Making "Build Back Better" Better: Aligning Climate, Jobs, and Justice

At the end of March 2021, President Joe Biden laid out his $2 trillion American Jobs Plan–part of his "Build Back Better" infrastructure program–to "reimagine and rebuild a new economy." Congress is expected to spend months debating and revising the plan. The public and many special interests will play a significant role in that process. President Biden has promised to follow up with additional proposals to further address climate policy and social needs.

Many particular interests will seek to benefit from the overall Build Back Better program–and that's good. But as Congress and the public work to shape the ultimate form of that program, we also need to keep our eyes on the ultimate prize: combining climate, jobs, and justice. What policies can integrate the needs of working people, the most oppressed, and our threatened climate and environment?

The Green New Deal reconfigured American politics with its core proposition: fix joblessness and inequality by putting people to work at good jobs fixing the climate. The Biden administration's Build Back Better (BBB) plan has put that idea front and center in American politics. Now we need to specify strategies that will actually achieve all three objectives at once.

There are many valuable plans that have been proposed in addition to Biden's Build Back Better plan. They include the original Green New Deal resolution sponsored by Sen. Ed Markey and Rep. Alexandria Ocasio-Cortez; the THRIVE (Transform, Heal, and Renew by Investing in a Vibrant Economy) Agenda; the Evergreen Action Plan; the Sierra Club's "How to Build Back Better" economic renewal plan; the AFL-CIO's "Energy Transitions" proposals; the BlueGreen Alliance's "Solidarity for Climate Action," and a variety of others. All offer contributions for overall vision and for policy details.

There are six essential elements that must be integrated in order to realize the Build Back Better we need for climate, jobs, and justice:

  • Managed decline of fossil fuel burning
  • Full-spectrum job creation
  • Fair access to good jobs
  • Labor rights and standards
  • Urgent and effective climate protection
  • No worker or community left behind

These strategies can serve as criteria for developing, evaluating, and selecting policies to make Build Back Better all that it could be.

Supporting the Nation’s Coal Workers and Communities in a Changing Energy Landscape

The shift to a low-carbon economy has proceeded largely without thoughtful plans or preparation for the workers and communities that have sustained the US economy for more than a century. The economic upheaval resulting from the dramatic job losses in the coal industry over the last decade has uprooted families, deepened economic anxiety, and left community leaders scrambling to keep schools open and social services in place. And the trend is set to continue: many more coal workers and communities are facing the same fate without intentional policies to address these changes.

As part of this shift, the nation must support coal workers in finding new career paths and help coal communities recover from the economic losses stemming from coal’s decline (see box). This will require long-term individual supports and benefits, long-term investments in community infrastructure, empowering local leadership to drive place-based solutions, and ensuring that the legacy of coal mines and coal-fired power plants is fully remediated. These elements are critical to a fair, just, and equitable move to low-carbon energy; are urgently needed; and must be sustained over time.

Ultimately, broader changes to our energy systems will impact a larger swath of fossil fuel–dependent workers and communities as we drive toward decarbonizing the economy by 2050. This policy brief focuses on coal-dependent workers because they have faced economic disruption over the past decade and are imminently threatened by the shift to lowcarbon energy in the near term.

But fortunately, there are solutions. New analysis by the Union of Concerned Scientists and the Utility Workers Union of America finds both that it is possible to support coal workers in the transition and that these comprehensive policies are affordable. Indeed, relative to the federal response to the Great Recession in 2008–2009 and the COVID-19 pandemic of 2020–2021, as well as the scale of investments needed to decarbonize our economy by 2050, investing in the nation’s coal workers comes with a relatively small price tag. Approximately 89,875 coal workers were employed in the United States in 2019. The cost of providing a comprehensive set of supports to the portion of these workers who will face job losses before reaching retirement age represents a tiny fraction of the estimated $2.5 trillion in additional capital investments in all energy sectors by 2030 that would be needed to reach net-zero emissions by 2050 (Larson et al. 2020). We estimate that the cost of these supports will range from $33 billion over 25 years to $83 billion over 15 years.

In Broad Daylight: Uyghur Forced Labour and Global Solar Supply Chains

The People’s Republic of China (PRC) has placed millions of indigenous Uyghur and Kazakh citizens from the Xinjiang Uyghur Autonomous Region (XUAR or Uyghur Region) into what the government calls “surplus labour” (富余劳动力) and “labour transfer” (劳动力转移)programmes. An official PRC government report published in November 2020 documents the “placement” of 2.6 million minoritised citizens in jobs in farms and factories within the Uyghur Region and across the country through these state-sponsored “surplus labour” and “labour transfer” initiatives. The government claims that these programmes are in accordance with PRC law and that workers are engaged voluntarily, in a concerted government-supported effort to alleviate poverty. However, significant evidence – largely drawn from government and corporate sources – reveals that labour transfers are deployed in the Uyghur Region within an environment of unprecedented coercion, undergirded by the constant threat of re-education and internment. Many indigenous workers are unable to refuse or walk away from these jobs, and thus the programmes are tantamount to forcible transfer of populations and enslavement.

It is critical that we examine the particular goods that are being produced as a result of this forced labour regime. This paper focuses on just one of those industries – the solar energy industry – and reveals the ways forced labour in the Uyghur Region can pervade an entire supply chain and reach deep into international markets. We concluded that the solar industry is particularly vulnerable to forced labour in the Uyghur Region because:

  • 95% of solar modules rely on one primary material – solar-grade polysilicon.
  • Polysilicon manufacturers in the Uyghur Region account for approximately 45% of the world’s solar-grade polysilicon supply.
  • All polysilicon manufacturers in the Uyghur Region have reported their participation in labour transfer programmes and/or are supplied by raw materials companies that have.
  • In 2020, China produced an additional 30% of the world’s polysilicon on top of that produced in the Uyghur Region, a significant proportion of which may be affected by forced labour in the Uyghur Region as well.

In the course of this research, we identified:

  • 11 companies engaged in labour transfers
  • 4 additional companies located within industrial parks that have accepted labour transfers
  • 90 Chinese and international companies whose supply chains are affected

This report seeks to increase the knowledge base upon which the solar industry determines its exposures to forced labour in the Uyghur Region. We investigated the entire solar module supply chain from quartz to panel to better understand the extent to which forced labour in the Uyghur region affects international value chains. The examples of engagement in these programs are meant to provide stakeholders with the evidence base upon which to judge risk of exposure to forced labour in the solar supply chain.

Essentially Unprotected: A Focus on Farmworker Health Laws and Policies Addressing Pesticide Exposure and Heat-Related Illness

FARMWORKERS ARE THE FOUNDATION of a trillion-dollar industry in the United States yet face a level of occupational risk unrivaled by most workers. Despite their prominence within the nation’s food system, farmworkers are largely invisible to most Americans, as are their sacrifces and challenges. To some degree, the COVID-19 pandemic forced the country to reckon with the inhumane realities of food production; farmworkers were quickly deemed essential. At the same time, farmworkers contracted the coronavirus at high rates due to the lack of enforceable COVID safety standards, crowded and unsafe working and housing conditions, and delayed federal assistance. As our nation begins to reckon with its long history of pervasive and systemic racism, law- and policymakers must confront the fact that the vast majority of farmworkers are foreign born, identify as Hispanic or Latino/a, are not native English speakers, earn low wages, and have long worked under extraordinarily hazardous conditions. A smaller percentage of farmworkers identify as Indigenous with some identifying an Indigenous language as the one in which they are most comfortable speaking while some may speak a language without a consistent written form, which makes reading and writing in any language impossible. Over half of farmworkers are either undocumented or migrant workers thereby limiting their labor rights,10 as well as their willingness to exercise the limited rights they possess to report health and safety violations for fear of retaliation through immigration enforcement. Estimates suggest approximately 524,000 farmworkers are under the age of 18.

Farmworkers face many different workplace hazards including injury from heavy machinery and repetitive motion, and illness from exposure to zoonotic disease, pesticides, and heat. For migrant farmworker women, signi%cant reproductive health issues are common. Children working in agriculture amount to less than 5.5 percent of working children in the country yet suffered 52 percent of work-related fatalities. Additionally, farmworkers often lack access to or cannot a(ord healthcare both because they earn extraordinarily low wages and due to rampant wage theft. Understandably, they may be reluctant to raise workplace concerns with their employers due to fear of retaliation. Climate change has exacerbated some of these conditions due to extreme heat and increased pesticide usage to combat the rising spread of pests.

Essential and in Crisis: A Review of the Public Health Threats Facing Farmworkers in the US

On March 19, 2020, in the midst of a global pandemic, the federal government declared farmworkers “essential workers.”1 From California to New York, the same communities called upon to keep Americans fed during an unprecedented period of sickness and uncertainty also suffered some of the most horrific Covid-19 infection and fatality rates. While individuals across the country grappled with the devastating impacts of the Covid-19 pandemic, farmworkers throughout the United States (US) were among those the US government called upon to risk their health and the health of their communities in order to keep groceries on the shelves for millions of Americans.

Despite the government’s public acknowledgement of the essential role that farmworkers fill in our food system, farmworkers were denied the most basic public health protections. This incongruity was nothing new. Americans have long relied on the skilled and arduous labor of farmworkers to fuel our food system, while the US government and agricultural employers fail to provide protection or address systemic problems that make workers vulnerable to sickness.

Moreover, Covid-19 has only exacerbated existing inequities in our food system. Any future shocks to the US food system could leave farmworkers further exposed to exploitation and health risks. In this report, which is an update to the Center’s 2017 report, “Public Health, Immigration Reform, and Food System Change,” we review available research on a variety of public health threats that farmworkers face. We demonstrate how these health burdens are, in part, the result of laws, policies and practices that are intentionally designed to limit this workforce’s resources and recourse to fight against unsafe working conditions.

Ranking G7 Green Recovery Plans and Jobs: Can the UK boost its climate action and green job creation in line with its G7 peers?

This report ranks G7 countries’ green recovery and job creation plans. It shows how the UK is lagging behind its G7 peers, and the potential to do much more to expand green jobs and accelerate climate action.

The TUC’s ranking of all G7 countries’ green recovery and jobs investments shows that the UK comes sixth. Only Japan scores worse per person.

The UK’s green recovery plans remain only a tiny fraction of that in other G7 countries, despite the government’s flagship Ten Point Plan for a Green Industrial Revolution which purports to support the UK’s climate targets and establish UK world leadership in some areas of green technology. Scaled by population, the UK green investment plans are only 26% of France’s, 21% of Canada, 13% of Italy’s and 6% of the USA’s.

This means that the UK Prime Minister would need five Ten Point Plans to match Prime Minister Trudeau in Canada, eight Ten Point Plans to match Prime Minister Draghi in Italy, and sixteen Ten Point Plans to match President Biden’s in the US.

Label Before Labor: Fair Trade USA’s Dairy Label Fails Workers

Fair Trade USA released a new “Fair Trade Dairy” label in partnership with Chobani. It’s a program that has been opposed by farmworker and human rights organizations since it was first announced. Now that there is yogurt on the shelf, but still no final standard released, this report looks at the label claims and evaluates “Fair Trade Dairy” based on the available standards.

The critique focuses on three key areas:

  • Inadequate standards development process
  • Standards that are not fit for purpose
  • Lack of enforcement mechanisms

Finally, the report also reviews the rising tide of research that shows that corporate-developed and led certifications are inadequate and points instead to existing models that are better suited to defending workers’ rights and safety. Organized workers are pushing policy changes across the country, improving wages and winning vital workplace protections. And Worker-driven Social Responsibility programs are building power and supporting workers defending their rights and addressing the fundamental power imbalances in the food system.

The report concludes that:
“Corporate consolidation, trade policy, and other macro trends are squeezing farmers and workers in the dairy industry. To address the forces at work requires addressing the imbalance of power head on. If we are to envision a world where those at the top of supply chains are held accountable, we must support programs that are transformative. Instead of reinforcing existing systems of power, we should look to the leadership of those who have been protesting, leading, and advocating for their own communities for hundreds of years.”

Reducing new mining for electric vehicle battery metals: responsible sourcing through demand reduction strategies and recycling

This research investigates the current status and future potential of strategies to reduce demand for new mining, particularly for lithium-ion battery metals for electric vehicles. This study is focused on four metals which are important to lithium-ion batteries: cobalt, lithium, nickel and copper.

In order to meet the goals of the Paris Climate agreement and prevent the worst effects of catastrophic climate change, it will be essential for economies to swiftly transition to renewable energy and transport systems. At present, the technologies required to produce, store and utilize renewable energy require a significant amount of materials that are found predominantly in environmentally sensitive and often economically marginalized regions of the world. As demand for these materials increase, the pressures on these regions are likely to be amplified. For renewable energy to be socially and ecologically sustainable, industry and government should develop and support responsible management strategies that reduce the adverse impacts along the material and technology supply chains.

There are a range of strategies to minimize the need for new mining for lithium-ion batteries for electric vehicles, including extending product life through improved design and refurbishment for reuse, and recovering metals through recycling at end of life. For example, we found that recycling has the potential to reduce primary demand compared to total demand in 2040, by approximately 25% for lithium, 35% for cobalt and nickel and 55% for copper, based on projected demand. This creates an opportunity to significantly reduce the demand for new mining. However, in the context of growing demand for electric vehicles, it will also be important that other demand reduction strategies with lower overall material and energy costs are pursued in tandem with recycling, including policy to dis-incentivize private car ownership and make forms of active and public transport more accessible. While the potential for these strategies to reduce demand is currently not well understood; this report provides insights into the relative merits, viability, and implications of these demand reduction strategies, and offers recommendations for key areas of policy action.

Freight Automation: Dangers, Threats, and Opportunities for Health and Equity

Freight Automation: Dangers, Threats, and Opportunities for Health and Equity explores how automation in the freight transportation system affects the health of workers, communities, and the environment—and also how these effects will be inequitably felt by people with low incomes and communities of color. Created PHI’s Regional Asthma Management and Prevention, Moving Forward Network, Human Impact Partners and community partners, the report also provides recommendations for policies and programs that promote health and equity for frontline workers and fence-line communities.

Community Hearing on Transit Equity 2021: Findings and Recommendations

In February 2018, the Amalgamated Transit Union (ATU) partnered with the Labor Network for Sustainability to launch Transit Equity Day in honor of Rosa Parks’ birthday, which is on February 4. We chose to honor Rosa Parks for the role she played in the civil rights movement by refusing to give up her seat at the front of the bus and, in doing so, lift up transit as a workers’ rights, civil rights, and climate-justice issue.

Since its launch, Transit Equity Day has grown each year. In 2020, there were events in 50 cities and a social media explosion that brought attention to transit equity beyond just the participating locations. Just as important, a Transit Equity Network emerged through the process. Consisting largely of grassroots advocates, the network has grown and relationships have deepened both locally and nationally.

After the success of Transit Equity Day 2020, participants were ready to work together on a national initiative. We wanted to develop a stronger sense of unity and shared values. We sought to shape a broad vision of what we wanted from our transit systems across the nation. But rather than creating a vision document ourselves, the Transit Equity Network leaders wanted first to hear directly and collectively from transit stakeholders—riders, workers, families reliant on transit, and community activists—about their needs, frustrations, and hopes.

Then came the COVID-19 pandemic and, with it, a transit crisis. With ridership plummeting and state and local budgets imperiled, it became clear that transit was facing an existential threat. The pandemic laid bare the crisis of inequality and highlighted the essential need for transit. While thousands of workers in sectors not considered essential stopped using transit, millions of essential workers continued to need to get to their jobs: workers in healthcare, public service, food and agriculture and others continued to work to keep us safe and healthy. Many of these workers were in low-wage jobs and dependent on transit, but transit services were being cut and health and safety was not adequately addressed in many systems that remained in service. The dangers associated with the pandemic were exacerbated for unemployed and low-income riders who rely on transit to get to healthcare appointments, grocery stores, pharmacies, and other necessary retail establishments. The idea of holding a (virtual) community hearing on transit was born in this context. The crisis caused by the pandemic made it even more apparent that we needed to hear directly from transit riders and workers about how to address the crisis in the short-term and improve the system in the long-term. For Transit Equity Day 2021 we convened two days of live testimony–as well as pre-recorded testimony–over Zoom with hearing facilitators who came from the policy and social justice world, with Spanish interpretation and to the extent we were able, accommodations for the physically challenged.

This report is a summary of those hearings–rooted in the experience of workers and riders. We have tried to highlight recurring themes, distill the most salient points and remain faithful to the intent of the testimony. Transit riders and workers were very clear about the important role transit plays in their lives and in their community. At the same time, they identified problems with the current system and offered constructive solutions to address them. We structured each key theme of these findings in a similar fashion: 1) recognize the critical benefit of public transit to those who are most vulnerable; 2) identify the existing problems and inequities in public transit; 3) propose policy solutions to both fix and improve public transit.
