US Energy Transition Presents Organized Labor With New Opportunities, But Also Some Old Challenges

President Biden’s push for “good, union jobs” in clean energy has increased hope that organizing solar and wind workers can close the pay gap between them and fossil fuel workers.

Two years ago, Skip Bailey noticed a lot of trucks from a company called Solar Holler driving around Huntington, West Virginia. A union organizer with the International Brotherhood of Electrical Workers, Bailey saw an opportunity.

“We want to get in on the solar business,” he said, predicting the industry will grow in his home region, which includes historic coal communities in West Virginia, Kentucky and Ohio.

Bailey talked to Solar Holler about unionizing its employees who install photovoltaic panels on homes. IBEW showed the company its local training facility for electricians, and explained the health insurance and pension plans it offers. 

“It wasn’t a hard sell in either direction,” said the company’s founder and CEO, Dan Conant. He was already interested in securing union protections for his employees when Bailey contacted him, he said. The move fit with Solar Holler’s dedication to West Virginia’s legacy of energy production and strong union membership.

“It was not just good business, but it just really spoke to our history as a state,” he said.

Conant and Bailey’s efforts paid off in March 2020, when IBEW Local 317 and Solar Holler signed a contract. It’s just a start—Solar Holler only has about 20 unionized employees—but the agreement is an early example of the future Joe Biden is promising. The president frequently pledges to create millions of jobs while transitioning the U.S. to clean energy. Every time he does, he’s quick to add that these will be “good, union jobs that expand the middle class.”

“It’s a great talking point,” said Joe Uehlein, president of the Maryland-based Labor Network for Sustainability, an advocacy group pushing to unionize green jobs. But he added that Biden faces a difficult balancing act to achieve his pledge.

Texas is currently confronted by three major, intersecting crises: the COVID-19 public health pandemic and ensuing economic crisis; a growing crisis of inequality of income, wealth, race and power; and the worsening climate crisis, which continues to take its toll on Texans through hurricanes, major flood events, wildfires, debilitating heat waves and the significant economic cost of these extreme weather events. These crises both expose and deepen existing inequalities, disproportionately impacting working families, women, Black, Indigenous and people of color (BIPOC) communities, immigrants, and the most vulnerable in our society.

A well-designed recovery from the COVID-19 global health pandemic, however, can simultaneously tackle these intersecting crises. We can put people to work in high-quality, family- and community-sustaining careers, and we can build the 21st century infrastructure we need to tackle the climate crisis and drastically reduce greenhouse gas emissions and pollution. Indeed, in order to avoid the worst impacts of the climate crisis, it is essential that our economic recovery focus on developing a climate-friendly economy. Moreover, there are significant jobs and economic development opportunities related to building a clean energy economy. One study shows that 25 million jobs will be created in the U.S. over the next three decades by electrifying our building and transportation sectors, manufacturing electric vehicles and other low-carbon products, installing solar, wind and other renewables, making our homes and buildings highly-efficient, massively expanding and improving public transit, and much more.

Conversely, a clean, low-carbon economy built with low-wage, low-quality jobs will only exacerbate our current crisis of inequality. The new clean energy economy can support good jobs with good benefits and a pipeline for historically disadvantaged communities to high-quality, paid on-the-job training programs that lead to career advancement. Currently, the vast majority of energy efficiency, solar and wind work is non-union, and the work can be low-wage and low-quality, even as the safety requirements of solar electrical systems, for example, necesitate well-trained, highly-skilled workers.

Labor Principles for Transportation Electrification

The Labor movement stands united in our support for good, middle-class jobs, policies that address climate change, and safe transportation that brings equitable benefits to communities across the country. As our infrastructure evolves and adapts to new challenges, new technologies, processes, and business models meant to face these challenges must advance these goals. Today, our nation is grappling with the challenge of transitioning to zero-emission transportation vehicles and infrastructure over the next few decades.

We cannot let the Wall Street and multinational corporations alone decide how to move forward on these issues. While we will all continue to advocate for modal and union specific concerns, the undersigned unions have come together to adopt the following principles that will guide our policy advocacy, collective bargaining, and organizing efforts as we all work to reduce greenhouse gas emissions in our industries and advance racial and environmental justice.

A Debate Over Carbon Capture in the Infrastructure Bill Could Test the Labor-Climate Alliance

President Biden wants to include carbon capture technology in his push for infrastructure investment. While unions are on board, some climate groups are keeping quiet for now.

In late March, President Joe Biden unveiled a $2.3 trillion infrastructure package, the American Jobs Plan, that his administration hopes to move forward this year. The plan would make major investments in improving physical infrastructure such as roads, schools and bridges while also creating good-paying jobs, expanding collective bargaining rights and funding long-term care services under Medicaid. 

The president’s plan also endorsed another proposal that a group of bipartisan lawmakers hope makes it into a final bill: expanding carbon-capture utilization and storage (CCUS) in the United States. The SCALE Act, introduced in mid-March by eleven senators and six House representatives, represents the country’s first comprehensive CO2 infrastructure and jobs bill. In describing the president’s infrastructure plan, the White House said it ​“will support large-scale sequestration efforts” that are ​“in line with the bipartisan SCALE Act.” 

The legislation, which would authorize $4.9 billion in spending over five years, would create programs to transport and store carbon underground. Its provisions include establishing low-interest loan programs modeled off of federal highway development programs, increasing EPA funding for permitting carbon storage wells, and providing grants to states to create their own permitting programs. Advocates point to countries such as Canada, Norway and Australia where elected officials have made similar investments in carbon storage infrastructure. 

The SCALE Act is notable both for the support it has, and hasn’t, received. Its early endorsers include a half-dozen industrial labor unions, centrist climate groups like the National Wildlife Federation, and energy companies like GE Gas Power and Calpine. Fossil fuel industry support for carbon-capture has historically been a top reason why progressive climate groups, meanwhile, remain skeptical of the idea, wary of subsidizing anything that amounts to corporate giveaways to some of the world’s worst polluters. While carbon-capture has long been a flashpoint in Democratic climate politics, most critics of the policy have stayed quiet on the SCALE Act for now.

Modeling released in December by the Princeton Net-Zero America Project found that construction of nearly 12,000 miles of pipelines capable of storing 65 million tons of CO2 per year would be needed by 2030 for the United States to reach net-zero emissions by 2050 — a stated goal of the Biden administration. The Clean Air Task Force, a climate advocacy group, says the SCALE Act programs are ​“consistent” with the quantity and timeline of infrastructure deployment needed to meet those goals.

To date, nearly all U.S. carbon-capture projects are situated near existing CO2 pipelines and Lee Beck, the CCUS policy innovation director at the Clean Air Task Force, says the SCALE Act’s goal would be to capture emissions from multiple sources and then transport the CO2 for storage elsewhere, as is currently being carried out through Canada’s Alberta Carbon Trunk Line System and Norway’s Northern Lights Project.

Supporters point to a number of recent scientific analyses that make the case for greater investment in carbon-capture. In February, the National Academies of Sciences released a report on decarbonizing the U.S. energy system which recommends that, over next decade, officials should focus on increasing deployment of carbon-capture technologies by a factor of ten while investing in permanent CO2 storage infrastructure. In 2020, the International Energy Agency warned that it would be ​“virtually impossible” to reach net-zero emissions without carbon capture technology, and the Intergovernmental Panel on Climate Change has said carbon capture is likely necessary to meet global climate targets. Supporters note that renewable energy sources like wind and solar are not viable alternatives for reducing carbon emissions in the industrial sector, which account for 32 percent of the United States’ energy use and nearly a quarter of its direct greenhouse gas emissions. 

Workers and Communities in Transition: Report of the Just Transition Listening Project

The idea of “just transition” has recently become more mainstream in climate discourse. More environmental and climate justice advocates are recognizing the need to protect fossil-fuel workers and communities as we transition away from fossil-fuel use. Yet, as detailed in our report, transition is hardly new or limited to the energy industry. Throughout the decades, workers and communities have experienced near constant economic transitions as industries have risen and declined. And, more often than not, transition has meant loss of jobs, identities, and communities with little to no support.

While transition has been constant, the scale of the transition away from fossil fuels will be on a level not yet experienced. Fossil fuels are deeply embedded in our economy and society. Transition will not only affect the energy sector, but transportation (including passenger and freight), agriculture and others. Adding to the challenges of the energy transition, we are also transitioning to a post-COVID-19-pandemic world. As such, we cannot afford, economically or societally, to repeat the mistakes of the past that left so many workers and communities behind.

To better understand how transition impacts people, what lessons can be learned, and what practices and policies must be in place for a just transition, in the Spring of 2020 we launched the Just Transition Listening Project (JTLP). The JTLP has captured the voices of workers and community members who have experienced, are currently experiencing, or anticipate experiencing some form of economic transition.

Those who have suffered from transitions are rarely the ones whose voices are heard. Yet, no one is more able to fully understand what workers and communities need than those who have lived that experience. The JTLP is the first major effort to center these voices. In turn, the recommendations provided can make communities and workers whole. In many ways, these recommendations are common sense and fundamental to creating a just society, regardless of transition. Yet, the failure of elected officials to deliver just transition policies points to the need for wide scale movement building and organizing.

This report summarizes lessons learned and policy recommendations in three overall concepts for decision-makers: Go Big, Go Wide, and Go Far.

Right to Work on a Hot Planet

By 1961, Charles Koch had stacked up three engineering degrees and was back home in Wichita, Kansas, to join the family business of oil refining, pipelines, and manufacturing. His father, Fred, was at the time attempting to tackle a different sort of engineering challenge: how to get unions, Communists, and big government off his back. The Nazi sympathizer Koch patriarch fought against unions in Kansas, and when the John Birch Society convened its inaugural meeting in 1958—initially composed exclusively of National Association of Manufacturers members—he enthusiastically attended as a co-founder. According to a 1961 Washington Post profile of Koch’s white supremacist conspiracy-theory club, “leadership of the Birch Society overlaps heavily with the leadership of the organizations that successfully campaigned in 1958 for a right to work amendment to the State’s Constitution.” Fred died in 1967, but Charles eagerly put his education to work carrying on his family’s 60-year war against collective bargaining rights and that pesky concept known as representative democracy. When it comes to right to work, especially, labor and climate campaigners quite literally share a common enemy. 

If those two groups have found it difficult to join forces, their adversaries are elegantly streamlined. During the Obama administration, Koch Industries trained its fossil fuel empire on the twin goals of turning legislatures red and pushing through deceptively named right-to-work statutes, all the while finding time to help kill federal climate legislation. Though no state had enacted right-to-work rules since Oklahoma in 2001, five have taken them up since 2012. This most recent push has focused on sapping public sector workers’ collective bargaining rights, in particular, like the bill that led thousands of union members to peacefully occupy Wisconsin’s capitol dome in 2011. 

That some of the most high-profile targets of anti-labor measures have been swing states with strong union legacies—namely, Wisconsin, Ohio, and Michigan—is no coincidence. As E.J. Dionne pointed out after Michigan enacted its right-to-work measures in 2013, Obama had won 66 percent of the state’s union households a year earlier. He won the state overall by just 1 percent. In 2018, the right’s biggest win against unions came with the decision in Janus v. AFSCME, which made right to work the national standard for public-sector workers. The crux of that case was AFSCME member Mark Janus’s argument—in a case supported enthusiastically by Koch networks—that being forced to pay agency fees—which cover the costs of union representation and contract negotiation—violated his free speech. This was a major blow to unions’ capacity to extract gains from employers, weakening labor’s power overall. That’s the whole point.

For Charles Koch and other captains of industry, the calculation behind crushing unions isn’t complicated: Weaker unions mean a weaker opposition to right-wing policies, including the sort of regressive climate and energy measures they’ve helped push around the country through the American Legislative Exchange Council. The right’s general project of minority rule—whether in weakening small-d democratic institutions like unions, gerrymandering congressional districts, or suppressing votes—is incompatible with climate action and democracy itself. Big business has long understood this. 

What’s ahead for Canadian climate and energy policy in 2021?

The Canadian government has a full climate change agenda ahead when it reconvenes Parliament on January 25, not the least of which will be the debate and passage of Bill C-12, the Net-Zero Emissions Accountability Act , analyzed by the Climate Action Network here. After its introduction in November, C-12 was criticized for lacking urgency and specific plans – for example, in an article by Warren Mabee in The Conversation which calls for three per cent to four per cent GHG reductions “every year, starting now.”

On December 11, the government released its latest climate plan, A Healthy Environment and a Healthy Economy, previously discussed in the WCR and noted primarily for its proposed carbon tax hike to $170 per tonne by 2050. According to “The good, the bad and the ugly in Canada’s 2030 climate plan” (The National Observer, Jan. 18): “The good news is that …The government’s recently announced A Healthy Environment and a Healthy Economy plan contains enough new climate policy proposals that, if implemented, will allow Canada to reach its 2030 target. The bad news is….Climate laws enacted by Canadian politicians to date don’t come anywhere close to meeting our 2030 target. With time running out and a gigantic emissions gap to close, Canada needs to enact climate laws now.”

Why Unions Are the Key to Passing a Green New Deal

There’s a persistent conservative myth that the clean energy transition must come at the expense of employment. Nothing could be further from the truth, though. The Congressional resolution on a Green New Deal, introduced by Rep. Alexandria Ocasio-Cortez and Sen. Ed Markey last February, includes a proposal guarantee employment to all those who want it. And increasingly, climate activists are focusing on the potential to create millions of good jobs in clean energy.

These pro-worker proposals—and the knowledge that it will take an economy-wide effort to kick fossil fuels and the curb to avert climate catastrophe—have won the platform support from swaths of the labor movement. Yet some powerful unions still oppose the sweeping proposal. The president of the AFL-CIO—the largest federation of unions in the U.S.—criticized the Green New Deal resolution, and heads of the Laborers’ International Union of North America, the United Mine Workers of America, and the International Brotherhood of Electrical Workers have outright opposed it. That poses a political roadblock to achieving the necessary transformation of the U.S. economy. 

“The Green New Deal movement needs broader support from the labor movement to be successful,” Joe Uehlein, founding president of the Labor Network for Sustainability and former secretary-treasurer of the AFL-CIO’s Industrial Union Department, said. “As long as labor isn’t a central player in this movement, they will they have the power to block pretty much anything. on Capitol Hill. They contribute in electoral campaigns. They’re a very powerful force.”
