us started this organization to respond to the decades of infighting created by the carriers to keep us divided.

I've been a conductor with BNSF Railway for over ten years. In 2008, I was injured on the job through no fault of my own. I was one of the first workers to file a whistleblower suit against a major railroad for retaliation for reporting a work-related injury. After 6 years of litigation, I won my case in Federal Court this past March, so I know a little bit about what it takes to fight corporations and what they will do to you and your family. I lost much of my support system, and I lost my house to foreclosure. And just as a side note, I first met Kshama Sawant when she showed up and got arrested for those of us fighting foreclosure. She is amazing!!! Over 1,000 railroaders who filed similar complaints have lost. I’m one of a handful to have won. The railroads have a lot of money to fight you, and they usually win.

I’ve taken it upon myself to use my victory to speak out for safety on the railroad because I’m one of the few people who can and not get fired for it, and I was actually in San Francisco speaking at a labor conference this past July when I got word that a group of unelected union officials from the conductor’s union had been meeting in secret with BNSF for 18 months, and unleashed a proposal that would have ended the job of the conductor on freight trains right here in my territory. My job. One person running trains at least a mile long through our communities where there have always been at least two, and engineer and a conductor. 140 years of railroading tradition gone with one contract. All the railroads would follow that precedent.

So we at Railroad Workers United went into what I can only call DEFCON 1 organizing. We had less than a month to mount a campaign to vote no before ballots were to be sent out. There were plenty of carrots in the agreement being dangled for the huge numbers of new hires we have, with things like “worker retention board” which claimed if you can’t hold a job, we’ll pay you to sit at home and not work, ending pay scale for new hires, and huge buy-outs for those getting close to retirement anyway. It was the standard concessionary agreement. Now those of us who have been in the game long enough knew these were only empty promises. We’ve seen enough of these broken in our careers, but the massive numbers of new hires did not, and we saw what scare tactics do at places like Boeing. Unions usually don’t defeat concessionary contracts, even when those companies are swimming in profits.

We knew we had to be bold, as bold as they were. I immediately started a FB group to protest the meeting in Sea-Tac where the officers would be to give us the hard-sell pitch. Now railroaders aren’t allowed to strike, and we haven’t done much in terms of organizing anything since 1894. You won’t find many of us who have ever so much as held a sign on a picket line. So I invited people who are more comfortable with holding signs - I invited my environmentalist friends I’d been trying to build alliances with these last couple of years - people from Backbone, from 350.org, Rising Tide, and members of the more radical unions like the Teamsters and Teachers and ILWU, and they showed up for us. Jess Spear showed up for us. The media we got in Seattle from that little picket inspired towns all across the country to follow suit. In places like Greybull, Wyoming and Creston Iowa, we got the spouses and families out there holding signs, (probably for the first times in their life), because they know our jobs and how terrifying it would be to have their loved ones out on these dangerous trains by themselves working under extreme fatigue in every kind of weather. We added over 2,000 new members to our facebook group in a month, distributed thousands of stickers and flyers and talking points. Many of us put our lives on hold and spent every waking moment organizing around this.

Finally, on September 10th, less than two months after we first got wind of it, the results were in. From the Gulf Coast to the Great Lakes to right here in the Pacific Northwest, our members voted that proposal down. It was one of the proudest moments of my life. But as sweet as that victory was, none of that means anything compared to this fight against climate change. I have a 9 year-old son. I read recently that by the time he is my age, at the rate we’re going, this planet will experience a mass extinction. Extinction! And I can’t help but wonder If I’ve really done enough to protect him from that future.

Now our recent victory was a huge inspiration to all of us. We now know what we have to do, and we know what it takes to do it. We understand completely now that we are fighting an industry that cares as much about us as they do the environment, which is not at all...It might seem a little scary for environmentalists to approach labor, and sometimes the feeling is mutual, but when my co-workers saw that tripod up in Everett with the sign that said “Cut Oil Trains, Not Conductors”, they were blown away. Nobody has stood up for us in a very long time. America has what I call an epidemic of fence-straddling. Most people like to be perched up there, listening to information from both sides and occasionally hopping down from one to the other based on the news we get or the friends we know or which side has the most money or slickest campaign. But my friends, the fence is an illusion. If we could all just step back for a minute and notice that big field we’ve been in together this entire time. The fence is capitalism and corporate plutocracy, and it’s time to take it down!!!

"Sharing economy" companies like Uber shift risk from corporations to workers, weaken labor protections, and drive down wages.

Kazi drives a Toyota Prius for Uber in Los Angeles. He hates it. He barely makes minimum wage, and his back hurts after long shifts. But every time a passenger asks what it’s like working for Uber, he lies: “It’s like owning my own business; I love it.”

Kazi lies because his job depends on it. After passengers finish a ride, Uber asks them to rate their driver on a scale from one to five stars. Drivers with an average below 4.7 can be deactivated — tech-speak for fired.

Gabriele Lopez, an LA Uber driver, also lies. “We just sit there and smile, and tell everyone that the job’s awesome, because that’s what they want to hear,” said Lopez, who’s been driving for UberX, the company’s low-end car service, since it launched last summer.

In fact, if you ask Uber drivers off the clock what they think of the company, it often gets ugly fast. “Uber’s like an exploiting pimp,” said Arman, an Uber driver in LA who asked me to withhold his last name out of fear of retribution. “Uber takes 20 percent of my earnings, and they treat me like shit — they cut prices whenever they want. They can deactivate me whenever they feel like it, and if I complain, they tell me to fuck off.”

In LA, San Francisco, Seattle, and New York, tension between drivers and management has bubbled over in recent months. And even though Uber’s business model discourages collective action (each worker is technically in competition with each other), some drivers are banding together.

The Fight For Railway Safety & The Case Of IBT BLET BNSF Railroad Worker Jen Wallis

Wallis won a lawsuit against the railroad which is owned by Warren Buffet. Labor’s Route to a New Transportation System: How Federal Transportation Policy Can Create Good Jobs, First-Rate Mobility, and Environmentally Sustainable Communities

Federal transportation policy is set every five to six years through the Surface Transportation Authorization Act. This policy largely shapes investment in our nation’s transportation system. Currently, only unions whose members are employed in the transport sector play a role in trying to influence federal transportation legislation, but the Reauthorization Act is hugely important to all union members and working people. The current legislation, Safe, Accountable, Flexible Efficient Transportation Equity Act: A Legacy for Users (SAFETEA -LU ) expires September 30, 2011. The reauthorization of federal transportation policy presents an important opportunity for union leaders and members to advocate for key policy reforms that will create good union jobs, defend and expand the role of the public sector in transportation, provide safe and affordable mobility to working families and reduce the transport sector’s contribution to air pollution and climate change.

The state of the U.S. transportation system determines working families’ access to affordable, high-quality mobility and, in turn, their ability to meet essential needs such as getting to work, school, medical services, recreation and more. The maintenance and operation of private vehicles consumes a growing portion of working families’ household budgets and puts owning and operating a vehicle completely out of reach for some. The impact of rising gas prices on working families’ mobility exacerbates the fact that only 50% of Americans have access to public transit. (need citation) Furthermore, in response to budget shortfalls, local governments have increased fares, laid off workers, reduced transit services and offered up public transit systems to privatization.
